Do Kwon’s U.S. Fraud Case: Guilty Plea, 15-Year Sentence and What Happened

Do Kwon pleaded guilty to two U.S. fraud counts and was sentenced to 15 years in prison. The SEC’s separate civil case resulted in a jury finding of liability.

Do Kwon’s U.S. criminal case has ended in a guilty plea and a 15-year prison sentence. On December 11, 2025, a federal judge sentenced the Terraform Labs co-founder to 15 years’ imprisonment and ordered him to forfeit more than $19 million, according to the U.S. Department of Justice (DOJ). His criminal case is separate from a civil Securities and Exchange Commission (SEC) case that resulted in a jury finding Terraform Labs and Kwon liable in April 2024.

Did Do Kwon face fraud charges in the United States?

Yes. Kwon was initially charged in the U.S. District Court for the Southern District of New York on March 23, 2023, the day DOJ says he was arrested in Europe while traveling on a false passport. He was extradited from Montenegro to the United States on December 31, 2024, and made his initial appearance in Manhattan, according to the DOJ case announcement.

The initial indictment contained broader charges and allegations. Those should not be confused with the offenses Kwon ultimately admitted: the guilty plea and sentence are the final outcome of the criminal case described here.

Did Do Kwon plead guilty, and what did he admit?

On August 12, 2025, Kwon pleaded guilty to two counts: conspiracy to commit commodities fraud, securities fraud, and wire fraud; and wire fraud. DOJ said those counts carried a combined statutory maximum of 25 years at the time of the plea. That figure was the maximum possible under the counts, not the sentence imposed. U.S. Attorney Jay Clayton characterized the case in that announcement, saying, “Do Kwon used the technological promise and investment euphoria around cryptocurrency to commit one of the largest frauds in history.” That is Clayton’s assessment, not a separate judicial finding.

How long was Do Kwon sentenced to?

On December 11, 2025, Judge Paul A. Engelmayer sentenced Kwon to 15 years’ imprisonment and ordered forfeiture of more than $19 million. DOJ describes the offenses in its sentencing announcement as wire fraud and conspiracy to commit securities fraud, commodities fraud, and wire fraud. See the DOJ sentencing release.

DOJ also reported that the collapse of UST and LUNA caused more than $40 billion in investor losses. That is the government’s reported figure; the cited announcement does not establish it as an independently audited, universal measure of losses.

How is the SEC case different from the criminal case?

The SEC’s civil enforcement action against Terraform Labs and Kwon was a separate proceeding from the DOJ prosecution. The SEC filed its case in February 2023. In its April 2023 description of the complaint, the agency alleged that Terraform and Kwon marketed and sold crypto asset securities including UST, LUNA, MIR tokens, and mAssets. The SEC said UST was promoted as a yield-bearing stablecoin advertised as paying as much as 20 percent interest through Anchor Protocol; that describes what the agency alleged was advertised, not a verified return. In April 2024, a civil jury found Terraform Labs and Kwon liable for defrauding investors in crypto asset securities. The SEC also reported that the court had previously found unlawful offers and sales of crypto asset securities in violation of registration provisions. This civil verdict is distinct from Kwon’s later criminal guilty plea and sentence. The SEC’s verdict announcement quotes then-Enforcement Director Gurbir S. Grewal: “We are pleased with today’s jury verdict holding Terraform Labs and Do Kwon liable for a massive crypto fraud.” That is Grewal’s characterization of the verdict.

Can affected investors get money back?

DOJ says potential federal remission may depend on property being finally forfeited, seized, and monetized. Remission is not guaranteed, and it is separate from Terraform’s bankruptcy process. DOJ directs potential victims to its Victim/Witness Unit for case updates and points to the Terraform wind-down trust for bankruptcy information. Its case page provides the relevant contacts and links. The forfeiture order itself does not mean victims have already received payments.
