How to Check Whether a Firearm Sale Requires a Background Check

Whether a firearm sale needs a background check depends on the states involved, whether an FFL is transferring the firearm, and the type of transaction. Here’s how to check the rules and understand the federal baseline.

There is no single nationwide answer for every firearm sale. To find out whether a check is required, identify the states involved, whether the seller is a licensed dealer or a private individual, where the transfer will happen, and whether it is a sale, gift, or other transfer. Federal rules set a baseline; state and local laws can add requirements. The steps below explain how to check the rules for a specific transaction, but cannot determine the answer without those details.

How do I know if my state requires a background check for a gun sale?

  1. Write down the transaction details. Note the buyer’s state of residence, the seller’s state of residence, where the firearm will be transferred, whether a licensed firearms dealer (FFL) is involved, and whether the transfer is a sale, gift, or another kind of transfer. The states and transaction type affect which rules to consult.
  2. Check ATF’s Brady State Lists. The lists show whether the FBI, a state agency, or a partial state point of contact handles National Instant Criminal Background Check System (NICS) checks. ATF’s page was last updated February 10, 2026.
  3. Check the states’ current official rules. Consult the relevant state police, attorney general, or legislature guidance for private-transfer requirements, permits, waiting periods, firearm-type distinctions, and other conditions. If more than one state is involved, check the rules relevant to each state and the transfer route.
  4. Ask an official state authority or an FFL if the answer is unclear. A dealer can explain the process it handles, but confirm the legal requirements with an appropriate state source. The federal point-of-contact lists identify who handles NICS checks; they do not say whether a particular sale or transfer must have one.

Does a private gun sale require a background check?

For a private transfer between two unlicensed people who live in the same state, federal law generally does not require an FFL to facilitate the transfer or require federal recordkeeping for it. State or local law may nevertheless require a background check, use of a dealer, a permit, or other conditions. ATF’s “Firearms Questions and Answers” page on same-state transfers, last updated January 15, 2026, warns that state or local rules may govern these transactions.

Federal law also prohibits a transferor from transferring a firearm when they know or have reasonable cause to believe the recipient is prohibited from possessing it. ATF explains this rule in “Do I need a license to buy and sell firearms?” The absence of a federally required check for a particular same-state private transfer is not permission to disregard that prohibition or state and local law.

Do I need a background check to buy a gun from a private seller?

If the seller and buyer are unlicensed individuals who live in the same state, federal law generally does not require an FFL check, but state or local law may require one or impose other transfer conditions. If the seller is an FFL, the general federal rule is different: the dealer must initiate a NICS check before transferring a firearm to an unlicensed person, unless a narrow federal exception applies. The dealer must also follow applicable state law.

A qualifying state permit may serve as an alternative to a NICS check under federal law, but only if it meets federal criteria and ATF has assessed it as qualifying. An FFL is not required to accept a permit and may contact NICS if the dealer has reason to doubt that the permit is valid or qualifies. ATF’s Brady Permit Chart identifies permit assessments; check the dealer and state requirements too.

Can I sell a firearm to someone in another state?

An unlicensed person generally cannot directly transfer a firearm to an out-of-state resident. The standard route is to send the firearm to an FFL in the recipient’s state, where the buyer completes the transfer under the applicable federal and state rules, including any required background check. Limited exceptions may apply, so confirm them against official guidance before arranging delivery. ATF’s “Firearms Questions and Answers” guidance on interstate acquisition explains the general rule.

Can a gun dealer run a background check for a private sale?

Yes. An FFL may voluntarily facilitate a private transfer and process the buyer’s check. ATF’s “Facilitating Private Sales: A Federal Firearms Licensee Guide” says facilitation is voluntary under federal law. A dealer that handles the transfer must follow the applicable Form 4473, NICS, and recordkeeping process, as well as stricter state requirements where they apply. Ask the dealer whether it offers the service and what steps it requires; availability and any fees vary.

Compare the available transfer routes

Route When it may apply What to verify
Direct same-state private transfer Both parties are unlicensed and reside in the same state. State and local check, permit, eligibility, and transfer rules; the federal prohibition on transferring to someone the seller knows or has reasonable cause to believe is prohibited.
FFL-facilitated private transfer The parties want a dealer to process the transfer, or state law requires dealer involvement or a check. Whether the dealer offers the service; required Form 4473, NICS, and recordkeeping steps; and applicable state conditions or fees.
Interstate transfer through recipient-state FFL The buyer and seller reside in different states. The recipient-state dealer’s process, delivery and transfer rules, required check, and whether an exception applies.
FFL sale to an unlicensed buyer A licensed dealer sells or transfers a firearm to a nonlicensee. The NICS requirement, any qualifying permit alternative, waiting periods, and other state restrictions.

What happens if a NICS check is delayed?

The FBI says that when it cannot make a determination within three business days, an FFL may transfer the firearm unless state law prohibits the transfer. This is a federal default, not a promise that a delayed purchase will be released: state law may bar transfer after an unresolved delay, and the dealer must comply with applicable requirements. What to confirm before completing a transaction

  • The buyer’s and seller’s states of residence, and the state where the transfer will take place.
  • Whether the transfer is by an FFL or between unlicensed individuals, and whether it is a sale, gift, or other transfer.
  • The current official requirements for the relevant state or states, including any permits, waiting periods, firearm-type rules, or dealer-processing requirements.
  • Whether any claimed federal permit alternative actually qualifies and whether the dealer will accept it.
  • For an interstate transaction, the recipient-state FFL and lawful delivery route before the firearm is sent or handed over.

These distinctions are based on ATF and FBI guidance available on October 4, 2026, with individual publication update dates noted above. Because the transaction’s states, firearm, parties, and permits determine which rules apply, the official state guidance or a qualified local authority is the right place to confirm a specific case.
