What Farmers Should Know About Eminent Domain (U.S. Federal Rules)

Whether a farm can be taken by eminent domain depends on who is acquiring the land and under what authority. This guide walks through the federal frameworks for pipelines, transmission lines and federal projects, plus valuation, possession, notice and crop allotment rules.

A farmer facing eminent domain needs three answers before anything else: who is taking the land, what legal authority they are invoking, and exactly what interest they want, whether that is full ownership, a permanent easement, a temporary construction right or an access right. Those answers decide which compensation rules, notice periods and possession rules can apply.

This article covers the main federal frameworks in the United States. It is not a state-by-state legal guide. Eminent-domain authority and procedure depend on who is acquiring the property, which statute or state authority they use, what kind of project it is, and where the land is located. No single federal rule governs every taking, and nothing here can set a deadline or identify a defense for your parcel.

Start with three questions: who, under what authority, and what interest

Every eminent-domain question for a farm turns on the same three facts. Pin them down from the written notice or offer before you respond to anything.

  1. Identify the acquiring entity. Is it a federal agency, a state or local government, or a private company? A private company’s involvement does not by itself show that it holds condemnation power. Federal law can delegate that power to certain private project sponsors, but only under specific statutes.
  2. Identify the legal authority. Ask which statute, regulatory approval or state law is being used. For a pipeline, that is usually a federal certificate; for certain interstate transmission lines, a federal permit. The notice should name it, and if it does not, ask in writing.
  3. Identify the exact interest. Fee title, a permanent easement, a temporary construction easement and an access right are different takings. The width, length, term and location of the interest drive both the valuation and what you keep using.

Which federal framework applies to your land

The table compares the three federal frameworks that most often matter to farmland. Each row is a summary; the sections that follow explain the parts that need more detail.

Can a pipeline or transmission company take my farmland?

Sometimes, but only under specific federal conditions. Neither statute gives every energy company or infrastructure developer the power to condemn farmland. Each one attaches to a particular kind of project and a particular federal approval.

Natural gas pipelines

Under the Natural Gas Act, holders of a FERC certificate of public convenience and necessity can use federal eminent-domain authority to acquire necessary pipeline rights-of-way when they cannot acquire the right by contract or cannot agree on compensation. In PennEast Pipeline Co. v. New Jersey (2021), the Supreme Court held that this authority extends to necessary rights-of-way in which a State has an interest. The ruling is specific to natural-gas pipelines. It is not a statement about other industries.

The Court’s syllabus frames the broader history of federal condemnation this way: “The Federal Government has exercised its eminent domain authority since the founding, connecting our country through turnpikes, bridges, and railroads—and more recently through pipelines, telecommunications infrastructure, and electric transmission facilities.” (Supreme Court of the United States, PennEast Pipeline Co. v. New Jersey, syllabus, 2021.)

Interstate electric transmission lines

For certain interstate transmission projects, 16 U.S.C. § 824p provides a separate route. A permit holder that cannot acquire a necessary right-of-way by contract or agree on compensation may use eminent domain, but only if the Commission determines that the holder made good-faith efforts to engage landowners and stakeholders early in the permitting process.

The statute limits the right-of-way to the specified transmission purposes and requires fair-market-value compensation, including applicable severance damages. It also directs that federal-court proceedings follow state procedure as nearly as practicable, so state practice still shapes how a case unfolds. Whether any of this applies depends on the particular permit and the statutory conditions. Check the permit before assuming it does.

If only part of my farm is taken, how is it valued?

Valuation depends on the specific interest taken and on how the project affects what remains. The clearest federal rules apply to covered federal agency acquisitions. Those rules set a floor and require explanation, but they do not list every compensable farm impact.

The offer starts from an approved appraisal

Before negotiations begin, a covered federal agency must set the amount it believes is just compensation. Its initial offer may not be less than its approved appraisal of fair market value. The agency must give you a written statement and a summary of the basis for the amount. Where appropriate, payment for the land acquired and damages to the remaining property are stated separately. Ask in writing for a copy of the appraisal behind the figure, since a summary of its basis is not the same thing as the appraisal itself.

Damage to the remaining farm and uneconomic remnants

If only part of a property is acquired and the agency determines that the remainder has little or no value or utility to you, it must offer to acquire that uneconomic remnant. This is a defined statutory circumstance, not a general guarantee that every affected remainder will be purchased. Under the transmission statute, compensation includes applicable severance damages, but the amount still depends on the facts and the governing law.

