CBP proposes new electronic filing, carrier-data and bonding requirements for informal entries valued at $2,500 or less. Comments are due December 7, 2026; the notice sets no final effective date.
What is the new import rule for Shein and Temu?
CBP published a proposed rule titled “Low-Value Shipments” on October 8, 2026. It would change customs entry procedures for informal entries of goods valued at $2,500 or less. That category is broader than orders from Shein and Temu: the proposal is not limited to those companies, particular retailers, or a single country of origin.
The proposal addresses customs paperwork and related entry requirements. It does not itself impose a new ban on low-value packages or restore or terminate duty-free treatment. CBP says its goals include protecting revenue and improving identification of violations of customs and trade laws, health and safety requirements, intellectual-property rights, and consumer-protection rules, as well as detecting and preventing illicit drugs and related materials. Those are the agency’s stated rationales, not measured outcomes established by the proposal.
What would CBP change?
All of these are proposed requirements, not rules that became final with the October notice.

- Electronic filing: Informal entries would have to be filed electronically before or upon importation.
- A mail-specific entry type: CBP would create electronic informal-entry type 13 for merchandise arriving through the mail environment.
- More data from carriers: The proposal would require additional carrier data for mail shipments.
- Bonds for certain entries: Certain informal entries would require a bond. The notice describes this as applying to certain entries, not every shipment in the category.
The practical effect for an individual purchase may depend on how it is shipped, how it is entered, and who handles the filing and any required bond. The notice does not provide shipment-specific legal advice or quantify how many Shein or Temu orders would be affected.
Is this the rule that ended the $800 de minimis exemption?
No. The $800 figure in CBP’s background discussion refers to the value limit associated with the de minimis exemption; it is not the ceiling for the October proposal’s informal-entry filing changes. The proposal’s stated value ceiling is $2,500 or less.

CBP’s notice describes the duty-free de minimis exemption as already suspended since at least August 29, 2025. It also references interim final rules issued June 24, 2026, covering non-postal and postal shipments. Separately, the notice says the One Big Beautiful Bill Act terminates the statutory exemption effective July 1, 2027. These are distinct developments, not provisions newly enacted by the October proposed rule.
Executive Order 14388, issued February 20, 2026, continued suspension of duty-free de minimis treatment for covered shipments regardless of value, country of origin, transport mode, or method of entry, while providing separate treatment for international postal shipments. That background helps explain why the October notice addresses entry procedures; it should not be confused with a new de minimis suspension.

Will Shein and Temu orders cost more or take longer?
The proposal could affect the steps involved in processing some imports if it is adopted, but CBP’s notice does not estimate consumer price increases, delivery delays, or the share of orders from either platform that would be affected. It would be speculative to assign a dollar increase or a delivery-time estimate based on this notice alone.
Whether a particular order faces a cost or processing change may depend on its entry and shipping arrangements, and on how CBP ultimately handles the proposal. The October notice does not establish the duty treatment or consumer impact for a specific shipment.

When would the proposed rule take effect?
The notice was published October 8, 2026, and CBP must receive comments by December 7, 2026. The proposal does not specify a final effective date. It may be revised or finalized after the comment process; the notice alone does not establish what CBP will do next.
