Employers should keep the plan active through arrival and return. No device practice or travel policy can eliminate legal, surveillance, detention, or other risks.
Start with the destination and the employee’s situation
“China” is not a single advisory area for travel planning. The U.S. Department of State’s China Travel Advisory, issued September 4, 2026, assigns mainland China Level 2, “Exercise increased caution.” It cites arbitrary enforcement of local laws, exit bans, and risk of unjust arrest or detention. The advisory discusses Hong Kong and Macau separately; check their current guidance rather than applying the mainland assessment to them.
The U.S. advisory is guidance for U.S. travelers, not a determination of another nationality’s legal or consular position. Employees should consult their own government’s current travel advice. For any traveler, the employer should consider the person’s circumstances and the trip’s purpose rather than treating the advisory as a prediction about an individual.

For mainland travel, the State Department says national-security, counterespionage, and data-security laws can give authorities broad discretion, and it describes potential risks in routine business and research activity. It also notes heightened scrutiny may affect people involved in business disputes or connected to U.S. corporate entities involved in such disputes. Employers should have qualified counsel assess specific exposure where relevant, not infer that any particular employee will be targeted.

Confirm the work authorization before travel
A business visit is not automatically authorized work. Match the visa and permissions to the activities and length of stay, and verify the current rules before departure. The Chinese government-hosted 2025 expatriate guide says foreigners working in China should obtain a work permit and describes Z-visa procedures for work of up to 90 days and for longer stays, including a work-related residence permit after entry for longer work. These are details from the 2025 guide, not a guarantee that the procedure or eligibility remains unchanged.
A 2026 edition of the guide was published July 10, 2026, according to a State Administration of Foreign Exchange notice. Because the available notice confirms publication but does not provide the full procedural text, employers should check the 2026 guide and relevant official Chinese sources for current requirements before relying on specific steps. Do not rely on visa-free eligibility language in the 2025 guide that expired December 31, 2025.

- List the employee’s actual planned activities, work location, and expected duration; give that description to the immigration adviser or appropriate authority when checking the correct authorization.
- Have the employer and employee retain the relevant approval and contact details, and identify who will address a delay, refusal, or change in duties.
- For a longer assignment, confirm applicable work-permit, residence-permit, and residence-registration obligations using current official instructions.
Build an employer travel plan before departure
Assign one employer contact who can respond during the trip and a backup who can act if the primary contact is unavailable. Give the employee a concise contact sheet with employer escalation details, local support arrangements, and consular contacts appropriate to their nationality. Agree in advance how the employee will check in, what to do if a check-in is missed, and how urgent concerns should be escalated.
The National Counterintelligence and Security Center’s 2024 Companies: Travel Security Guidance is designed to help companies develop overseas travel-security policies. It addresses preparation, hotels, and meetings, conferences, and social events, and says employers should apply the guidance in the context of relevant law, regulation, agreements, and policy. Use it as a framework for a company-specific plan, not as a substitute for local legal or operational advice.

- Set the level of support according to the destination, travel duration, employee circumstances, data sensitivity, and the organization’s ability to respond.
- For trips involving sensitive, regulated, or strategically important information, decide in advance what information and system access are genuinely necessary and who can approve exceptions.
- Give employees a way to report a concerning approach, unexpected questioning, lost property, or other incident promptly, and explain who will receive the report.
Reduce device and information exposure
The State Department’s general Business Travel and Work Abroad guidance, last updated August 11, 2025, recommends discussing device and data protection with the employer before travel. These are general business-travel practices, not China-specific guarantees. Apply the organization’s security policy and the employee’s actual role when deciding which measures are appropriate.
- Before departure: Agree with the employer on what data and equipment are needed. Install current security patches and company-approved antivirus or anti-spyware software, and confirm the employee knows how to contact the company security team.
- During the trip: Keep electronics, paperwork, and sensitive materials with the traveler. Do not attach unknown storage devices or peripherals. Treat hotel, airplane, internet-café, and public Wi-Fi as non-private; do not assume a network is confidential just because it requires a password.
- On return: Follow the employer’s device-check process, inspect devices, and change passwords as advised by the company. Report suspicious approaches or events to the company security team; the State Department also advises U.S. travelers to report relevant concerns to the FBI.
Controls can reduce unnecessary exposure, but they do not prevent surveillance, compelled access, detention, or legal consequences. Do not promise employees that a particular phone, app, network, or configuration makes travel risk-free.

Review cross-border employee data before it moves
Travel can involve transferring employee information from China to systems or recipients outside the country—for example, through company systems used abroad. Under its July 24, 2026 policy FAQ, China’s Cyberspace Administration says that when personal information is provided outside China, the processor is to notify the individual and obtain separate consent under the cited Personal Information Protection Law provisions, subject to the stated statutory exceptions. For sensitive personal information, the individual should also be told why the cross-border transfer is necessary and how it may affect their rights.
Employers should have qualified privacy or legal counsel review the actual data flow rather than treating travel, an employment relationship, or a general acknowledgment as blanket consent. The review should identify what information is transferred, who receives it, the purpose and scope, the applicable legal basis, and the transfer mechanism. This is a compliance question about the employer’s data practices, not merely a device-setting decision.

Prepare for arrival and an incident
The Chinese government-hosted expatriate guide lists these emergency numbers. Confirm local arrangements and any language support before relying on them, and make sure employees can reach the employer’s designated contact as well.
- 110: Police for assault or property crime.
- 119: Fire.
- 120: First aid.
The guide says a lost passport should be reported immediately to a local police station. Employees should also have nationality-appropriate consular contact information and know how to reach employer support. Emergency numbers alone are not a medical, transport, or occupational-safety plan; make arrangements suited to the assignment and location.
Close the loop after the trip
On return, complete the company’s device and account checks, collect any incident reports, and review whether the employee’s access or information-handling arrangements should change. For recurring or sensitive travel, use those lessons to update the travel policy and decide whether the organization needs more tailored security support. Recheck official advisories, entry and work rules, and privacy requirements before each trip because they can change.
