What to Do About Returned Checks: Steps for Writers and Depositors

A bounced check can mean insufficient funds, a stop payment, a closed account, or bad check data. Here is what writers and depositors should do next, including fee and hold rules.

If a check bounced, start by getting the bank’s stated return reason. That reason decides who you need to contact, whether the money problem sits with you or the other party, and which fees or holds may apply. A returned check is not always an insufficient-funds case, and the steps differ depending on whether you wrote the check or deposited it. The guidance below reflects U.S. federal agency materials checked in October 2026. State law, the type of check, and your account agreement can change the outcome.

Start with the bank’s stated return reason

Banks return checks for several reasons. The Consumer Financial Protection Bureau (CFPB) lists the following among them in CFPB Bulletin 2022-06:

  • Insufficient funds in the account the check was drawn on (often called NSF).
  • Stop payment placed by the check writer.
  • A closed or foreign account.
  • Questionable, erroneous, or missing check information.

Ask the bank for the specific reason in writing or in the return notice. Do not assume the cause from the label “returned.”

If you wrote the check

Your priorities are confirming the cost, paying the payee another way, and preventing a second hit.

  1. Confirm the return reason, balance, and fee. Check the returned item in your transaction history or statement, and ask your bank for the reason and the fee charged. If the bank record points to a cause other than insufficient funds, follow that cause, not the assumption.
  2. Read your deposit account agreement for the NSF fee and resubmission terms. The Office of the Comptroller of the Currency (OCC) says there is no legally fixed number of times a bank must resubmit a check, and that fees may be charged each time an item is submitted, subject to the agreement. See the OCC’s guidance on NSF check resubmission.
  3. Contact the payee promptly and agree on a replacement payment method. Before you send another check, confirm how the payee will handle the original. If the first item is later resubmitted and paid, you could end up paying twice.
  4. Keep your records: the return notice, the statement entry, and your messages with the payee.

If you deposited a check that came back

Your priorities are understanding what happened to your balance, knowing when any redeposited money will be usable, and pursuing payment from the person who wrote the check.

  1. Get the exact return reason from your bank. It may be insufficient funds, a stop payment, a closed account, or a problem with the check’s information.
  2. Reconcile your balance now. Your bank may reverse the provisional credit it gave you for the check and may charge a returned-item fee under your account terms. The OCC says the payee has to pursue the maker for reimbursement; the bank is not the party that collects from the writer. See the OCC’s explanation of deposited checks that bounce.
  3. Ask whether the check can be redeposited, and when any recredited funds become available. Do not treat a credit that briefly appears as spendable money. Details are in the next section.
  4. Request a replacement payment from the maker in writing, and keep the returned check or its image, the bank’s notice, and your communications.
  5. Ask about the fee if it seems out of line with the circumstances. Ask the bank for the basis of the fee and its dispute process.

Fees and holds: what is and is not settled

Two different fees can appear in the same episode. A check writer may be charged an NSF or overdraft-related fee by the writer’s bank. A depositor may be charged a Returned Deposited Item fee by the depositor’s bank. These are separate charges under separate account agreements, and one does not cancel the other.

The CFPB defines a Returned Deposited Item as “a check that a consumer deposits into their checking account that is returned to the consumer because the check could not be processed against the check originator’s account.” In Bulletin 2022-06, dated October 26, 2022, the Bureau states that “blanket policies of charging Returned Deposited Item fees to consumers for all returned transactions irrespective of the circumstances or patterns of behavior on the account are likely unfair under the Consumer Financial Protection Act (CFPA).” That is the Bureau’s supervisory position, not a court ruling. The bulletin does not decide whether any particular fee charged to any particular customer is unlawful. It identifies blanket policies as the concern, not every returned-item fee.

The bulletin’s historical fee examples illustrate past practice. They are not a current national fee estimate, and no reliable typical amount for today appears in the official materials reviewed. Use your own bank’s fee schedule.

For a redeposited check, availability can be delayed by an exception hold. OCC guidance on exception holds on redeposited checks says the hold may extend availability by an additional five business days, or possibly longer. A displayed credit does not mean the check has cleared or that the amount is final.

Suspected fraud or an unauthorized check

If the returned item appears unauthorized, forged, or altered, act quickly. The CFPB advises notifying your bank or credit union promptly. Federal protections may apply if the check was processed as an electronic transfer. If it was not, protections may depend on state law. Prevention for check writers

The OCC says a bank does not have to notify you when an NSF check is returned, so the tracking falls to you. Keep an accurate check or transaction register and balance it against your statement. If you still write checks, a paper check register works. An electronic register or the bank’s balance alerts and email notices are alternatives. Ask your bank which notices it offers.

Where state law and collection rules take over

Collection remedies, demand-notice requirements, the fees a payee can recover from the writer, and any civil or criminal consequences depend on state law and on the type of transaction. The reviewed federal sources do not establish a single national demand-letter form or a universal collection deadline. For a disputed or substantial amount, contact your state’s consumer protection office, state-specific legal aid, or an attorney before you take collection steps.

For practical purposes, the sequence is the same in every state: identify the reason, confirm the money, fix the replacement payment, and keep records.
