A lien is a legal claim or security right tied to property, usually used to secure payment of a debt or another obligation. It can affect property without meaning that the creditor has already taken it. The rules for creating, enforcing, prioritizing, and removing a lien depend on its type and the jurisdiction involved.
What a lien does—and what it does not do
A lien gives a creditor or other claimant a legally recognized interest connected to property. Depending on the lien and applicable law, it may complicate borrowing against, refinancing, or selling the property, or provide a route to enforcement. The existence of a lien alone does not establish that the claimant can immediately seize the property.
The IRS makes the distinction clear for federal tax debts: a lien secures the government’s claim, while a levy is the legal seizure of property to satisfy the debt. Those are different concepts and steps; a lien is not itself a levy. The IRS explains the difference between a levy and a lien.
How liens arise: two U.S. examples

How lien priority is determined
If more than one claim affects the same property, there is no reliable universal ranking that applies to every lien. Priority can turn on the lien’s legal source, the property and jurisdiction, when the claim attached and was perfected, whether required public notice was filed, and statutory exceptions.
In federal tax-lien disputes, state law determines the nature of the taxpayer’s property interest, while federal law determines priority among competing liens asserted against that interest. The general “first in time is the first in right” principle has qualifications, including statutory provisions and filing rules. The Department of Justice’s Tax Division manual explaining this framework is archived guidance, so it should not be treated as a current answer to a specific priority dispute. How to check or respond to a lien
If a lien may affect your property, identify the precise claim before deciding what to do. Check the relevant public record and the lien document, and confirm the claimant, amount, dates, property covered, and applicable jurisdiction. A recording or notice is important evidence, but whether a lien is valid, enforceable, or correctly prioritized depends on governing law and the facts.
- Use the official recording or filing office for the property’s location to look for public filings; procedures and records vary by jurisdiction.
- Compare the filing with the underlying notice, contract, judgment, tax account, or other stated basis for the claim.
- Note response, payment, appeal, and enforcement deadlines shown in the documents, then verify them under local rules.
- For a disputed, high-value, or time-sensitive claim, seek advice from a qualified lawyer or tax professional familiar with the relevant jurisdiction and lien type.
Options for a federal tax lien
For a federal tax lien, the IRS says full payment is the best way to remove it and states that it releases the lien within 30 days after the tax debt is paid. That is the IRS’s stated period for this specific lien, not a deadline for liens generally.

The IRS also describes several other forms of relief, each subject to eligibility requirements and conditions:
- Discharge: removes the lien from specific property.
- Subordination: allows another creditor to move ahead of the IRS in priority without removing the lien.
- Withdrawal: removes the public notice of federal tax lien, but does not cancel the underlying tax liability.
- Appeal: a route to challenge certain collection actions under applicable procedures.

Why the word “lien” can mean different legal arrangements
Liens may be statutory, contractual, judgment-based, possessory, or equitable, among other forms. Their shared feature is a legally recognized claim connected to property, but the right’s source and practical effect differ. For illustration only, UK Insolvency Service guidance describes a possessory lien as potentially allowing someone to retain property already lawfully held until a debt is paid, while an equitable lien need not involve possession.
