When Can You Challenge an Indian GST Demand for Procedural Errors?

An Indian GST demand may be challenged for procedural defects, but the right test depends on the tax period, statutory route, record and remedy deadline.

You may be able to challenge an Indian GST demand if the authority used the wrong statutory route, missed the applicable deadline, denied a required hearing, failed to consider your reply, gave no reasoned basis for its decision, confirmed more than—or different grounds from—the show-cause notice, or did not serve the communication through a legally permitted method. A procedural defect does not automatically cancel a demand: the result depends on the applicable law, the record, and the remedy sought.

First identify the tax period and the statutory route

Start with the financial year covered by the demand and the section named in the notice. The applicable route affects the alleged basis for tax, the deadlines, and possible consequences. Do not assume that a section number or deadline applicable to an earlier period applies to a later one.

Check whether the notice actually alleges that basis and whether the case record supports it; calculate the applicable deadlines under the relevant statutory version.
Section 74A Relevant to post-FY 2023–24 periods; the older Section 73/74 framework should not simply be carried forward. Verify the provision, commencement and deadline rules applicable to the specific period before assessing limitation.

The CBIC’s tax-information pages mark Sections 73 and 74 as applying to periods up to FY 2023–24. Deadlines depend on the applicable version of the law and facts such as the annual-return due date or erroneous-refund date; statutory exclusions, including a stay, may affect the calculation. Section 75(10) provides for adjudication to be deemed concluded if an order is not issued within the applicable period referred to in Section 73(10) or 74(10). There is no single deadline that can safely be applied without those details.

Check whether the notice gave you a fair chance to answer

Read the substantive show-cause notice alongside its annexures, demand statement, relied-on material and any electronic summary, such as Form GST DRC-01. The central question is whether the notice makes clear what conduct is alleged, for which period, under what statutory basis, and how the tax, interest, penalty or input tax credit amount was calculated. A summary should not be treated as a substitute for examining the allegations and supporting material in the notice.

Section 75(4) requires an opportunity of hearing if you request one in writing or if an adverse decision is contemplated. If a hearing is material, make the request clearly and preserve proof that it was submitted. Section 75(5) permits an adjournment for sufficient cause, with reasons recorded, subject to a maximum of three adjournments during the proceeding.

Test whether the order stayed within the notice

Section 75(7) sets two express limits: the order cannot confirm more tax, interest or penalty than the amount specified in the notice, and it cannot confirm the demand on grounds other than those specified there. Compare the notice, your response, the officer’s computation and the final order line by line. A new basis for liability or a higher confirmed amount may support a procedural challenge.

Look for a reasoned decision that addresses your reply

Sections 73(9) and 74(9) require determination after considering any representation. Section 75(6) says the proper officer “shall, in his order, set out the relevant facts and the basis of his decision.” An order that merely lists your response without dealing with material arguments or evidence may support an argument that the representation was not properly considered or that the order lacks the required reasons. Whether that warrants setting aside the order or a remand depends on the circumstances and applicable precedent.

Verify service through every permitted channel

Section 169 allows service through several methods, including direct delivery, registered or speed post or courier, the email address provided for registration, and making the communication available on the common portal. Not receiving a paper copy alone does not establish defective service. Check the portal, registered email, address-change filings and any postal records to determine whether a statutory method was used.

Consider the special rule for an unsustainable Section 74 allegation

Under Section 75(2), if an Appellate Authority, the Appellate Tribunal or a court concludes that a Section 74 notice is not sustainable because fraud, wilful misstatement or suppression to evade tax was not established, the proper officer is directed to determine the tax as if the notice had been issued under Section 73. CBIC Circular 185/17/2022-GST addresses the operation of this mechanism and related limitation questions. It is a specific statutory rule, not a general cure for every defect in a Section 74 proceeding.

Preserve the appeal deadline if a final order has issued

Under Section 107(1), an aggrieved person may generally appeal an adjudicating authority’s decision or order to the Appellate Authority within three months from the date it is communicated. An appeal is also subject to prescribed pre-deposit conditions; confirm the current requirements for the order at issue. Do not assume that an informal representation pauses the appeal period. Raise the procedural objection in your response where possible and preserve it in a statutory appeal if the order is adverse.

Organise the record before challenging the demand

  • Keep the notice, annexures, demand statement, DRC-01 summary and relied-on documents together.
  • Retain your filed response, attachments, submission acknowledgement and later written submissions.
  • Preserve hearing requests, hearing notices, attendance records, adjournment applications and related communications.
  • Save the final order, DRC-07 summary, portal records, registered-email records and evidence of the communication date.
  • Prepare a date calculation under the provision applicable to the tax period, including any relevant statutory exclusion, and separately track the appeal deadline.

Rules refer to Form GST DRC-06 for a representation and Form GST DRC-07 for a summary of specified orders. The rules compilation used for these form references predates this article’s research date, so check the current rules and forms before relying on the mechanics. State and Union Territory GST enactments generally parallel central provisions, but confirm the applicable State or UT law, rules, notifications and local precedent for the case.
