GSTAT Lucknow Ruling on Jai Enterprises: Why Suspicion Alone Was Not Enough to Prove E-Way Bill Reuse

A GSTAT Lucknow report says vehicle movements alone did not prove e-way-bill reuse in the Jai Enterprises dispute. The reported ₹6.62 lakh case conflicts with a reproduced order showing a different appeal number and amount.

The reported Lucknow GST Appellate Tribunal ruling turned on proof, not suspicion: authorities alleged e-way-bill reuse based on vehicle movements, but the tribunal reportedly found no independent evidence that the same goods had already completed a journey or been delivered. There is an important record mismatch, however: the LiveLaw Biz report identifies a ₹6,62,077 demand in APL/82/LCK/2026, while the available reproduced order text concerns APL/38/LCK/2026 and ₹6,06,844. The figures and case identities should not be treated as confirmed to be the same matter until checked against the signed order.

What the reported ruling decided

LiveLaw Biz reported that the Lucknow Bench allowed an appeal by Jai Enterprises on 16 September 2026 and quashed a reported demand of ₹6,62,077 under the Central GST and Uttar Pradesh GST Acts. According to that report, officials relied on toll-plaza records and photographs indicating that a vehicle carrying pan masala and tobacco travelled from Kanpur towards Etawah, returned towards Kanpur, and later went towards Auraiya on the same day. Authorities inferred that the goods had already been transported and that invoices or e-way bills were being reused. The report says the goods’ description, quantity, value and ownership matched the documents, and that the tribunal found no independent evidence establishing an earlier completed journey or delivery. That account is not fully corroborated by the detailed text currently available. A separate reproduction headed Jai Enterprises v. Pankaj Gandhi, Addl. Commissioner, State Tax gives a different appeal number, date and amount. It describes the same core dispute—whether vehicle movement and prior checking proved that the same goods were being transported again—but readers should not assume the two records describe one order.

Why the case details do not line up

The mismatch matters because the appeal number, parties and demand amount identify which order supports a legal claim. LiveLaw Biz’s contemporary report and TaxHeal’s reproduced order text give materially different particulars:

The reproduced order text gives further particulars: it concerns vehicle UP-71-B-9301 carrying goods from Jai Enterprises in Nayaganj, Kanpur, to Fatehpur, with invoices and e-way bills dated 1 March 2022. The vehicle was reportedly checked at Jhakarkatti at 1:27 p.m. and again at 9:52 p.m. near Cooperganj/Jhakarkatti. Jai Enterprises’ explanation was that the vehicle had broken down; it submitted a repair bill and driver affidavit. TaxHeal’s reproduced order text

That text states that ₹6,06,844 was deposited and ordered refunded in accordance with law. It also lists penalty components of ₹74,382 and cess penalty of ₹4,58,080, which do not add up to the stated total. Those component figures should not be used to calculate or explain the demand without checking the signed order. The available sources do not establish whether APL/82 and APL/38 are separate matters or whether one record contains errors.

What evidence the tribunal found missing

In the reproduced APL/38 text, the tribunal’s reasoning distinguishes a suspicious pattern from proof of the alleged contravention. The order says there was no discrepancy in the goods’ description, quantity, value or ownership, and that the goods were covered by tax invoices or e-invoices and e-way bills. It found no independent, cogent evidence that the same goods had completed an earlier journey and been delivered before the later movement.

  • Movement or location evidence: A vehicle’s route, timing or earlier verification may prompt an inquiry, but the reproduced order did not treat that information alone as proof that the goods had already been delivered.
  • Documents and goods: The reproduced text records that the goods matched the invoice and e-way-bill particulars, with no stated discrepancy in description, quantity, value or ownership.
  • Breakdown explanation: The taxpayer supplied a repair bill and driver affidavit; the reproduced order says the department did not establish that the repair bill was fake or forged.
  • Missing link: The order identifies no independent proof that the same goods had completed a prior journey, been delivered, and were then being transported again under reused documents.

The reproduced text says the department did not establish a contravention of the GST Act or Rules on that record. It attributes this statement to the tribunal at paragraph 32.8: “Intention cannot be presumed merely from suspicion, and a presumption of tax evasion cannot take the place of proof of the underlying contravention.” Because the full text is hosted by a secondary publisher rather than the tribunal, the quotation should be checked against the signed order before being relied on as an authoritative quotation.

What the ruling does—and does not—mean for GST penalties

The narrow takeaway is that an inference from vehicle movement or an earlier e-way-bill check did not, on the record described, prove that the same goods had already completed a journey or that the e-way bill had actually been reused. The tribunal’s assessment rested on the documents matching the goods and the absence of cogent evidence of an earlier delivery or completed transport.

This is not a blanket ruling that vehicle movement evidence is irrelevant, that every GST detention requires proof of subjective intent, or that a taxpayer’s explanation must always be accepted. The decision, as described in the available materials, applies to its particular evidence. A different record containing proof of prior delivery, actual document reuse, or another established contravention could present a different question.

Procedural context and how to verify the order

The reproduced APL/38 order says the appeal was filed under Section 112 of the Central Goods and Services Tax Act, 2017 and corresponding Uttar Pradesh GST provisions. It identifies the challenged original order as one under Section 129(3), dated 8 March 2022, and the first appellate order as dated 11 October 2023. The reproduced text says the tribunal set aside both orders and directed refund of ₹6,06,844 in accordance with law.

The GSTAT describes itself as constituted under Section 109 of the CGST Act to hear appeals against orders by appellate or revisional authorities under Sections 107 or 108 and corresponding State GST Acts. Its website provides order/judgment and case-status functions. To resolve the present discrepancy, search the official GSTAT resources by appeal number and party name, then compare the signed order’s caption, date, demand and disposition with the two published accounts.
