The National Farm Security Action Plan signals tighter federal scrutiny and improved reporting of foreign interests in U.S. farmland and agriculture. It does not, by itself, ban foreign-owned agricultural companies or require Syngenta to sell U.S. assets. The practical impact depends on whether a foreign person has a reportable interest or control in agricultural land, whether a transaction is subject to review, and which state laws apply.
What the plan calls for
USDA’s July 2025 National Farm Security Action Plan treats foreign interests in agricultural land as a national-security and transparency issue. It calls for the department to strengthen the Agricultural Foreign Investment Disclosure Act (AFIDA) process through enhanced reporting and verification, and to share information more effectively. It also calls for coordination with the Treasury Department’s Committee on Foreign Investment in the United States (CFIUS) on covered transactions involving farmland, agricultural businesses, agricultural biotechnology, or the agriculture industry.
- More reliable reporting: USDA intends to improve the information it collects and how it verifies it.
- More interagency coordination: The plan identifies coordination with CFIUS for transactions that fall within its review framework; it does not say every foreign agricultural investment is automatically subject to CFIUS review.
- Possible further policy action: The plan describes work with state and congressional partners toward action concerning farmland control by nationals of countries of concern or other foreign adversaries.
These are stated priorities and proposed directions. An action plan is not itself a new statute, final regulation, parcel-specific decision, or universal ownership prohibition.
What AFIDA requires of foreign persons
USDA’s AFIDA overview says foreign persons who hold a “significant interest or substantial control” in agricultural land must file a disclosure. That is a federal reporting duty; it should not be confused with permission to own land, a finding that ownership is unlawful, or a general restriction on operating an agricultural business. The materials cited here do not establish a specific filing threshold, deadline, or penalty, so businesses should use current USDA/FSA guidance for those details.

USDA launched an online AFIDA filing portal on January 22, 2026, while keeping the FSA-153 paper form available. The agency says the portal collects the same information as the paper form and cautions filers not to submit both versions for the same filing. The portal announcement changes the filing channel, but does not by itself establish a change to AFIDA’s substantive rules or filing threshold.
Why Syngenta is relevant—and what its example does not prove
In its 2020 launch announcement, Syngenta described the group as “Swiss headquartered and Chinese-owned,” said it brought together Syngenta AG, ADAMA, and agricultural businesses of Sinochem, and identified U.S.-headquartered Syngenta Seeds as a business unit. A Sinochem/ChemChina announcement said the group was wholly owned by ChemChina at the time of the restructuring. These company statements explain why Syngenta is a useful example in a discussion of foreign interests in agriculture.

They do not establish the present ownership of a particular U.S. parcel, whether a particular entity has filed an AFIDA disclosure, or whether a transaction involving the company would be reviewed or restricted. Nor does the action plan itself direct Syngenta to divest land or businesses.
AFIDA rulemaking is distinct from a binding final rule
The regulatory agenda describes AFIDA revisions as a rulemaking effort, with an advance notice of proposed rulemaking, a planned proposed rule, and a planned final action. Federal Register proposed-rule material from 2026 connects that work to the action plan, data integrity, and information sharing. A planned timetable or proposed rule is not the same as an effective final regulation. A business evaluating a filing or transaction should check the current regulation and rulemaking docket rather than assume every contemplated reform is already binding.

State ownership restrictions and enforcement are separate
Federal AFIDA disclosure and state restrictions on foreign ownership are different questions. A filing under federal law does not settle whether a particular state permits a given entity to own particular land; state law and the facts of the parcel or transaction matter independently.
In October 2023, the Associated Press reported that Arkansas ordered Northrup King Seed, identified as a Syngenta subsidiary, to divest 160 acres in Craighead County and imposed a $280,000 penalty concerning a state reporting requirement. That is a dated report of state-level action, not proof of the order’s current status. The cited report does not establish whether the land was divested or whether the penalty or order was later resolved.

What a foreign-owned agricultural business should check
- Identify the land interest. Determine whether the relevant entity holds an interest in agricultural land or has control that may trigger AFIDA reporting. Do not assume that foreign ownership of a business, without more, answers the land-reporting question.
- Check current federal filing guidance. Consult USDA/FSA’s current AFIDA instructions and use either the online portal or the FSA-153 paper route for a filing; follow USDA’s instruction not to duplicate the same filing in both systems.
- Assess the transaction separately. For an acquisition, investment, or other covered transaction, determine whether CFIUS review applies based on the transaction and applicable rules. The plan’s reference to coordination does not establish that a specific deal is covered.
- Check the state law where the parcel is located. State ownership rules and state reporting or enforcement actions may apply independently of federal disclosure. For a past order or penalty, verify its present status with the relevant authority or company.
- Get advice on the actual facts. Ownership chains, control rights, parcel location, land use, and transaction structure can affect the analysis. For a specific filing or investment decision, consult current agency guidance and qualified counsel.
USDA’s AFIDA detailed data page warns that annual data may contain errors and that historical spreadsheets are not routinely updated. Any acreage or ownership figure drawn from those files should therefore be tied to its reporting year and treated with that limitation; no acreage total is needed to understand the plan’s core effect.
