In 2023, data center tax incentives were state-specific, not a uniform national tax break. The official examples below show different approaches: exemptions tied to investment, jobs, electricity demand, connected projects, or an extension agreement. They are selected examples, not a complete inventory of state legislation enacted that year.
How the 2023 state examples compare
These programs concern data center operators and large projects, not tax deductions that individual households can claim. The table summarizes the thresholds and rules described in the cited state records; the cited reports and legislative materials are not interchangeable with a nationwide count of laws.

What the differences mean for operators and taxpayers
Eligibility is more than a dollar threshold
A project’s location, structure, timing, electricity demand, employment commitments and certification status can matter as much as its headline investment. Florida combines capital investment with critical IT load; Kansas links investment to job creation and maintenance; Connecticut scales the exemption term to qualified spending; Virginia’s extension process uses an MOU to define how investment and jobs will be measured; and Texas addresses qualifying property across connected project sites.
Covered costs vary
The programs do not exempt the same things. Kansas expressly includes electricity and certain labor services, while Texas lists a broad range of tangible property and project infrastructure. Florida’s statute is framed around qualifying data-center property and critical IT load, rather than the detailed connected-project property list in Texas. A label such as “data center tax incentive” therefore does not tell an operator which purchases or taxes qualify.

Accountability mechanisms differ
Virginia’s report sets out categories for evaluating fiscal effects and return on investment; those categories alone do not prove a particular net benefit. Florida specifies compliance reviews and possible recovery of taxes, interest and penalties when conditions are not met. Connecticut’s report, by contrast, says its direct-impact estimate awaited reported program activity and issued exemptions.

The state materials demonstrate several distinct policy designs, but they do not establish a complete list of all state bills enacted in 2023. Some records describe laws or legislative changes from that year; others describe program rules then in force or FY2023 program activity. A proposal, a bill analysis, an enacted statute and an annual program report answer different questions and should not be treated as equivalent evidence.

The Connecticut figure for Cigna is one applicant’s projected minimum investment, not the state’s total incentive value or a national investment estimate. The reviewed official materials also do not establish a comparable national total for tax benefits or state enactments; unlike program figures should not be added together to create one.
For households, these incentives are not a direct personal tax benefit. Their possible effects on public revenue or local economies depend on program results, and the cited Virginia and Connecticut materials illustrate why projected investment, evaluation categories and measured outcomes must be kept distinct.
