The borrower may continue using the property, but the creditor may have rights against it if the borrower defaults. The name does not determine the exact legal effect: the governing law and agreement control.
How a chattel mortgage works
The borrower agrees that identified movable property will serve as collateral for a debt or other obligation. For example, a business might use a vehicle or piece of machinery as collateral for financing. The Nigeria Collateral Registry describes a security interest as “a property right in collateral that is created by agreement to secure the payment or performance of an obligation.” The details of title, possession, and use depend on the agreement and local law; the label does not mean title always transfers to the lender.
Movable property is property other than land. The types of assets covered depend on the applicable legal framework. The Nigeria Collateral Registry, for example, lists vehicles and business equipment such as farm equipment, machinery, taxis, and computers as examples in its regulatory context.
What happens if the borrower defaults?
A secured creditor may have rights against the agreed collateral after a default. What counts as default, what notice is required, and how a creditor may enforce its rights depend on the contract and governing law. The term “chattel mortgage” alone does not establish that a lender can immediately repossess an asset or prescribe a single repossession process.

Why the jurisdiction matters
There is no single worldwide rulebook for chattel mortgages. Some legal systems treat the term as one transaction within a wider personal-property security framework; others set particular recording rules or direct certain assets to separate statutes.
- Kenya: The Movable Property Security Rights Act, 2017 covers security rights in movable assets and expressly includes chattel mortgages. It excludes interests in land and certain categories governed by separate laws, including vessels and aircraft.
- Nigeria: The Nigeria Collateral Registry FAQ explains security interests and gives examples of movable collateral under its regulatory framework.
- North Carolina, United States: State law provides recording rules for personal-property mortgages and refers vehicle security interests to separate motor-vehicle provisions. See Chapter 47, Article 2.
- Ontario, Canada: The Personal Property Security Act lists chattel mortgages among transactions that may create a security interest.
- Texas and North Carolina, United States: State Article 9 statutes provide secured-transactions rules. Texas defines goods as things movable when a security interest attaches. These are state-specific frameworks, not a single nationwide rule. See the Texas Business and Commerce Code, Chapter 9 and North Carolina Chapter 25, Article 9.
Does a chattel mortgage need to be registered?
Registration, recording, and other steps to make a security interest effective against third parties vary by jurisdiction and asset type. North Carolina, for instance, has personal-property mortgage recording provisions and directs vehicle security interests to separate motor-vehicle rules. That example does not establish the requirements for another state, country, or transaction. Check the applicable statute and the contract rather than assuming that signing the agreement is the only required step.

What to check in the agreement
Before signing, read the document and confirm the points that affect your rights and obligations:
- Which asset is collateral, and how precisely is it identified?
- What debt or other obligation does the collateral secure?
- What are the payment terms, and what events count as default?
- May you continue using the asset, and does the agreement limit selling, transferring, or otherwise disposing of it?
- What filings or registrations are required for this asset in the relevant jurisdiction?
- What enforcement process does the agreement describe, subject to local law?
- How will the security be released or recorded as discharged after the obligation is paid?
How it differs from other financing labels
“Chattel mortgage” is not a universal, self-defining category that can be reliably distinguished from every secured loan, conditional sale, hire-purchase contract, or equipment-finance agreement by name alone. Kenya’s movable-property security law includes chattel mortgages within a broader security-rights framework, while Ontario’s Personal Property Security Act lists them among transactions that may create a security interest. In practical terms, compare what the contract actually does: whether the asset secures an obligation, who holds title and possession, how the asset may be used or disposed of, what filing rules apply, what happens on default, and how the security is released.
