Brazil’s data protection authority did not impose a permanent, countrywide ban on artificial intelligence. In July 2024, the Autoridade Nacional de Proteção de Dados (ANPD) ordered Meta to suspend a specific privacy-policy change and related processing of personal data for generative-AI training in Brazil. On August 30, 2024, the authority approved a compliance plan and lifted that preventive suspension. The sources available here do not establish the case’s final outcome as of October 5, 2026.
What Brazil’s order covered
Meta’s updated privacy policy took effect on June 26, 2024. It applied to Facebook, Messenger and Instagram, and allowed public information and content shared on those services to be used to train or improve generative-AI systems. On July 2, ANPD ordered Meta to suspend the relevant part of the policy and the associated personal-data processing for AI training in Brazil.
The order concerned data belonging to both users and non-users of Meta platforms. It was a preventive measure aimed at a particular policy change and processing activity—not an order to stop developing AI generally, nor a finding that every use of AI by Meta was unlawful. ANPD announced a fine of R$50,000 per day for noncompliance with the order.
Why ANPD intervened
In its preliminary assessment, ANPD raised concerns about whether Meta had an adequate legal basis for the processing, whether people received clear and sufficient information, and whether the route for objecting was too difficult to use. The authority also expressed concern about processing involving children and adolescents without adequate safeguards.

Those were concerns stated in a preventive proceeding, not final findings that Meta had violated the law. ANPD president Waldemar Gonçalves described the authority’s purpose as promoting compliance with Brazil’s General Data Protection Law (LGPD) and clarifying data subjects’ rights. That statement describes the regulator’s stated aim; it is not a determination that Meta’s practices were compliant.

What the approved plan meant for people in Brazil
The August plan changed the immediate regulatory position: the preventive suspension was lifted after ANPD approved the plan. The authority said the plan called for clearer information and a simpler objection mechanism for both users and non-users. It also included the commitment concerning data from accounts belonging to people under 18 pending a definitive decision in the supervisory case.

That is a dated description of the plan, not confirmation of the case’s eventual resolution or of Meta’s present-day AI-training practices in Brazil. ANPD’s public listing identifies the supervisory process as 00261.004509/2024-36, but the listing does not establish a final outcome. The latest substantive case outcome verified here is the August 2024 plan approval; a current claim about whether Meta is training on Brazilian data requires newer case-specific confirmation.
Meta’s position and the scale cited by ANPD
In a May 2024 statement about Brazil, Meta said it was offering additional transparency in response to ANPD recommendations and described plans to develop AI for Brazil. That was the company’s position, not evidence that ANPD accepted every aspect of Meta’s approach.

ANPD cited about 102 million active Facebook users in Brazil in its July 2, 2024 notice. That is the authority’s figure at that time, not a current audience estimate.

The July order addressed a specific Meta policy change and related personal-data processing for generative-AI training in Brazil. The later plan required clearer notices and a simplified route to object, but the material available here does not establish the case’s final disposition or the current availability and operation of that route. It therefore cannot answer, as of October 5, 2026, whether a particular Facebook or Instagram post is currently being used to train AI in Brazil.
