The scheme has two different disclosure routes: one for specified undisclosed foreign assets or income with an aggregate ceiling of ₹1 crore and a 60% payment calculation, and a narrower route for certain assets worth up to ₹5 crore with a fixed ₹1 lakh fee. Which route may apply depends on how the asset was acquired, why it was omitted, and your tax residence in the relevant years.
What FAST-DS 2026 does—and what it does not automatically cover
The Foreign Assets of Small Taxpayers Disclosure Scheme, 2026 (FAST-DS) is a time-limited route for eligible taxpayers to declare specified foreign assets or foreign income and make the prescribed payment. Eligibility is not determined simply by owning something overseas: residence history, the source of funds, and the reason the asset or income was not reported all matter. The Income Tax Department’s Form 1 user manual describes an undisclosed asset as an asset, including a financial interest in an entity, located outside India and held in the taxpayer’s name or as beneficial owner where the source of investment is unexplained or unsatisfactory. It also provides an “any other asset” category.
That general wording does not settle whether a particular crypto holding is covered. The official materials retrieved for FAST-DS do not expressly address crypto-assets, exchange custody, private keys, self-custody, situs, or crypto valuation. Do not assume every overseas exchange account, token, or wallet qualifies. Get confirmation from the notified rules or a qualified Indian tax professional familiar with foreign assets and crypto before declaring a holding or calculating its value.
How the ₹1 crore and ₹5 crore routes differ
The figures are ceilings for different categories, not interchangeable deductions and not one universal threshold. The first route addresses specified undisclosed foreign assets or foreign income. The second is limited to assets with particular acquisition and reporting histories.

The ₹1 crore ceiling and 30%-plus-equal-amount calculation are stated in the Income Tax Department’s Finance Bill 2026 scheme provisions. For foreign assets, the bill specifies value as of 31 March 2026. Do not apply that asset valuation date to foreign income: the materials summarized here do not establish that it is the income valuation rule.
The ₹5 crore category is narrower than the first. It is not a general low-fee alternative for any foreign asset below that value. The asset must fit one of the stated histories, and the Income Tax Department FAQ states the ₹1 lakh fee where the applicable asset value does not exceed ₹5 crore.

Does FAST-DS cover crypto held on a foreign exchange or in a wallet?
The official Form 1 manual’s broad descriptions, including “any other asset,” are not a crypto-specific eligibility ruling. The retrieved FAST-DS materials do not establish how an exchange-held token or a self-custodied holding should be classified, where it is considered located, or how it should be valued. So the available guidance is not enough to conclude that either type qualifies—or that it is excluded.
Before filing, ask a qualified Indian tax professional to assess the exact asset, custody arrangement, source of funds, residence timeline, and applicable notified rules. Preserve records that may help establish those facts, such as exchange statements and transaction history, but do not treat this list as a substitute for the scheme’s required evidence or as proof of eligibility.

When and how to file
The Income Tax Department’s Form 1 of FADS 2026 User Manual states that declarations may be filed online from 16 August through 31 December 2026. CBDT announced on 1 September 2026 that Notification No. 114/2026 notified the FAST-DS rules and forms. Where a portal-manual summary or Finance Bill text differs from the notified rules, the notification and rules control.
- Submit Form 1 online. The manual describes sections for basic information, asset or income details, applicable annexures, a categorized summary and amount payable, and verification. The annexures cover bank accounts, immovable property, jewellery, artistic work, shares and securities, and any other asset. Attach valuation reports if applicable; the manual does not say every applicant needs one. Supporting documents may be uploaded as PDF or ZIP, and the declaration is electronically verified.
- Wait for Form 2. The tax authority determines the amount payable and issues Form 2 within the prescribed timeline described in the manual.
- Pay using ITNS 289, then submit Form 3. Make the payment after Form 2 and send Form 3 with proof of payment, following the prescribed timeline.
- Receive Form 4. After its prescribed review, the authority issues Form 4 certifying the declaration’s validity.
Check the payment details before paying
The Income Tax Department FAQ says ITNS 289 is prefilled for assessment year (AY) 2026–27, regardless of the year the asset was acquired or income earned. It also warns that an incorrect minor head cannot be corrected or refunded. Verify the challan details carefully before making payment.

The Income Tax Department’s Form 1 manual states that taxpayers making a valid declaration and payment receive immunity from further tax, penalty, and prosecution under the Black Money (Undisclosed Foreign Income and Assets) and Imposition of Tax Act, 2015, subject to prescribed conditions. That is not unconditional immunity, nor does the wording establish that every other tax, reporting, or criminal issue is resolved.
The department’s “Declaration on Foreign Assets and Income” brochure says penalties may apply for failure to file and disclose foreign assets or for inaccurate particulars, and that prosecution proceedings may be initiated under the Black Money Act. These are potential consequences under the law, not automatic outcomes for every error. If you are uncertain about a holding’s classification, eligibility, or value, get case-specific advice before filing.
