Short answer: As of 18 August 2026, the EU has reinstated a temporary framework that allows certain communication providers to voluntarily detect, report and remove child-sexual-abuse material and grooming-related content. It does not require every service to scan every private message, and communications protected by end-to-end encryption are excluded from this interim measure. Separately, the EU is advancing age-assurance policies and a political 16 minimum for social-media access, but there is not one binding EU-wide law that already bans all under-16s from social media.
The three EU policy tracks behind the headlines
“Chat Control” is campaigners’ shorthand, not the formal name of a single enacted law. Current coverage combines three separate tracks with different legal effects:
- Temporary voluntary detection: a time-limited derogation from parts of the ePrivacy framework, reinstated in July 2026.
- Permanent child-sexual-abuse legislation: a separate proposal covering prevention, risk assessments, detection, reporting, removal and victim support. It remains under negotiation.
- Age limits and age assurance: Digital Services Act duties, Parliament’s call for a 16 threshold, a Commission recommendation on age-verification technology and advisory expert recommendations.
Keeping those tracks separate is essential. A temporary permission to scan voluntarily is not the same as a permanent scanning duty, and a political call for a 16 minimum is not an operative EU-wide age ban.
What was reinstated in July 2026?
The previous interim legal basis was Regulation (EU) 2021/1232. It expired on 3 April 2026 after the European Parliament rejected the Commission’s proposed extension on 26 March, by a vote reported as 228 in favour, 311 against and 92 abstentions. The gap lasted until the Council approved a replacement in July.

The Council’s final approval on 23 July 2026 restored a temporary derogation intended to apply until 3 April 2028, or until permanent legislation replaces it. The regulation still required publication in the Official Journal and entry into force after the specified three-day period. The Council describes the measure as restoring legal certainty for providers that choose to use detection tools, not as imposing a universal scanning command.

What providers may do—and what they are not required to do
The interim measure permits covered providers of number-independent interpersonal communications services to continue voluntary activity that can include:
- detecting suspected child sexual abuse material;
- detecting or addressing solicitation and grooming-related activity within the applicable legal scope;
- reporting relevant material to competent authorities; and
- removing illegal material or disabling access to it.
The operative word is may. The measure creates a legal route for a provider that elects to deploy detection systems; it does not order every platform to scan every message. The Council’s explanation and Commission opinion are the relevant primary sources.

“Voluntary” does not mean commercially irrelevant. This is an analytical consequence rather than a statutory command: large platforms may face pressure from regulators, child-safety groups and public opinion to participate, while also facing reputational damage if automated systems produce errors or users believe private communications are being inspected. Providers must weigh detection capability, cross-border reporting, privacy commitments, encryption architecture and the cost of handling false positives.
What the encryption exclusion means
The reinstated measure excludes communications to which end-to-end encryption has been, is being or will be applied. Parliament inserted that language on 9 July, and the Council approved the amended text.

“Encrypted” alone is not enough to determine the result. Services differ in how messages, backups, attachments and metadata are protected. The temporary exclusion also should not be read as a promise that every future child-safety law will treat every encrypted feature identically.
Why supporters and privacy advocates disagree
The child-safety case
- Detection can help identify known abuse material and some grooming-related conduct.
- Reports can give investigators leads and support efforts to locate victims.
- A defined legal framework can provide conditions, documentation and accountability for providers that use detection tools.
The privacy and security case
- Automated systems can generate false positives involving lawful personal images or conversations.
- Scanning incentives may expand from a narrow child-safety purpose to broader content monitoring.
- Inspecting private communications can undermine user trust, especially where people reasonably expect confidentiality.
- Moving detection onto devices or weakening encryption could create security risks beyond the original policy goal.
These are competing policy arguments, not findings that settle the law. The interim regulation’s legal effect remains narrower than claims that the EU has authorized blanket surveillance, while the practical pressure on major services may still be substantial.

Is there a binding EU-wide “16+ social media” law?
Not as one universal rule, as of 18 August 2026. Three layers are being discussed:
Existing binding duties
The Digital Services Act requires platforms accessible to minors to provide a high level of privacy, safety and security for them. It does not itself set a universal EU-wide minimum age of 16 for social-media access. The Commission’s children and the digital environment policy page describes that protection framework.
Parliament’s political position
Parliament has called for a minimum age of 16 for access to social media. That is significant legislative pressure, but a parliamentary position is not automatically an enforceable regulation. See the June 2026 Parliament position.
Commission recommendation and expert advice
On 29 April 2026, the Commission adopted Recommendation (EU) 2026/1035 on a common framework for age-verification technologies. A recommendation is not a regulation or directive adopted through the ordinary legislative process. The Commission’s special panel has also proposed stronger age-appropriate protections, but its work is advisory. The primary materials are the Commission Recommendation and the special-panel page.

How age assurance could work—and where it can fail
Age assurance is a family of methods, not one mandatory identity-document system. Possible approaches include:
- Self-declaration: simple and low-friction, but easy to evade.
- Document checks: stronger evidence of age, with greater privacy, retention and exclusion risks.
- Third-party age tokens: a service could receive an attestation that a threshold was met without receiving a full identity profile.
- Device, app-store or browser signals: potentially convenient, but dependent on account accuracy and interoperability.
- Biometric or behavioral estimation: can avoid document uploads but may be inaccurate or discriminatory and raises sensitive-data concerns.
- Parental consent: may help families, but creates verification burdens and does not answer every safety question.
Proof of age is not necessarily proof of identity. Privacy-preserving tokens could reveal only that someone is over a threshold, whereas centralized identity databases create additional retention and breach risks. Children may share devices or accounts; VPNs, sideloaded apps and different national rules complicate enforcement. A technically sophisticated check can still be inaccessible, inaccurate or easy to bypass.
What the developments mean for users, parents and platforms
Users
Users may see service-specific safety checks, moderation changes or age gates, depending on the provider’s choices and national requirements. The temporary framework does not mean every private message will be scanned.
Parents
Parents may gain more platform controls and clearer age-assurance signals, but could also face extra steps, privacy trade-offs and inconsistent rules between services or countries.

Platforms
Providers that volunteer to detect content must manage technical deployment, safeguards, reports, removals, cross-border cooperation and user trust. The absence of a universal scanning duty does not remove reputational or regulatory incentives to act.
Users of encrypted services
The explicit exclusion for communications to which end-to-end encryption applies is important under this temporary measure. It does not settle the separate permanent regulation, nor does it make every encrypted product exempt from every other EU or national obligation.
The permanent child-sexual-abuse regulation is still unresolved
The long-term proposal is intended to create durable EU rules for provider risk assessments, preventive measures, detection and reporting, removal, blocking or delisting, victim support and potentially EU-level coordination and enforcement. - Platforms and public authorities work out how the Commission’s age-verification framework is implemented in practice.
- Future Digital Services Act guidance and enforcement may add detail to protections for minors without creating a universal 16 threshold by themselves.
