Nomad Internet’s Texas Lawsuit Ended in an Agreed Judgment—Not Simply a “No-Fault” Dismissal

Nomad Internet settled Texas’ civil case through an agreed final judgment—not a simple dismissal. Here’s what the $8 million judgment, consumer-refund rules, and permanent injunction mean.

Yes, Nomad Internet reached a settlement with the State of Texas. Nomad described the May 2024 resolution as a “no-fault agreement” and denied the allegations. However, the court entered an Agreed Final Judgment and Permanent Injunction requiring $8 million in monetary relief, including $2 million for eligible consumers, and permanently restricting specified sales and advertising practices. That is not the same as a dismissal, exoneration, or finding that the allegations were meritless.

What happened in the Texas case?

The Texas Attorney General sued GEV IO, LLC, doing business as Nomad Internet, along with Jessica Garza, Homero Joshua Garza, and related defendants in April 2023. The state brought claims under the Texas Deceptive Trade Practices–Consumer Protection Act. The original petition is available in the Texas Attorney General’s filing.

On March 6, 2024, defendants signed the settlement documents. The court then entered the agreed judgment and permanent injunction. Nomad published its public explanation on May 23, 2024, and the Texas Attorney General announced the consumer-refund component on June 19, 2024.

What Texas alleged

The state’s allegations, which were claims in a pleading rather than findings after a contested trial, included:

  • Nomad represented or implied that it had partnerships with major wireless providers when the state alleged those relationships did not exist.
  • Customers were directed to T-Mobile, Verizon, and AT&T coverage maps in ways Texas said could suggest an authorized relationship.
  • Nomad allegedly acquired, altered, or reprogrammed wireless-provider SIM cards and distributed them without authorization.
  • Some consumers allegedly lost service when underlying carriers detected and terminated the SIM cards.

Those allegations are set out in the original petition. The judgment resolved the state’s civil claims without a trial deciding every disputed allegation.

What Nomad said about the resolution

In its May 23, 2024 announcement, Nomad called the outcome a “no-fault agreement,” said it denied the accusations, and said it would focus on rural connectivity and product development. Those are the company’s characterizations, not labels imposed by the court.

What the court actually ordered

The controlling document is the Signed Agreed Final Judgment and Permanent Injunction. It states that the parties fully compromised and settled the controversies and that the court found the settlement fair, reasonable, and just. The monetary terms are:

Texas Attorney General’s fees $1 million Reimbursement under the judgment
Unabated civil penalties $2 million Payable under the judgment
Abated civil penalties $3 million Due if defendants materially violate the judgment
Total monetary judgment $8 million Combined judgment amount

The payment structure required at least $1.5 million initially for consumer relief, followed by monthly payments until $5 million had been paid for consumer relief, attorney’s fees, and unabated penalties. The additional $3 million was conditional on a material violation. Thus, “$8 million settlement” does not mean $8 million in customer refunds.

What the permanent injunction prohibits

The injunction creates continuing obligations beyond the payment schedule. It bars the defendants from:

  • Selling or leasing wireless or telecommunications services or equipment without appropriate authorization or a contractual relationship with a network or service provider.
  • Representing that a mobile-network operator is a partner without an actual partnership or agreement.
  • Making unsupported claims about sponsorship, approval, quality, or other product characteristics.
  • Disguising the manufacturer, distributor, or source of equipment.
  • Advertising service as “unlimited” when it is not actually unlimited.

Who could qualify for the $2 million consumer relief?

The judgment defined eligible consumers narrowly. A person generally had to:

  • Purchase Nomad products or services between January 1, 2020, and November 30, 2022;
  • Request a replacement SIM card or return a SIM card because it was not working; and
  • Not already receive a full refund of membership fees and monthly payments for the relevant telecommunications services.

The $2 million was to be distributed pro rata. The Texas Attorney General described the program as refunds for more than 20,000 consumers, but the judgment’s definitions and the administrator’s records control eligibility. The documents do not establish one guaranteed payment amount for every person.

How the consumer payments were to be handled

The judgment required a consumer-relief administrator, a trust account, delivery of eligible-consumer information, funding of the full $2 million, pro-rata calculations, and mailed checks. Checks would become void after 120 days. KCC, Epiq, Global, and Rust Consulting were listed as pre-approved administrators, with another administrator permitted if the parties agreed.

Former customers should preserve invoices, SIM-replacement or return records, cancellation confirmations, refund correspondence, and address information. A customer who already received a full refund may fall outside the judgment’s defined category. The eligibility period also ends in 2022, so later service problems are not automatically covered.

Does “no fault” mean Nomad was cleared?

No. In ordinary settlement language, “no fault” can mean the defendant resolves a case without admitting liability. It does not mean the plaintiff’s allegations were judicially rejected, that the case was simply dismissed, or that the defendant was exonerated.

This case ended with a negotiated judgment, not a jury verdict on every allegation. At the same time, the court entered monetary relief and a permanent injunction after finding that the settlement was fair and that the state’s claims and requested relief supported the order. The most accurate description is: Nomad and Texas resolved the civil case by agreed judgment; Nomad denied the allegations and used “no-fault” to describe the deal; the judgment still imposed substantial payments and ongoing restrictions.

Did the judgment release every possible customer claim?

No. The release covers the Texas Attorney General’s covered civil claims arising before the judgment’s effective date. The judgment expressly says it does not affect private claimants or other governmental agencies.

That means the agreement should not be described as eliminating every private lawsuit, arbitration claim, federal action, claim against unrelated parties, or dispute involving conduct after the judgment.

What current Nomad customers should check

The settlement does not establish that every current Nomad plan is unlawful or unusable, and it does not prove present-day performance. Customers should evaluate the current service on its own terms.

Verify the underlying network and address coverage

Nomad’s terms of service state that service is delivered through third-party networks and that coverage, performance, and network-management practices can change. Ask which network supports the plan at your address and verify service where the modem will actually be used. A carrier’s coverage map does not by itself prove that Nomad is an authorized reseller or that you receive the same priority as the carrier’s direct customers.

Read “unlimited” and network-management language

Confirm whether the plan is subject to deprioritization, data-management rules, location limits, or acceptable-use restrictions. Rural cellular performance can vary with terrain, tower congestion, antenna placement, and local network conditions.

Understand the rental and refund rules

Nomad’s public plans page observed in August 2026 listed a residential plan at $99.95 per month and a travel plan at $129.95 per month, with rented modem equipment, no long-term contract, no credit check, and a 14-day money-back guarantee. These are time-stamped page observations and can change.

Under the current refund policy, the 14-day period generally starts when equipment is delivered, and cancellation and equipment return must be completed on time. Outbound shipping is described as non-refundable.

Cancel explicitly and document the return

Nomad’s billing guidance says billing can continue while a subscription remains active and the modem has not been returned and checked in. Unplugging equipment or simply stopping use is not necessarily cancellation. Obtain written cancellation confirmation, keep the return-tracking number, and retain proof of delivery and check-in.
