What Happens If You File an Indian GST Return Late or Make a Mistake?

A late Indian GST return may bring a fee, while unpaid tax can attract interest. Learn how filing blocks and correction windows work, including GSTR-1A.

If you file an Indian GST return late, a late fee may apply; if tax was also unpaid, interest may apply separately. If a filed return contains an error, you generally correct it through a permitted later-period filing or amendment facility—not by editing the filed return at will. The right consequence and correction route depend on the return form, tax period, taxpayer category, and current notifications.

What can happen if a GST return is filed late?

Late filing and late payment are different problems. A delayed return can attract a late fee even when no tax remains unpaid. Interest concerns tax that was not paid by the prescribed time; filing late by itself does not establish that interest is due.

Late fee depends on the return and applicable relief

Section 47(1) of the Central Goods and Services Tax Act, 2017 states a late fee of ₹100 for each day of delay, subject to a maximum of ₹5,000, for the specified delayed supply details or returns covered by that provision. This is the statutory CGST provision, not a universal bill for every late return: the applicable form, taxpayer class, amendments, notifications, and any late-fee relief can affect the amount. Check the current portal liability and relevant notification for your return and period. Section 47(2) provides a separate rule for annual returns.

Interest may apply to unpaid tax

Section 50 addresses interest on tax unpaid within the prescribed period. The applicable notified rate and calculation rules matter, so do not calculate interest simply from the number of days a return was late. First establish whether tax was unpaid, which tax period it relates to, and the applicable computation rule.

A missed return can block later filing and prompt a notice

Under section 39(10), a registered person cannot furnish a return for a tax period if a previous-period return has not been furnished. GST Portal guidance also describes sequencing constraints involving GSTR-1 and GSTR-3B. The Act provides for a notice requiring a return defaulter to file within 15 days; the notice process and subsequent consequences depend on the circumstances.

How to correct a mistake in a filed GST return

Start by identifying the form, tax period, error, and whether the return has already been filed. A filed return is not generally an editable draft. For returns covered by section 39(9), a discovered omission or incorrect particular may generally be rectified in the return for the month or quarter when it is noticed, subject to the statutory cutoff and applicable interest. That provision excludes corrections arising as a result of scrutiny, audit, inspection, or enforcement activity.

For GSTR-1: use GSTR-1A when the same-period window is open

GSTN describes GSTR-1A as an optional facility to amend an incorrect GSTR-1 record or add a missed record for the same period. It becomes available after GSTR-1 is filed or after its due date, whichever is later, and may be used before filing GSTR-3B for that period. Changes flow into that period’s GSTR-3B. For a supply added or amended through GSTR-1A, the recipient’s input tax credit is reflected in the recipient’s next-period GSTR-2B. This is not an always-available way to edit GSTR-1 after GSTR-3B has been filed. See the GST Portal GSTR-1 user guide for the portal process.

Check which correction deadline applies

The GSTR-1 guide gives a cutoff of 30 November in the following financial year for correcting or adding prior-financial-year invoice details in GSTR-1. Separately, section 39(9) frames its general cutoff around the September return or second-quarter return following the end of the financial year, or the date the annual return is filed, whichever is earlier. These are not interchangeable descriptions of one universal deadline. Match the rule to the form and correction at issue, and check current portal guidance and notifications.

What to check before deciding your next step

  1. Identify the return and tax period. Confirm whether the issue concerns GSTR-1, GSTR-3B, an annual return, or another filing, and whether it is monthly or quarterly.
  2. Separate late filing from unpaid tax. Check whether any tax was unpaid by its prescribed due date; late fee and interest are distinct liabilities.
  3. Check filing sequence and notices. Confirm whether an earlier return is still pending and whether a return-default notice has been issued.
  4. For an error, check the available amendment route and deadline. In particular, determine whether same-period GSTR-1A is still available or whether a later-period correction under the applicable rule is required.
  5. Verify current portal calculations. GSTN says its GSTR-3B interest enhancement applies from January 2026 tax periods and accounts for the minimum electronic cash-ledger balance under the proviso to Rule 88B(1). The system-populated figure is a minimum amount; taxpayers remain responsible for self-assessing the correct liability and increasing it if necessary. GSTN’s 6 March 2026 advisory says a technical issue may have affected some February 2026 interest displayed in March 2026; if you observe a discrepancy for an affected amount, the advisory describes using “RE-COMPUTE INTEREST.” These notes concern the specified periods and portal behavior, not a guarantee about later software versions.
  6. Get case-specific help when the stakes are material. If there is a tax shortfall, a potentially expired correction window, or a complex form-specific issue, consider talking to a qualified GST practitioner.

GSTR-1 due dates are not due dates for every GST return

The GST Portal guide says monthly GSTR-1 is generally due on the 11th day of the succeeding month and quarterly GSTR-1 on the 13th day of the month following the quarter. Government-notified extensions can change a due date. These dates apply to GSTR-1; check the applicable schedule for other forms and periods in the portal and relevant notifications.
