How Courts Reconcile Conflicting GST Rulings: Precedent, Judicial Hierarchy and Distinguishing Facts

When High Courts disagree on GST, the outcome depends on binding Supreme Court law, territorial reach, bench strength and whether the judgments decided the same issue on materially similar facts.

When two High Courts reach different conclusions on a GST issue, neither judgment automatically governs taxpayers across India. Courts identify the law declared by a binding higher court, assess each High Court ruling in light of its reach and bench strength, and compare the precise legal questions and facts. A later Supreme Court decision may resolve the conflict; until then, the answer can depend on where a case is heard and what it actually involves.

Which court’s GST ruling controls?

The starting point is the judicial hierarchy. Under Article 141 of the Constitution, “The law declared by the Supreme Court shall be binding on all courts within the territory of India.” A Supreme Court ruling on the legal issue therefore binds courts throughout the country, subject to what the Court actually decided and any later authority.

A High Court ruling ordinarily binds courts and authorities within that High Court’s territorial jurisdiction, but a judgment from one High Court does not automatically bind another High Court. Outside its own jurisdiction, it may be considered as persuasive authority. That distinction matters when a business operates in several states: the existence of a judgment elsewhere does not by itself settle how a court in the business’s state must decide the same question.

Do not treat every sentence in a Supreme Court order as a nationwide rule. Identify the legal principle the Court declared and distinguish it from case-specific directions made under Article 142. The Supreme Court discussed this distinction in its judgment of 3 October 2024. The effect of any particular direction depends on the order and context in which it was made.

How to tell whether GST judgments really conflict

Headlines and summaries can make two decisions appear inconsistent when they answer different questions. Compare the judgments themselves, beginning with the provision and version of the CGST, IGST or relevant SGST law at issue. A change in statutory wording, the relief requested, or the stage of the proceedings may make a result inapplicable to another dispute.

What to compare What to check Why it matters
Court and territorial reach Which court decided the case, and where would the new case be heard? A High Court judgment does not automatically bind courts in another High Court’s territory.
Bench strength How many judges decided each case, and was one bench larger? Bench composition can affect how decisions relate to one another, particularly within the same High Court. The applicable court rules and precedents should be checked.
Statutory text Which provision and version of the GST legislation did each judgment apply? Different wording or amendments can change the legal issue.
Question actually decided What precise legal question did the court need to answer to reach its result? Two cases may discuss the same broad topic but decide different points.
Facts, procedure and remedy What material facts, procedural stage and relief were before the court? A difference here may explain different outcomes without a true conflict in legal rules.
Reasoning and later history What reasoning supports the result, and has a higher court later considered the decision? The controlling principle may be narrower than a judgment’s broad observations, and later appellate treatment can change its significance.

Find the ratio, not just a broad statement

The ratio is the legal principle necessary to support the judgment on the issue before the court. A judgment can also contain observations that were not necessary to decide that issue. When comparing cases, focus on the reasoning that led to the result rather than treating every comment as a rule governing future disputes.

If the courts applied different statutory text, addressed different remedies, or decided different issues, explain that difference directly. Do not describe the decisions as opposing answers to the same question unless they truly decided the same material legal point.

Check bench strength and any same-court conflict

When decisions come from the same High Court, check the composition of each bench and the court’s applicable precedent rules before concluding that a later judgment displaced an earlier one. Bench strength is relevant to how courts treat earlier decisions, but the precise procedure for a disagreement between benches depends on the court’s rules and applicable precedent. A GST example: VKC Footsteps

Union of India v. VKC Footsteps India Pvt. Ltd. illustrates how the Supreme Court can resolve conflicting High Court outcomes in a GST dispute. The cases concerned the formula for refund of unutilised input tax credit. In its judgment of 13 September 2021, the Supreme Court affirmed the Madras High Court judgment and allowed the Union’s appeals against the Gujarat High Court judgment.

The Court concluded that the formula was not ambiguous or unworkable in the circumstances before it and declined to substitute a judicially prescribed order of utilisation for the legislative formula. It also urged the GST Council to consider reported anomalies, stating: “However, given the anomalies pointed out by the assessees, we strongly urge the GST Council to reconsider the formula and take a policy decision regarding the same.” That recommendation was not itself an order requiring the Council to amend the formula.

The example shows why both the disposition and the reasoning matter. The Supreme Court resolved those appeals, but its discussion should not be enlarged into a claim that every challenge to the refund formula, on any facts or legal grounds, necessarily fails. For another dispute, identify the provision, issue, facts and relief at stake before deciding how the judgment applies.

A practical method for checking a GST precedent

  1. State the exact question. Write down the GST provision, the version in force for the relevant period, the decision or action being challenged, and the relief sought.
  2. Read the full judgments. For each decision, identify the court, date, bench composition, procedural posture, material facts and result. Separate the reasoning necessary to decide the issue from broader observations.
  3. Map the authority. Check whether a Supreme Court ruling declares law on the same point, whether a High Court judgment is binding in the relevant territory, and whether bench strength affects the relationship between decisions from the same High Court.
  4. Compare the cases on the merits. Use the statutory wording, question decided, facts, procedural stage and remedy to determine whether the apparent disagreement is real or whether one judgment can be distinguished.
  5. Trace later treatment. Look for later judgments or orders that affirm, reverse, distinguish or leave the issue open. Do not assume that a pending appeal, special leave petition or interim order has settled the legal question without examining what the court actually ordered.
  6. Record the conclusion narrowly. State which authority is binding for the particular court and issue, what remains unsettled, and which factual or statutory differences could affect the outcome.

Where to verify judgments and their history

Use the full court judgment rather than a case summary when the outcome could affect a GST return, refund claim, assessment or appeal. The Supreme Court Reports search portal describes searches by keyword, phrase, party, Act and section. Search using the parties’ names as well as the statutory provision, then inspect the judgment and relevant later orders. Court records are the source for confirming a decision’s date, bench, disposition and procedural history.
