A GST rate change does not mean every invoice issued after the effective date should use the new rate. In India, the applicable rate depends on the particular goods or service, its notified effective date, and the statutory time-of-supply rules—especially when supply, invoice, or payment dates fall on different sides of the change. Check those facts first; then calculate the tax and decide separately whether to revise the customer-facing price.
Start with the supply and its effective rate
GST rates are not uniform across small businesses or even across all of one business’s sales. Identify the precise goods or service, confirm its classification, and check the rate and effective date in the applicable notification. The CBIC and GST Council materials are official places to verify rate notifications. A general guide cannot determine the rate for an unidentified supply.
A dated example: the Ministry of Finance FAQ on the 56th GST Council’s decisions said most changes to goods and services rates took effect on 22 September 2025. It identified cigarettes, chewing tobacco products such as zarda, unmanufactured tobacco, and beedi as exceptions whose existing rates would continue until a later notified date. This was a specific transition, not a rule for future changes or every supply; verify the notification and effective date for the item in question. How to decide which rate applies across a change date
When a transaction spans a rate change, the invoice date alone does not settle the rate. Section 14 of the Central Goods and Services Tax Act sets out the time-of-supply cases for a change in tax rate. The result depends on when the supply occurred and when the invoice was issued and payment received, as applicable to the statutory case. Central Goods and Services Tax Act, section 14.

For example, a supply completed before a rate change but invoiced afterward cannot be assigned a rate just by looking at the later invoice date. Match the transaction’s dates to the relevant section 14 case. Use this transition check
- Identify the supply. Confirm the goods or service classification and its notified rate and effective date.
- Write down the dates. Record when the supply occurred, when the invoice was issued, and when payment was received.
- Apply section 14. Determine which statutory case fits those dates. Do not assume the announcement date, advance date, or invoice date alone controls.
- Check any invoice already issued. Confirm that it records the applicable rate and tax amount, and use the applicable correction process if the document needs adjustment.
Advances and incomplete supplies
If you received an advance or the supply is not yet complete, apply the time-of-supply provisions to the actual facts. An advance does not create a one-size-fits-all answer about which rate applies. Separate the tax calculation from the customer price
A rate change affects the tax calculation; it does not by itself require a business to change its pre-tax selling price. The invoice and the commercial quote answer different questions: the invoice must show the applicable tax, while the seller decides whether to hold the pre-tax price or the customer’s total steady, subject to the relevant commercial arrangement.

These are arithmetic consequences, not a claim about how small businesses usually pass rate changes on to customers. The outcome for a particular sale depends on the agreed price basis, the applicable rate, and the time-of-supply result.

What to check on invoices
For a registered seller required to issue a tax invoice, CBIC’s invoice rules include the rate of tax and amount of tax among the prescribed particulars. Check that both match the supply and the rate established for its effective date. CBIC, CGST Rules, 2017, Part A.
Invoice obligations depend on registration status. CBIC’s FAQ says registered persons must issue tax invoices under section 31 and the rules; an unregistered person may issue an ordinary commercial invoice but cannot issue a tax invoice. Do not treat every small business as a registered taxpayer. CBIC GST FAQ.

When an invoice needs a correction or adjustment
CBIC FAQ material describes credit notes as relevant in cases such as excess taxable value or excess tax on an invoice, subject to section 34 and its conditions. A credit note is not a universal substitute for checking the transaction’s dates, applicable rate, and current reporting requirements. CBIC GST FAQ.
The same FAQ explains that a discount given before or at the time of supply and duly recorded on the invoice is excluded from taxable value under the described conditions. It also identifies credit notes as potentially relevant to returned goods and excess tax or value. Check the current statutory conditions before making a specific adjustment. CBIC GST FAQ.

Keep a record of the rate decision
For a sale near a rate-change date, retain the classification and notification checked, the supply, invoice, and payment dates, and the reasoning used to apply section 14. This makes it easier to explain why the invoice uses a particular rate and to correct an error through the applicable process if needed. The rate itself must still be verified for the specific supply and effective date.
