Mortgage Escrow Waiver vs. Escrow Account: Costs, Risks, and Eligibility

An escrow waiver shifts property-tax and insurance payments from your mortgage servicer to you. Learn how eligibility, fees, cash flow, and missed-payment risks affect the decision.

An escrow account has your mortgage servicer collect money for covered property taxes and insurance with your mortgage payment, then pay those bills. With an escrow waiver, you pay the bills yourself. A waiver is not automatic: availability depends on the loan, applicable law, loan documents, investor requirements, and lender or servicer policy. To decide whether it makes sense, compare any fee or loan-pricing change with your ability to reserve money and pay each bill by its due date.

What changes when you waive mortgage escrow?

With escrow, the servicer estimates covered property expenses, collects funds as part of your monthly mortgage payment, and disburses them when due. The monthly amount can change as estimates and bills change. Federal rules limit an escrow cushion to one-sixth of estimated annual disbursements when a cushion is permitted; that limit concerns the account cushion, not a waiver fee. See the CFPB’s Regulation X, 12 CFR § 1024.17.

Without escrow, your mortgage payment generally excludes those property bills, and you are responsible for setting aside money and paying each bill directly. Your total housing costs have not disappeared: the taxes and insurance still come due, often in larger payments at specific times. The practical change is who holds the money and manages payment timing.

Can you remove escrow from your mortgage?

There is no universal right to waive or cancel escrow. Check the loan documents and ask the lender or servicer about the policy that applies to your specific loan. Applicable law, loan type, investor requirements, and lender or servicer rules can all affect the answer. For example, certain covered higher-priced first-lien mortgages are subject to a federal escrow requirement unless an exemption applies; the scope and exemptions are set out in the CFPB’s 12 CFR § 1026.35. That is not a rule that determines escrow requirements for every mortgage.

For loans covered by its guidance, Fannie Mae’s Selling Guide allows a lender to waive escrow for certain individual first mortgages when law and the loan documents permit it, subject to the lender’s written policy. The guide says the policy should consider the borrower’s ability to pay property bills in lump sums as well as loan-to-value. Fannie Mae states: “Fannie Mae advocates the establishment of an escrow account for the payment of taxes and insurance, particularly for borrowers with blemished credit histories or first-time homeowners.” Read the guide’s Escrow Accounts section.

Fannie Mae servicing criteria are not universal eligibility rules

For loans covered by its Servicing Guide, Fannie Mae requires denial of a waiver request in specified circumstances. These include certain recent delinquencies, a prior loan modification, a failed earlier waiver, or a principal balance greater than or equal to 80% of the original appraised value. These are Fannie Mae servicing criteria, not general thresholds for all lenders or mortgage programs. See Fannie Mae’s guidance on administering escrow accounts and paying expenses.

Ask the lender or servicer to identify the rule or policy it is applying and provide its decision in writing. Do not assume that a credit score, equity level, waiting period, or program label alone guarantees eligibility.

What does an escrow waiver cost?

A lender may charge a fee when escrow is not established. If applicable, the Closing Disclosure identifies it as an “Escrow Waiver Fee.” The CFPB’s Closing Disclosure rule, 12 CFR § 1026.38, names the fee but does not set a standard amount or require every lender to charge one.

Before accepting a waiver, ask whether there is a fee and whether the waiver changes the loan’s pricing. Review the fee and other loan terms on the Closing Disclosure; do not evaluate the decision based only on a lower monthly mortgage payment, since that payment may simply omit bills you will still owe directly.

What are the risks of paying property bills yourself?

A waiver transfers bill-management responsibility to you. You need to know when taxes and insurance are due, keep enough money available, and make each payment on time. If you spend money intended for a later bill or miss a due date, you may face consequences under the applicable tax, insurance, and loan arrangements.

For loans covered by Fannie Mae’s servicing guidance, unpaid covered property charges can lead the servicer to advance funds, revoke the waiver, and establish an escrow account. How to decide whether a waiver is worth it

Compare the actual terms and your own cash-management habits, rather than treating the waiver as a simple monthly-payment reduction.

  • Fee and loan pricing: Get the waiver fee, if any, and ask whether the interest rate or other pricing changes.
  • Cash-flow timing: Compare the regular escrow collection with the size and due dates of your direct tax and insurance bills.
  • Control: Consider whether managing the funds and paying bills yourself is worth the added responsibility to you.
  • Reliable reserves: Be realistic about whether you can consistently keep the needed money set aside, rather than relying on cash being available when a large bill arrives.
  • Loan-specific rules: Confirm eligibility and the consequences of a missed bill with your lender or servicer, using your loan documents and the policy that applies to your mortgage.

If you prefer predictable monthly budgeting or are not confident you will reserve the money, keeping escrow may be the more practical choice. A waiver may suit a borrower who can manage lump-sum bills reliably and finds the actual fee and pricing trade-off worthwhile.
