What is the EU investigating Temu for?
The European Commission opened formal proceedings under the Digital Services Act (DSA) on 31 October 2024. The DSA sets obligations for large online platforms, including requirements related to systemic risks. The Commission said it would examine four areas of Temu’s compliance; the opening announcement described questions to investigate, not established breaches. Illegal and non-compliant products
The Commission examined how Temu identifies and limits illegal or non-compliant product listings, including whether suspended traders or previously removed goods could reappear on the marketplace.
Potentially addictive design
The inquiry included game-like reward features and the measures Temu uses to mitigate possible effects on users’ physical and mental well-being. This was an investigative concern—not a finding that Temu’s design is addictive.

Product recommendations
The Commission examined whether Temu explains the main parameters behind its recommendations and gives users at least one easily accessible option for recommendations that is not based on profiling.
Researcher access to public data
The fourth strand concerned whether Temu meets DSA duties to provide researchers with access to publicly accessible data.

Did the EU fine Temu?
Yes. On 28 May 2026, the Commission issued Temu a €200 million fine under the DSA. The Commission’s enforcement chronology records the fine as a non-compliance decision closing its preliminary findings on illegal products. The Commission’s fine announcement and its DSA enforcement chronology describe the decision.
The decision concerned Temu’s assessment of systemic risks connected with illegal products and resulting consumer harm. The Commission said Temu’s 2024 risk assessment relied on general e-commerce industry information rather than platform-specific evidence and seriously underestimated the likelihood that consumers would encounter illegal items. It also said the assessment did not properly account for how platform design, recommendations and influencer promotions could amplify those risks. These are the Commission’s conclusions about Temu’s risk assessment; they are not proof that every item listed or every transaction on Temu involved an illegal product.

What did the Commission find about products on Temu?
In a preliminary finding dated 28 July 2025, the Commission said its mystery-shopping analysis showed a high risk that EU consumers would encounter non-compliant products on Temu. It named baby toys and small electronics as examples. The Commission described this as a preliminary finding at that stage, not a determination that all products in those categories—or all Temu listings—were non-compliant. The later €200 million decision addressed Temu’s diligence in identifying, analysing and assessing systemic risks. It should not be confused with a blanket product recall or a finding that every purchase from the marketplace was unsafe.

Is Temu still being investigated for addictive design?
Potentially addictive design was one of the four areas named when proceedings opened in 2024. The Commission cited game-like reward programmes and possible effects on physical and mental well-being as matters to examine. The material cited here does not establish a final finding or other definitive outcome for that strand. The 2026 fine closed the preliminary findings concerning illegal products; it should not be presented as a resolution of all the 2024 concerns.
The same qualification applies to recommendation transparency and researcher access to public data: both were part of the original proceedings, but the cited official material does not establish their final disposition. It also does not support saying that these strands remain actively under investigation today.

Why was Temu subject to the DSA’s largest-platform rules?
The Commission designated Temu a Very Large Online Platform (VLOP) in May 2024. In its designation announcement, the Commission reported that Temu had more than 45 million average monthly users in the EU—above the DSA threshold for VLOP designation. See the Commission’s designation announcement.
The Commission’s later enforcement chronology records a figure of 75 million average monthly active users for Temu in its VLOP listing. That is the figure recorded on that chronology, not a fresh user count for 2026; it is distinct from the more-than-45-million figure reported in May 2024.
