In the United States, adding someone to a property deed generally means preparing a new deed that transfers an ownership interest to that person, signing it according to local rules, and recording it with the land-records office for the property’s county. The right deed, ownership wording, supporting forms, fees, and tax treatment depend on the property’s state and county—and on the people and circumstances involved.
Before preparing a deed, decide what ownership you intend
Adding a name is not simply an administrative update: it gives another person an ownership interest. First confirm who currently owns the property and what share is to be transferred. Consider how all owners will hold title and what that choice means for decision-making, inheritance, and the parties’ other legal and financial interests.
Terms such as joint tenancy, tenancy in common, tenancy by the entirety, and community property do not have identical effects nationwide. Rights can vary by state and by the owners’ relationship. In particular, survivorship and inheritance consequences may differ. Sacramento County Public Law Library advises people who are unsure how to hold title to consult a family or estate lawyer or a law library.
Choose the deed and title wording for your jurisdiction
There is no single deed form or ownership phrase that is correct for every U.S. property transfer. Sacramento County’s guidance discusses grant and quitclaim deeds as options in its California context and notes that forms vary by county. A deed’s assurances and execution requirements also depend on state law. Do not assume an online blank deed is valid for your property or that a deed type has the same effect in every state.

If the transfer involves family, an estate plan, a mortgage, or a tax question, have a real-estate attorney or title professional prepare or review the deed and the proposed title wording. The people signing and the formalities required depend on local law and the circumstances. A recorder’s office may accept documents without advising you how to prepare them: Fresno County Recorder, for example, says its staff cannot give deed-preparation advice.
Prepare and record the new deed
- Find the property’s jurisdiction. Identify the state and county where the property is located, then get current recording instructions from that county’s recorder or register of deeds. Requirements at a county office are not a nationwide template.
- Confirm the ownership details. Verify the current owners, the interest being transferred, and how the owners will hold title. Resolve any uncertainty about the deed form and vesting language before signing.
- Prepare the deed and supporting paperwork. Use a qualified attorney or title professional when the transfer has meaningful legal, family, estate, mortgage, or tax implications. Local offices may require a transfer declaration, return, exemption statement, or other documents. Milwaukee County, for example, requires an electronic real-estate transfer return receipt with a conveyance document.
- Sign and submit it under local rules. Check the required signing formalities, submission method, return address, recording fees, and any applicable taxes with the county office. Milwaukee and Fresno County materials illustrate that supporting documents and charges differ; their requirements and fees should not be treated as general U.S. rules.
- Check the recorded document. Review the recorded deed or recording confirmation to verify that the names and legal description are correct. Keep the recorded document with your property records.
Milwaukee County Register of Deeds describes its process this way: “To change ownership of real estate, a new conveyance document (deed) must be drafted and submitted for recording along with an Electronic Real Estate Transfer Return Receipt (e-RETR).” That receipt requirement is specific to the county’s process, not a universal filing rule.

Understand what happens to the mortgage
A deed changes an ownership interest; it does not by itself make the new owner liable on the existing loan note or release the current borrower from that obligation. A mortgage or deed of trust generally remains a lien on the property. Do not assume that adding someone to the deed also adds them to the loan.
Federal law, 12 U.S.C. § 1701j-3(d), bars a lender from enforcing a due-on-sale clause for certain specified transfers of residential real property. Covered circumstances include a transfer in which the borrower’s spouse or children become an owner. The protection is limited to the statutory circumstances; it does not establish that every transfer to another person is protected. Review the loan documents and discuss the proposed transfer with the servicer or a lawyer, particularly if the person is not a spouse or child, or the loan is a reverse mortgage or has special terms.

Check possible taxes and other costs
A transfer may involve documentary or other transfer taxes, property-tax consequences, gift-tax considerations, recording fees, or other legal consequences. Riverside County cautions that many transfers may be subject to documentary transfer tax and that some may trigger gift tax or other consequences. Whether a tax applies, and whether an exemption is available, depends on the governing rules and the facts. A transfer to a relative is not automatically tax-free.
Ask the county recorder or register of deeds what filing charges and transfer forms currently apply, and consult a tax professional about the consequences of the particular transfer. Fresno County’s recording guidance describes California-specific document and transfer-tax requirements; those details should not be generalized to other counties or states.
