Both come from cannabis, and delta-9 THC is psychoactive. In U.S. law, “hemp” has been a statutory category defined by a THC threshold; it is not a promise that a finished product is non-intoxicating, FDA-approved, or legal to sell everywhere.
What the two labels mean
Hemp and marijuana are not separate plant species in the federal definitions discussed here. Both refer to cannabis, and the word “hemp” can cover the plant and its parts and derivatives when they meet the applicable statutory definition. “Marijuana” generally refers to cannabis outside that hemp exception under the federal Controlled Substances Act (CSA), subject to the law’s exceptions.
Delta-9 tetrahydrocannabinol (delta-9 THC) is a psychoactive cannabinoid found in cannabis. Calling it “hemp-derived” describes a product’s claimed source and the legal category it is being evaluated under; it does not mean the product contains no THC or cannot cause intoxication.
How the federal definitions compare on October 4, 2026
As of October 4, 2026, the 2018 Farm Bill’s definition remains the applicable federal baseline described in the reviewed sources. The amended definition enacted in P.L. 119-37 is not scheduled to take effect until November 12, 2026.

The 0.3% figure is a statutory concentration threshold measured on a dry-weight basis. It is not a statement that hemp products have zero THC, and meeting that definition alone does not establish compliance with every rule governing a finished product.
What changes on November 12, 2026
P.L. 119-37, enacted in November 2025, amends the federal hemp definition. Rather than relying on the 2018 definition’s delta-9-only threshold, the amended definition uses a total-THC approach that includes THCA and adds exclusions for certain products. The law is scheduled to take effect November 12, 2026; it should not be treated as already effective on October 4.

The Congressional Research Service summarizes one final-product exclusion as covering products with more than 0.4 milligrams of combined total THC and similar-effect cannabinoids per container. This is a specific statutory exclusion, not a recommended serving limit or a universal rule that resolves the status of every product. The definition also contains other exclusions, and application may depend on the exact product and statutory wording. CRS has identified implementation and enforcement questions around the changes.
For a purchase or sale occurring on or after the effective date, check the law then in force, subsequent federal guidance or amendments, and the relevant state rules. The available sources do not establish that every product will be treated identically under the amended definition.

Why a hemp label does not settle product legality
Federal hemp classification and permission to market a particular finished product are different questions. The U.S. Food and Drug Administration (FDA) says the 2018 Farm Bill preserved its authority under the Federal Food, Drug, and Cosmetic Act and section 351 of the Public Health Service Act over products containing cannabis or cannabis-derived compounds, regardless of whether the source material qualifies as hemp.
FDA says it has not approved a marketing application for cannabis to treat any disease or condition. It has approved one cannabis-derived and three cannabis-related drug products available by prescription; that does not amount to approval of hemp-derived delta-9 products generally. A product’s “hemp-derived” label is not evidence that FDA has approved it or that it complies with the requirements applicable to its product category.

State and local restrictions may also be stricter or different from the federal definition, and legal challenges to state restrictions exist. A federal hemp threshold therefore does not establish that a particular product may be possessed, sold, shipped, or consumed in every state or locality.

For licensed hemp production compliance, USDA describes total THC as the potential total delta-9 THC derived from the sum of THC and THCA after decarboxylation, or calculated using a conversion factor if the testing method does not decarboxylate the sample. The result is reported on a dry-weight basis. USDA’s sampling and laboratory procedures concern production compliance.

That production test is not a consumer method for certifying a retail product’s legal status. A home test or a product label alone cannot establish all the facts that may matter, including the product’s formulation, applicable legal definition, FDA requirements, and state or local rules.
How to assess a specific product
- Pin down the date and location. Identify where the product will be possessed, sold, or shipped and when. The federal definition is scheduled to change on November 12, 2026, and state and local rules can differ.
- Read the product information carefully. Record the stated source, ingredients, THC and THCA amounts, amount per container, and any claims about intended use. A “hemp-derived” description alone does not establish a legal conclusion.
- Separate the legal questions. Consider whether the material meets the relevant hemp definition, whether the finished product can be marketed under FDA requirements, and whether the jurisdiction permits that product. A favorable answer to one does not answer the others.
- Check current, jurisdiction-specific rules. For an individual product, consult current federal and state or local requirements and, when the consequences matter, a qualified lawyer. This overview is not legal advice or a fifty-state product clearance.
Health claims require separate evidence
The legal distinction between hemp and marijuana does not establish a comparative safety or health profile for products containing delta-9 THC from either source. Do not infer that one is safer, more effective, or medically appropriate based on the source label alone; product-specific clinical evidence and applicable FDA requirements are separate issues.