Questions that shape the valuation

Before you accept any figure, work through these questions with the acquiring party in writing:

  • What exact acreage, easement, access right or other interest is described, and is there a map or plan?
  • How will construction and operation affect fields, drainage, irrigation, buildings, fences, field access and crop rotation?
  • How much value and usefulness will the remaining parcel lose, and how will that be measured?
  • Which impacts are included in the offer, and which are being addressed separately?

Federal statutes do not establish a universal list of payable farm losses. Do not assume that any particular item, such as lost income or replanting costs, will be paid unless the governing law or the written offer says so.

Can they take possession before I am paid?

The answer depends on which procedure is used, and the two main federal mechanisms work differently.

Covered federal agency acquisitions

Under the federal Uniform Relocation Assistance and Real Property Acquisition Policies Act, an owner generally cannot be required to surrender possession before receiving the agreed purchase price or a qualifying court deposit. The exact conditions follow the statute’s text, so read it closely if you are in this situation.

The Declaration of Taking Act

In federal condemnation proceedings, a different mechanism applies. Filing the declaration of taking and depositing the estimated compensation vests title to the specified interest in the United States and vests the right to compensation in those entitled to it. The deposit is an estimate, and the final amount owed is determined separately. In practice, title can pass before the compensation amount is settled, which is why the deposit figure and the court papers deserve immediate attention.

How much notice do I get if my farm operation has to move?

For a covered federal public improvement, 42 U.S.C. § 4651 provides that the project should be scheduled so that a person lawfully occupying the property is not required to move a farm operation without at least 90 days’ written notice of the required move. That obligation applies “to the greatest extent practicable.” It is a scheduling standard for federal acquisitions, not an absolute notice period for every taking. The provision was enacted as part of Pub. L. 91–646 on January 2, 1971.

If your state or a private project sponsor is acquiring the land, the federal 90-day provision may not apply at all. Ask for the notice period in writing and check what your state requires.

Crop acreage allotments: a narrow federal transfer rule

Under 7 U.S.C. § 1378, a separate agricultural provision addresses the transfer of certain crop acreage allotments when land is acquired for a nonfarming purpose. It is an allotment rule, not a compensation program, and it has conditions.

Eligibility and the three-year window

The provision applies when an owner is displaced because land is acquired for a nonfarming purpose by an agency with eminent-domain authority. The owner may apply to the county committee within three years after displacement to establish allotments for other farms owned by that person, subject to the statute’s criteria and limitations. Whether an allotment exists for your crop and farm is a question for the county committee.

The 15 percent threshold

Where the acquired cropland is less than 15 percent of the farm’s total cropland, the allotment attributable to that acquired portion is transferred to the portion that was not acquired. This is not replacement land, not compensation for lost income, and not a general federal payment program. Do not treat it as a substitute for the valuation discussed above.

Negotiating versus contesting an offer

Federal acquisition policy encourages negotiated agreement, avoids condemnation where possible, treats owners consistently and promotes public confidence in the process. Those are policy goals, but they do not stop a proceeding by themselves. Talks do not pause formal court or agency deadlines, and formal papers should never be set aside on the assumption that negotiations will resolve them.

When you weigh a voluntary sale or easement against contesting a proposed taking, compare the same five things side by side:

  • The actual offer and the specific property interest it covers
  • The appraisal and the documented effect on the remaining land
  • The applicable process and its timing
  • The authority the project claims, including whether its federal approval is final, conditioned or changed
  • The compensation for severance and remnant losses under the governing law

Documents to gather before your first response date

  • The written notice, offer, court papers, project name, acquiring entity and the exact statute or certificate it cites
  • The parcel and easement descriptions, maps or plans, the term and width of any right-of-way, construction access and proposed restoration terms
  • The agency’s appraisal, its written explanation of the amount and any separate accounting for damage to the remaining land
  • Evidence of farm use and impacts: crop plans, leases, access and drainage arrangements, irrigation systems, structures, fencing and records of the affected remainder
  • Every response, negotiation, hearing or court date stated in the papers, written down in one place

Questions for a state-specific attorney

Federal rules leave a great deal to the state where your land sits, and the answers to these questions can change the outcome. Statutes are amended over time, so confirm the current text in the U.S. Code and in the agency’s regulations before relying on any provision above.

  • Which state condemnation procedure and compensation rules apply to this taking?
  • What response, hearing or court deadlines apply, and when did the clock start?
  • Does the acquiring entity actually hold the authority it claims for this project?
  • Are severance damages and remnant losses recoverable under state law for this kind of land use?
  • Has the underlying project approval been issued, conditioned, extended or changed?
