Thailand’s Securities and Exchange Commission (SEC) has issued rules for crypto exchange-traded funds, with Bitcoin and Ether eligible at the outset. The rules take effect on 16 October 2026; as of the SEC’s 8 October announcement, no fund launch, issuer, or listing date had been confirmed. The framework sets out how such funds must operate and what protections investors should receive.
What Thailand’s new ETF rules establish
The Thai SEC announced on 8 October 2026 that it had issued 11 notifications covering crypto ETFs and related fund-management and supervisory arrangements. The notifications take effect on 16 October 2026. They create a regulatory route for products; they do not mean that investors can already buy a Thai-listed crypto ETF.
Under the framework, crypto ETFs must meet the general rules for ETFs as well as requirements for mutual funds investing in digital assets. An asset manager seeking to establish one must demonstrate organizational readiness, including appropriate personnel, operating systems, and service-provider arrangements. The SEC’s 8 October 2026 announcement describes the framework and its effective date.
Which crypto assets can funds track?
Bitcoin and Ethereum are the initially eligible assets. The SEC says eligibility is to be determined with regard to liquidity, broad acceptance, network security, and investor protection. The announcement does not establish eligibility for other cryptocurrencies.

Funds must be passively managed to track the selected crypto asset. They must maintain at least 80% average net exposure to one crypto asset over each accounting year, as specified by the Thai SEC. This is a portfolio rule, not a statement about expected returns or a guarantee that a fund’s price will match the asset perfectly.
Where and how the funds would be held and traded
Trading on the Stock Exchange of Thailand
The framework provides for crypto ETFs to be listed and traded exclusively on the Stock Exchange of Thailand (SET). The SEC announcement does not identify a specific fund or confirm that any product has been listed.

Custody and fund supervision
Fund assets must be safeguarded by digital-asset custodians regulated by the SEC. Qualified digital-asset custodians and other digital-asset businesses may apply to act as mutual-fund supervisors, subject to readiness criteria. The final announcement also says qualified foreign custodians may be permitted if the SEC considers that appropriate to the circumstances; it does not name any approved custodian.
Investor protections and practical implications
The rules require investor education about product characteristics and risks, along with a mechanism for investors to acknowledge and confirm their understanding of risks before trading. Securities companies are to provide guidance on appropriate allocation and risk tolerance. Margin loans may not be used to purchase crypto ETFs.

Asset managers must disclose product characteristics, fund structure, investment mechanisms, service providers, and specific risks. These safeguards can help investors understand what they are buying, but they do not eliminate the volatility and other risks of the underlying crypto asset.
Thai mutual funds and private funds may also invest in Thai crypto ETFs, subject to existing investment limits. The SEC says those funds were previously permitted to invest only in foreign crypto ETFs. Its announcement does not give the numerical limits.

What investors can and cannot conclude now
- Established: The rules cover an initial Bitcoin- and Ethereum-focused framework, passive tracking, custody, trading, disclosures, and investor safeguards.
- Not established: The SEC announcement does not name an issuer, a custodian, a fund, a launch date, fees, or a SET listing.
- Not established: The announcement gives no basis for comparing the performance, costs, or holdings of specific Thai funds, because no specific fund is identified.
Before investing in a product that may be launched under this framework, check its official prospectus and disclosures for fees, tracking method, service providers, custody arrangements, and risks. Confirm that it has actually been approved and listed rather than relying on a proposed launch or a general announcement.
