Can You Legally Use a Sanctioned Cryptocurrency Exchange? A Guide to the U.S., UK and Australia

There is no universal yes or no: sanctions rules depend on your jurisdiction, the exchange and counterparties, and the specific crypto transaction.

Sometimes, but there is no blanket yes-or-no answer. Whether you may use an exchange depends on the sanctions law that applies to you, the exchange and other parties, and the particular service or transaction. A platform letting you sign in or trade does not establish that doing so is lawful.

What does “sanctioned exchange” mean?

The phrase can describe different situations with different legal consequences. An exchange might itself be designated, be owned or controlled by designated people, face a restriction on certain services, or simply choose to block particular users, countries or tokens under its own risk policy. A platform restriction is not necessarily a government designation, and a government designation is not the same thing as a private account freeze.

The relevant questions are who is covered by the applicable rules, what designation or restriction applies, who owns or controls the assets or business, and what you propose to do. Sanctions lists and rules change; the summaries below reflect official guidance checked on 4 October 2026, not a determination about any specific exchange or transaction.

How do the rules differ by jurisdiction?

United States U.S. citizens and permanent residents wherever located; people and entities in the United States; and U.S.-incorporated entities and their foreign branches. Some program-specific rules may also affect foreign subsidiaries or non-U.S. people. OFAC applies sanctions obligations to digital currency as it does to fiat. U.S. persons must block property and interests in property of SDN-listed persons and entities owned at least 50% in aggregate by blocked persons, and must not engage in prohibited dealings.
United Kingdom People and entities in UK territory, as well as UK nationals and entities established under UK law when abroad. OFSI says cryptoassets fall within relevant sanctions definitions. Making funds or economic resources available directly or indirectly to a designated person can be a criminal offence.
Australia For autonomous sanctions, activity in Australia; activity by Australian citizens and Australian-registered bodies corporate overseas; and activity aboard Australian-flagged vessels and aircraft. The Australian Sanctions Office treats cryptocurrency as an asset for sanctions purposes. Making it available to or for a designated person, or dealing with crypto owned or controlled by a designated person, can be an offence.

Can a U.S. person use a crypto exchange outside the United States?

Being offshore does not, by itself, take a U.S. person outside U.S. sanctions rules. OFAC describes the obligations as the same for digital-currency and traditional fiat transactions, and its jurisdiction generally includes U.S. citizens and permanent residents wherever they are. OFAC’s FAQ 560 states: “Yes, the obligations are the same.”

The result still depends on the particular sanctions program and transaction. For example, OFAC’s Russia-related guidance says U.S. persons, wherever located, are generally prohibited from engaging in or facilitating transactions involving blocked persons, including through virtual-currency exchanges, wallet hosts and service providers. That program-specific guidance is not a rule that every foreign exchange is off-limits to every U.S. user. Non-U.S. people also must not cause U.S. persons to violate sanctions or engage in evasion.

What applies in the UK?

UK financial sanctions can reach a UK national or a UK-established entity acting abroad as well as people and entities within UK territory. Because cryptoassets fall within the relevant definitions, using crypto does not itself remove a transaction from sanctions controls.

Exceptions and licences depend on the specific sanctions regime. Check that regime’s statutory guidance for an applicable exception; if none applies, a licence is needed for activity that would otherwise be prohibited. Do not assume that an exception or general licence under one regime covers another. The UK government announced that the UK Sanctions List became the sole source for UK sanctions designations on 28 January 2026, so check the live list and regime guidance before acting.

What applies in Australia?

Australian autonomous sanctions can apply to activity in Australia and to specified Australian people and entities acting overseas. The Australian Sanctions Office’s exchange-sector guidance says crypto is an asset for these purposes and advises exchange providers to use reasonable precautions and due diligence. It also says providers should freeze and report assets they identify as owned or controlled by designated entities. The guidance is directed at exchange providers, but it makes clear that crypto transfers are not outside sanctions law.

The Australian Sanctions Office’s 2026 guidance states that an individual may face up to 10 years’ imprisonment and/or a fine of 2,500 penalty units, stated as $910,000 as of 1 July 2026, or three times the transaction value, whichever is greater. This is a stated maximum penalty basis in Australian guidance, not a prediction of a sentence; it applies in the relevant offence context and is not a penalty rule for other jurisdictions.

What should you check before using an exchange?

  1. Identify your legal connection. Consider where you are, your citizenship or residence, and where any company involved is incorporated or established. Some rules follow people or entities abroad.
  2. Check the exact designation and program. Consult the current official list and the rules for the relevant sanctions regime. A name match alone may not answer whether an entity is restricted; ownership, control and the specific measure can matter.
  3. Identify the parties and assets. Determine who owns or controls the exchange, the other party and the crypto involved, and whether a designated person has an interest in the property.
  4. Define the activity. Trading, transferring, providing services, or making assets available may be treated differently under the applicable prohibition.
  5. Check for a regime-specific exception or licence. Do not assume permission under one program applies to another, or that the exchange’s own approval is a legal licence.
  6. Get qualified advice for a real transaction. Sanctions consequences turn on current rules and detailed facts; a sanctions lawyer or qualified compliance adviser can assess the specific case.

A VPN, offshore account, self-custody wallet, or successful login does not change which sanctions law applies to a person or transaction. Do not treat any of them as a legal workaround.

What if an exchange freezes or rejects your crypto?

A rejection or account restriction by a platform does not, by itself, prove that your assets have been legally blocked under sanctions rules. A business may refuse service under its own policy, while a legal blocking obligation applies to property that the relevant rules require to be blocked. The cause and legal status of the restriction matter.

For a U.S. person holding virtual currency that must be blocked under OFAC rules, OFAC says access must be denied to all parties and reporting requirements apply. OFAC FAQ 646 states that the initial report is due within 10 business days, with annual reporting for as long as the virtual currency remains blocked. This requirement concerns property legally required to be blocked; it does not mean every customer whose exchange account is restricted has a reportable blocked asset. If you believe assets are legally blocked, do not move them to evade a restriction; seek qualified legal advice and consult the applicable official guidance.
