Probating a will is necessary when a court must confirm that the will is valid and authorize a personal representative to collect, manage, and distribute assets that cannot pass to heirs or beneficiaries by other means. Owning a will does not by itself trigger probate. What triggers it is the set of assets the person owned alone at death, how each one was titled, where the person lived, and whether a simplified state procedure can cover what remains.
What the court is actually deciding
Probate is the court process that proves a will and admits it so the named executor can act. New York Courts describe it as the step that must happen for the decedent’s wishes to be carried out, and it requires filing the will with the court. The executor’s authority comes from the court, which is why banks, title companies, and county offices often ask for letters or a court order before releasing or retitling assets that were held in the decedent’s name alone.
A will that is never filed does not automatically cause probate, and assets that transfer outside the will do not need the court. The practical question is therefore narrower: is there property that needs someone with legal authority to act for the estate?
Assets that usually pass without probate
California Courts identify jointly owned property with right of survivorship and transfer-on-death property as examples that may pass without formal probate. In practice, the same logic applies to several common arrangements:

- Joint tenancy with right of survivorship. The surviving owner typically takes full title. Check the deed or account registration, not the family’s understanding of who owns the asset.
- Transfer-on-death or payable-on-death designations on real estate, brokerage, or bank accounts, where the state permits them.
- Beneficiary designations on life insurance, retirement accounts, and some annuities. The named beneficiary usually claims directly from the institution.
- Property held in a funded trust. The trust’s successor trustee, not the probate court, generally controls these assets.
Each arrangement has its own paperwork and deadlines, and a designation that is outdated or never completed can send an asset back into the probate estate. Confirm every designation against the institution’s records before deciding that an asset is outside probate.
Real estate can change the answer
Solely owned real estate is the asset most likely to force a court process, even when the rest of the estate is small. New York’s small-estate route excludes solely owned real estate, so a home titled in the decedent’s name alone generally cannot be handled through that route. California handles small real property differently, through a separate affidavit for qualifying real estate, which is discussed below.

Small-estate shortcuts differ by state
Simplified procedures are the main alternative to full probate, but each state sets its own limits. The figures below come from the court pages cited and measure different things, so they should not be compared with one another or treated as a national rule. Thresholds can also depend on the date of death, so confirm the current figure on the linked page before relying on it.

California’s guidance also notes that some transfers with survivorship or transfer-on-death features may need no court process at all; the California Courts page on when formal probate may not be needed sets out those situations.

A triage sequence for the executor or heir
- Locate the original will and identify the named executor. Do not alter the original. New York Courts caution that removing staples can cause problems with its filing process, so leave the document intact.
- Establish the decedent’s state of residence and where each asset is located. Domicile and asset location can decide which court and which procedure apply. Sources reviewed for this guide do not offer a nationwide conflict-of-laws rule, so this step needs a check against the relevant state’s rules.
- Build an asset list and read every title. Separate sole-name property, joint property with survivorship, transfer-on-death assets, beneficiary-designated accounts, trust-held property, and real estate.
- Test the sole-name property against the state’s shortcut. Compare total value, the date of death, whether real estate is included, and whether a probate case is already open. Use the court page for the county or state where the decedent lived.
- Decide whether formal probate is needed. If the sole-name assets exceed the shortcut limits or include disqualifying real estate, plan for a court filing. If they fall within the limits and meet the conditions, a simplified affidavit may be enough.
What formal probate involves
New York Courts list the core filing as the original will, a certified death certificate, the petition, and supporting papers. Notice must go to distributees and beneficiaries. The package differs from county to county and state to state, so treat this as an example of what a filing looks like rather than a template to copy. Your county’s probate clerk or court website will list its own forms, fees, and notice rules.

- the estate includes real property, especially property with a mortgage or unclear title;
- heirs or beneficiaries disagree about the will, the assets, or the distribution;
- the decedent’s accounts or designations are unclear, outdated, or missing;
- the estate includes business interests, out-of-state property, or unusual assets; or
- you are unsure whether the estate qualifies for a shortcut.
A California superior court’s probate FAQ notes that even where formal probate is not required, some legal process may still be necessary, and it recommends consulting legal counsel on estate questions. The Superior Court of California, County of Stanislaus probate FAQ is one example of that guidance.
