What Was the FBI Probe Into Future Electronics About?

In July 1999, a Future Electronics executive linked an FBI investigation to pricing practices, but the FBI declined to confirm that characterization.

A Future Electronics executive said in July 1999 that an FBI investigation appeared to concern the distributor’s pricing practices. The FBI did not confirm that description. Later that year, news coverage reported separate allegations about sales and inventory reporting; Future disputed wrongdoing, and the contemporaneous reports said no formal charges had been filed as of their publication dates.

What did the Future Electronics executive say the investigation concerned?

In a July 9, 1999, report, EE Times quoted Robert Vaupshas, then Future Electronics’ vice president of sales, as saying: “It seems the investigation stems from a fundamental industry practice with respect to pricing.” The headline’s reference to the probe’s “subject” reflects Vaupshas’ characterization, not a confirmed statement from the FBI. Did the FBI confirm that pricing was the focus?

No. The report quoted an FBI spokeswoman in Dallas saying, “We wouldn’t confirm that this is the direction the investigation is headed.” The article therefore records what a Future executive believed the investigation concerned while making clear that the bureau did not verify his account. What pricing practices did the report describe?

The July article gave context about how electronics distributors and suppliers handled component prices. It described Future’s Market Price Program as buying components in volume upfront after negotiating with suppliers. It also discussed ship-from-stock-and-debit and meet-comp arrangements, through which supplier credits could address price changes or competing offers. These descriptions explain the commercial setting; they are not findings that Future’s practices were unlawful. EE Times, July 9, 1999

What did later 1999 coverage report?

A November 12, 1999, EE Times article described allegations in a Department of Justice affidavit concerning false sales and inventory reporting and the keeping of two sets of books. These were reported allegations, not established findings of guilt. The article also reported that Future and chief executive Robert Miller disputed wrongdoing; it characterized the company’s public position as calling the allegations “wholly unfounded and distorted.” EE Times, November 12, 1999

Were charges filed, and what was the investigation’s outcome?

The July report said no charges had been filed and no arrests made at that point. The November report said no formal charges had yet been filed as of its publication. Those dated statements do not establish what happened after 1999, and the cited contemporaneous coverage does not verify the investigation’s ultimate outcome.

Why did Future dispute the characterization?

The July article also quoted Miller, in an employee memo, saying: “This investigation stems from a fundamental misunderstanding of the entire electronic distribution industry.” That was the company’s position, just as Vaupshas’ comments were his characterization of the probe; neither statement amounts to a determination by investigators or a court.
