A working prototype is not yet a sellable product. To make the transition, define who will use it and where, turn the design into something that can be built and tested consistently, identify the rules that apply in each market, and plan for production, quality, and cash flow. The exact path depends on the product: a wireless consumer device, a product with medical intended use, and a non-radio electronic device may face different requirements.
Start by defining the product, customer, and markets
Write down the intended user, the problem the product solves, how and where it will be used, and the countries where you expect to sell it. These are practical design decisions as well as business ones: they shape the product requirements, testing plan, compliance work, and likely production needs.
Specify what the product must do and the conditions under which it must work. Include operating conditions, power and enclosure details, expected user behavior, durability expectations, and how you will tell whether a unit works correctly. A prototype that works on a bench has not necessarily demonstrated that it will work reliably in ordinary use or across repeat builds.
If the product has a medical intended use or makes medical claims, do not treat it as ordinary consumer electronics. FDA device classification and risk-based controls may apply, and the marketing pathway differs by device class. The FDA’s How to Study and Market Your Device guidance is a starting point for understanding that separate path.

Make the design repeatable before committing to production
Productization means controlling more than the circuit. Define the complete product construction, including components, dimensions, enclosure openings, power connections, labels, and any manufacturing or factory-test requirements. UL Solutions’ preparation guidance identifies these kinds of product and manufacturing details as relevant to an evaluation.
Test usability and robustness as part of design iteration. Simplexity Product Development’s November 2020 entrepreneur guide discusses checks such as drops, temperature, and water exposure. Which tests make sense depends on the product’s intended use and environment; those examples are not a universal test plan or a current compliance checklist.

- CLEAR SETUP SUPPORT FOR FIRST-TIME BUILDERS — Download the latest tutorial and code, select the UNO board and correct computer port, check component polarity and breadboard rows, and keep power-module input at 9V or below; younger learners should work with an experienced adult
Keep controlled records of the design and its revisions. Before a unit is built, the people doing the work should be able to identify the approved design and the applicable build instructions. Record defects and changes so that a fix can be evaluated and carried into later builds rather than applied informally to only some units.
Identify compliance obligations before launch
There is no single certification that makes every electronics product legal to sell. Requirements depend on the product, its functions and intended use, and the markets where it will be offered. Identify the applicable rules early enough that a required design change does not arrive after tooling, production, or a sales commitment.

| Product or market situation | What to investigate | Why timing matters |
|---|---|---|
| U.S. consumer product | Use the U.S. Consumer Product Safety Commission’s free Regulatory Robot as a starting point. Run it separately for each different product type. | The CPSC cautions that noncompliant samples must not be sold or distributed to U.S. consumers. |
| Product with radio-frequency functions | Determine whether FCC equipment authorization applies to the device and its intended marketing. | Under 47 CFR § 2.803, certain RF devices may not be delivered to end users before required authorization. The regulation contains limited conditional-sales and pre-sale provisions with specific conditions; it is not a general permission to sell first and authorize later. |
| Product sold in the EU | Identify the applicable product rules and whether CE marking applies. Complete the required conformity assessment, technical documentation, and any required EU declaration of conformity; provide understandable instructions and safety information; and meet marking and traceability duties. | The European Commission’s Your Europe guidance says these manufacturer obligations also apply to manufacturers based outside the EU. The exact requirements depend on the product. |
| Product being evaluated for electrical safety | Identify the applicable safety standard and check whether critical components are suitable for the product. Consider evaluation by an appropriate testing or certification provider. | UL Solutions advises starting with applicable requirements early and preparing detailed product and manufacturing information. A UL Mark is one possible route, not proof that every product legally needs one. |
For U.S. electrical and electronic equipment, NIST’s 2016 guide provides a government overview of compliance requirements. Because it dates from 2016, use it as orientation and verify current requirements with the relevant regulator. Do not infer a certification requirement from the fact that a product contains electronics; UL standards are generally voluntary unless incorporated into a regulation or code.
Plan the manufacturing handoff and quality process
Before a production run, agree with the manufacturing partner how approved design revisions will be identified, who controls generated intellectual property, how pilot builds will be tracked, what process validation is needed, how defects will be recorded, and which quality measures must be met. These controls make it easier to see whether units are being built to the same approved design and to respond when a problem appears.

When comparing potential partners, ask what is included in their scope—such as design assistance, testing, certification support, new-product introduction, production, fulfillment, or after-sales support—and whether their experience and process fit the product’s complexity, intended markets, and target volume. Compare setup and per-unit costs, minimum order quantities, lead times, access to design files, and intellectual-property terms using product-specific proposals rather than assumptions about a provider or a standard fee.
Simplexity’s November 2020 guide covers production handoff topics including process validation, build tracking, schedule and budget review, quality metrics, intellectual-property control, and revision records. Treat it as industry guidance, not a regulator’s rulebook or a substitute for product-specific compliance work.

Work out the financial plan before choosing a launch size
A first production run ties up money before all units are sold. Build a product-specific budget that accounts for design changes, evaluation and testing, manufacturing setup, components, production, and the work needed to support customers. Ask potential partners for quotes and lead-time assumptions, then test whether the plan still works if evaluation reveals a needed redesign, a build takes longer than expected, or initial sales are slower than forecast.
Do not choose a launch quantity or sales channel based on a generic rule. The right choice depends on customer demand, unit and setup costs, distribution, service burden, and working capital. Customer research and a clear view of how customers will buy and get support are more useful than treating a prototype’s popularity among friends as proof of demand.
For an eligible U.S. small business working on technology relevant to federal agency needs, SBIR/STTR may be a possible non-dilutive funding route. The official SBIR.gov program describes a development-to-commercialization pathway; eligibility and current opportunities must be checked for the specific business and project. It is not a guaranteed source of funding or a substitute for a sales and cash-flow plan.
Use a staged go/no-go decision
Move to a production commitment only when you can identify the intended user and markets, the approved design and test evidence, the applicable compliance path, the production and quality controls, and the funding needed to complete the launch and support customers. If one of those is unresolved, make the next spend serve that decision—for example, clarify an applicable requirement, validate a design assumption, or obtain a production quote—rather than treating a larger build as progress by itself.
