USPTO Refuses Tesla Robotaxi Trademark as “Merely Descriptive”

The reported USPTO refusal addressed whether ROBOTAXI describes a particular offering—not a blanket ban on Tesla registering or using the word. Separate filings and proceedings have distinct records and outcomes.

The USPTO’s reported refusal concerned whether ROBOTAXI describes the offering covered by a particular Tesla trademark application, rather than identifying Tesla as its source. The May 2025 report described a nonfinal office action, not a final ruling that Tesla can never register the term or use it. Later filings and proceedings have separate serial numbers and should not be treated as one case.

What “merely descriptive” means in this trademark dispute

In a trademark application, an examiner may refuse registration if the wording directly describes the goods or services listed in that application instead of functioning as an inherent indicator of their commercial source. The question is tied to the mark as applied for and the specific goods or services in that record; it is not a blanket decision about every use of the word Robotaxi.

The May 2025 reporting characterized the USPTO action as a nonfinal refusal on descriptiveness grounds. A nonfinal action gives the applicant an opportunity to respond. It is not a final adjudication that the wording can never be registered, and it does not by itself prohibit use of the word. The report and indexed USPTO materials identify Tesla, Inc. as the applicant, but the specific serial number for the reported May refusal is not established in the sources cited here. Reuters’ May 8, 2025 report and the USPTO application record for serial no. 99241534 are distinct references; the serial number should not be assigned to the reported refusal without confirming the underlying office action.

Why the application records must be kept separate

Tesla has multiple ROBOTAXI application records. Each has its own serial number, goods or services, prosecution history, and potential outcome. An office action, deadline, or opposition involving one filing does not automatically apply to another.

What the later procedural updates do—and do not—show

October 21, 2025 office actions

USPTO indexed results show separate nonfinal office actions for serial nos. 99241534 and 99241526. The available indexed information is not enough to state their exact goods or services or to quote the examiner’s reasoning, so those details should be taken from each application’s own file rather than inferred from the May 2025 report.

February 4, 2026 extension request

For serial no. 98795389, Tesla requested a three-month extension on February 4, 2026. The form identifies November 20, 2025 as the office-action issue date and says the extension would make the response deadline six months from that date. This documents extra response time requested for that application, not whether Tesla later responded or what the USPTO ultimately decided.

September 10, 2026 opposition record

TTABVUE lists opposition no. 91310278 as pending and identifies Tesla’s serial no. 99185848 in that proceeding. The record also names serial no. 99032366 as a pleaded application with a suspension-letter status. An opposition is a separate proceeding from an examiner’s descriptiveness refusal, and the record should not be used to characterize the outcome of the May 2025 application.

Can Tesla trademark the word “Robotaxi”?

The reported nonfinal refusal does not answer that question for every Tesla filing. A decision about registration depends on the particular mark, the goods or services claimed, the evidence and arguments in that application, and how the USPTO proceedings develop. The cited materials establish separate records and procedural events, but they do not establish a final outcome for serial no. 98795389 after its extension request or a final resolution of the pending opposition.

For a definitive status, consult the USPTO’s TSDR record for the exact serial number and review its documents and status history. Do not assume that a refusal, response deadline, extension, or opposition in one serial-numbered file carries over to another.
