Are Shein and Temu on the U.S. Forced-Labor Entity List? What the Latest Records Show

The latest official U.S. records reviewed do not establish that Shein or Temu was added to the UFLPA Entity List. Here is what the list covers and what recent government actions mean.

No official records reviewed establish that Shein or Temu has been added to the U.S. Uyghur Forced Labor Prevention Act (UFLPA) Entity List. The headline that the Trump administration was considering the retailers describes reported deliberations, not a completed government designation. The latest official update covered 43 companies, effective August 3, 2026, but did not identify either retailer as an addition.

What the UFLPA Entity List is—and what it is not

The UFLPA, enacted in 2021, created a statutory Entity List covering specified entities and products connected to forced labor in Xinjiang. It is not a general blacklist of retailers accused of labor abuses. The law’s categories include entities that produce goods wholly or partly in Xinjiang; entities working with the regional government on specified labor schemes; products made by listed entities; exporters of those products from China to the United States; and entities sourcing material from Xinjiang or specified labor programs. Being discussed for possible inclusion, being recommended for evaluation, and appearing on the official list are different things. A formal listing is an agency action under the statute; a report about possible deliberations does not itself change a company’s status.

What the latest official records say about Shein and Temu

On July 31, 2026, the Department of Homeland Security announced 43 additions to the UFLPA Entity List, effective August 3. DHS Secretary Markwayne Mullin said, “Today we are adding 43 Chinese companies to the Uyghur Forced Labor Prevention Act Entity List, and DHS will ensure their products do not enter our country.” The announcement described the additions, but did not identify Shein or Temu among them. The Federal Register notice dated August 3 records the updated list and confirms 43 new entities; two appear on separate sub-lists. It likewise does not establish that Shein or Temu was added. Federal Register notice.

These records support a precise status statement: the reviewed official additions do not name either retailer. They do not establish what officials may have discussed privately, and they are not a finding about either company’s supply-chain practices. Because the list can change, consult the current DHS UFLPA Entity List for the latest status.

Why a separate 2026 trade action does not answer the listing question

On July 23, 2026, the Office of the United States Trade Representative announced final action under Section 301 following investigations into 60 economies’ failure to impose or effectively enforce prohibitions on forced-labor imports. The White House memorandum also describes the inquiries as economy-level investigations. USTR announcement and White House memorandum.

That Section 301 action concerns trade policy toward economies; it is not a retailer-specific UFLPA designation. The 60-economy figure therefore does not mean that Shein or Temu was added to the Entity List.

What the congressional commission recommended

The Congressional-Executive Commission on China’s 2025 annual report recommended evaluating whether Temu and SHEIN, if vertically integrated in manufacturing, sourcing, or warehousing, warrant inclusion on the UFLPA Entity List. That is a commission recommendation to evaluate possible inclusion—not an agency determination, proof of a violation, or confirmation that either retailer is listed. How to read claims about the retailers

  • “Under consideration” describes a reported possibility, not a completed listing.
  • “Recommended for evaluation” describes the CECC’s position, not a government finding about company conduct.
  • “Added to the Entity List” should be supported by the current official DHS list or a formal government notice naming the entity.

A listing-status question is narrower than the broader question of whether a company uses forced labor. The official actions discussed here do not establish a finding about either retailer’s actual labor practices.
