Nando’s Australia Pty Ltd was fined $160,000 after food-safety offences at its Willetton restaurant on 6 and 8 September 2023. The Department of Health’s conviction notice records the conviction on 29 May 2024 and lists four failures under the Australia New Zealand Food Standards Code. The City of Canning said the restaurant was closed after an inspection found rodent evidence in food-preparation and storage areas; it reopened after addressing the identified issues.
What happened at Nando’s Willetton?
The official conviction notice names the business as Nandos, Willetton, and the convicted company as Nandos Australia Pty Ltd. It gives the premises address as Shop 3/41 Burrendah Blvd, Willetton WA 6155. The offences occurred on 6 and 8 September 2023; the conviction date was 29 May 2024. The notice records a $160,000 penalty and $2,745 in costs. The costs are separate from the penalty: the formal record does not describe the combined amount as a fine. It also does not explain how the court arrived at the penalty or allocate it among individual offences.
What food-safety failures did the official notice list?
The notice cites section 22(1) of Western Australia’s Food Act 2008, which concerns compliance with the Australia New Zealand Food Standards Code, and non-compliance with Standard 3.2.2. It itemises four failures:

- Failing to provide suitable means for drying hands.
- Failing to keep the premises clear of accumulated food waste, dirt and grease.
Contemporaneous media reports describe the case as involving 10 violations or breaches and mention additional findings, including pest-control failures, food past its use-by date, contaminated food-contact surfaces, and cleanliness and repair concerns. Those are details reported by 7NEWS, not a count-by-count account in the Department’s notice. The notice’s four listed clause failures cannot be mapped from the available record to the 10 violations cited in media coverage.
Why did the City say it pursued legal action?
PerthNow reported that City of Canning Mayor Patrick Hall said a routine inspection found a rodent infestation and evidence of rodents and rat droppings throughout food-preparation and storage areas. Hall described the condition as a very serious public-health risk. He also said: “The seriousness of the food safety risks were such that legal action was warranted and in the public interest.” (PerthNow, 6 June 2024)

This is the City’s stated rationale, as reported by PerthNow. It should not be mistaken for a published explanation from the court of how it set the $160,000 penalty.
What happened after the inspection?
According to Hall’s account in PerthNow, the City directed the restaurant to close. The business closed, addressed cleanliness, maintenance, rodent and related food-safety matters, and was inspected again by Environmental Health officers before reopening. 7NEWS reported that the City issued a prohibition order requiring closure until food-safety risks were resolved.

How can someone report a food-safety concern in Canning?
The City of Canning says its Environmental Health officers investigate concerns such as pests on food premises, unclean premises, food poisoning, allergens or foreign objects, and incorrect or incomplete labelling. It conducts unannounced inspections and also relies on reports from the community. Use the City’s food complaints page to raise a current concern; the City’s guidance asks food-poisoning complainants for details including when and where they ate, symptoms and when they began, and the suspected food and other foods consumed.
