Not generally, based on the named products’ published terms as of October 7, 2026. xStocks says it is unavailable to U.S. residents and U.S. persons, and Ondo Stocks says it is offered only outside the United States to eligible non-U.S. persons. A temporary SEC exemption announced in September 2026 creates a limited pathway for certain venues, but does not establish that a particular product is open to U.S. customers.
What does “tokenized stock” mean?
The term does not describe one uniform kind of investment. Investor.gov defines tokenized securities as financial instruments—such as stocks, bonds, or fund interests—formatted as or represented by a crypto asset recorded on a blockchain or similar distributed ledger. Depending on the product’s legal structure, a token might represent a security held through an intermediary or an entitlement or economic exposure connected to one. The label alone does not establish that the token holder owns an ordinary share or has the same rights as a brokerage shareholder. Investor.gov’s overview of tokenized securities explains the distinction.
What does the SEC’s 2026 exemption change?
On September 17, 2026, the SEC announced temporary, conditional exemptive relief for Tokenized Securities Venues to trade tokenized National Market System (NMS) stock through specified permissioned automated market makers and liquidity pools. The SEC called it an “Innovation Exemption.” It is a limited regulatory pathway tied to the order’s conditions—not blanket permission for unregistered platforms, a general approval of tokenized stocks, or confirmation that a particular venue has launched a product for retail customers. The order and an individual customer’s access to a live offering are separate questions. See the SEC announcement and Commissioner Hester M. Peirce’s statement.
What do xStocks and Ondo Stocks say about U.S. eligibility?
| Offering | Published eligibility information | What that establishes |
|---|---|---|
| xStocks | Its official site says xStocks are not available to U.S. residents or U.S. persons. Its partner page says integrations require geographic-compliance measures and are subject to eligibility review. xStocks; xStocks partner information. | A token appearing in a wallet, or being accessible through a partner integration, does not override the stated geographic restriction or prove a U.S. user is eligible. |
| Ondo Stocks | The product page says the offering is only for eligible non-U.S. persons outside the United States. Ondo Stocks. | The published terms describe an offshore offering, not access for U.S. residents. |
Ondo separately announced on July 23, 2026, that its broker-dealer subsidiary Oasis Pro Markets received U.S. regulatory authorizations for activities involving tokenized equities and funds. That company announcement does not by itself show that Ondo Stocks—or another named retail product—is live for U.S. customers, nor that every U.S. resident can use it. Ondo’s announcement concerns the subsidiary’s authorizations; check the specific product’s current terms for customer eligibility.

What should you verify before using a named offering?
Check the specific product’s current terms and the relevant venue or intermediary directly. Eligibility can depend on more than a U.S. address: state, residency, investor category, and account type may matter. Confirm these points before funding an account or attempting a transfer:
- Legal instrument: Is the token itself the security, or does it represent an entitlement or economic exposure tied to an underlying security?
- Customer eligibility: Does the offering accept your state of residence, residency status, investor category, and account type?
- Venue and intermediaries: Which venue, broker-dealer, and custody arrangements are involved, and what role does each play?
- Investor rights and asset handling: What do the terms say about voting, dividends, custody, transfers, and redemption?
- Trading conditions: What are the trading hours, liquidity arrangements, and applicable fees?
Do not treat technical transferability, a partner integration, a regulatory announcement, or the presence of a token in a wallet as a substitute for confirming both the product terms and your own eligibility.
