If you’ve just been fired, stay calm, avoid making statements you can’t verify, and get the next steps in writing. Don’t rush to sign a release, assume severance or an immediate final paycheck is guaranteed, or miss deadlines for unemployment and health coverage. The practical steps below are U.S.-focused; rights and deadlines can vary with state law, contracts, employer coverage, and the facts.

What should I not say when I get fired?

You do not need to settle every disagreement in the termination meeting. Keep your response brief and professional, ask for the reason and paperwork, and take time to review disputed details. These are practical communication tips, not a legal formula.

  1. Don’t lash out, threaten, or insult anyone

    Anger is understandable, but an argument can distract from the information you need. Ask who will provide the written reason for the termination, when you will receive separation documents, and how to return any employer property.

  2. Don’t guess, lie, or make a rushed admission

    If someone asks about an event you remember differently, answer truthfully and distinguish what you know from what you need to check. You can ask to see a relevant document or say you need time to review your records before responding. Don’t conceal facts or speculate just to end the conversation.

  3. Don’t post accusations or confidential details publicly while upset

    Pause before posting about the employer, colleagues, or the reason you were fired. Keep your account factual and private while you review the paperwork or seek advice. This is prudent judgment, not a claim that every public statement is legally prohibited.

  4. Don’t misrepresent the separation in future applications or interviews

    Give a short, truthful explanation if asked, then turn to your relevant experience and what you are looking for next. You do not need to offer a long account or make claims about the former employer that you cannot support.

What should I do after being fired?

Start with the documents, pay, and benefits that affect your immediate finances. Keep your own employment records and a dated, factual timeline of important events, but do not take or copy company files indiscriminately. Whether a particular record may be retained can depend on law, workplace policy, and the facts; ask a qualified lawyer if you are unsure.

  1. Don’t sign a severance or release on the spot

    Read the full agreement and understand what you would receive, what claims or rights it addresses, and every deadline before deciding. The EEOC’s severance agreement Q&A advises workers to check the deadline and consider having an attorney review the agreement. Compare its payment and benefits, released claims, reference and confidentiality terms, and property-return requirements; whether an offer is fair depends on its actual terms.

  2. Don’t assume severance is automatically owed

    Under the federal Fair Labor Standards Act, severance pay is generally a matter of agreement, not a required payment. That does not resolve what a contract, benefit plan, or applicable state law may require in a particular case. Check the documents that apply to your employment. See the U.S. Department of Labor’s severance pay overview.

  3. Don’t assume your final paycheck is due immediately everywhere

    Federal law does not require an immediate final paycheck, while some states require faster payment. If your regular payday passes and you have not been paid, contact the Department of Labor’s Wage and Hour Division or your state labor department. The federal overview is Last Paycheck.

  4. Don’t overlook unemployment and health coverage follow-up

    Unemployment benefits are administered by states. A person unemployed through no fault of their own may qualify if they meet the state’s other rules; the state decides individual eligibility. Apply or check your state agency’s instructions, and answer claim questions accurately. The federal overview is the Department of Labor’s Termination page.

    If you and your health plan qualify, COBRA may let you and eligible family members temporarily continue group coverage, usually by paying the full premium. The Department of Labor says the election window is 60 days from the later of the date job-based coverage ends or the date you receive the election notice. Read your plan’s notice carefully. What if the firing may involve discrimination or retaliation?

Do not assume that an unfair or upsetting termination by itself proves a legal violation. But certain worker complaints and opposition to discrimination, as well as participation in some investigations or proceedings, may be protected activity. Coverage depends on the law and facts.

  1. Don’t ignore a possible discrimination or retaliation connection

    Write down dates, statements, witnesses, and documents while events are fresh. Preserve records you are entitled to keep, and avoid altering or removing employer materials. Consider contacting the relevant agency or an employment lawyer to assess whether the law applies. The Department of Labor describes protections for covered worker activity in its retaliation overview; the EEOC explains protected activity related to discrimination in its retaliation guidance.

Should I sign a severance agreement?

Only after you have read and understood the terms and deadlines and decided what they mean for you. A signature can involve a trade: the agreement may offer pay or benefits in exchange for releasing claims or accepting other terms. Don’t treat an employer’s deadline as a reason to skip review; the EEOC recommends considering attorney review. The relevant question is not whether severance agreements are always good or bad, but what this agreement offers and what it asks you to give up.

How to handle the termination meeting

  1. Ask for the stated reason for termination and when you will receive it in writing.
  2. Ask what documents you should expect, including any separation or benefits notices, and note their deadlines.
  3. Clarify final pay, accrued benefits, and the process for returning company property.
  4. If asked to sign, request a copy and time to review it. Do not sign a release you do not understand.
  5. After the meeting, record a factual timeline and follow up on state unemployment, final pay, and health coverage.
