On 27 February 2024, the Supreme Court of India temporarily restrained Patanjali Ayurved from advertising or branding products it manufactured and marketed for curing diseases, disorders or conditions covered by the Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954 and its 1955 Rules. The Court also issued notice asking why contempt proceedings should not be initiated against the company and its managing director. The contempt case later closed: on 13 August 2024, the Court accepted unqualified apologies, cautioned the parties to honor their undertakings and discharged the notices. This was not a ban on every Patanjali product or every form of advertising, nor a ruling on whether a particular product works.
Why did the Supreme Court restrain Patanjali from advertising medicinal products?
The restraint arose in the context of an ongoing petition brought by the Indian Medical Association. In November 2023, Patanjali’s counsel assured the Court that the company would comply with laws on advertising and branding and would not issue casual statements claiming medicinal efficacy or attacking a system of medicine. The Supreme Court later recorded that Patanjali was bound by that assurance.
The Court’s later account referred to a press conference by Baba Ramdev and Acharya Balkrishna on 22 November 2023, followed by newspaper advertisements dated 4 December 2023. In the February proceedings, these events were treated in connection with alleged breaches of the undertaking. They should not be confused with a finding about the efficacy of any product.
What did the February 2024 order actually restrict?
The order of 27 February 2024 applied to advertising or branding products manufactured and marketed by Patanjali that were meant to cure diseases, disorders or conditions specified in the 1954 Act and the associated 1955 Rules. It was a temporary restraint “until further orders,” not a blanket prohibition on all of the company’s products or advertising.

The order also issued notice asking why contempt proceedings should not be initiated against Patanjali Ayurved and its managing director. A contempt notice is a procedural step asking a party to respond; it is not itself a final finding of contempt.

Did the Supreme Court later close the Patanjali contempt case?
Yes. On 13 August 2024, the Supreme Court accepted the unqualified apologies subsequently tendered, cautioned the parties to abide by their undertakings, discharged the contempt notices and closed the contempt proceedings. That disposition closed the contempt matter; it should not be described as a final judgment establishing whether every challenged advertisement or product was lawful.

The Court’s judgment reproduced the undertaking given on 21 November 2023: “henceforth there shall not be any violation of any law(s), especially relating to advertising or branding of products manufactured and marketed by it and, further, that no casual statements claiming medicinal efficacy or against any system of medicine will be released to the media in any form.” This is the earlier assurance as recorded by the Court, not a new statement made in the February 2024 order.

What does the later 2025 order establish?
A separate order dated 11 August 2025 in the broader writ proceedings records a request that authorities act on alleged prohibited claims in advertisements. It establishes that there was a later step in the wider matter, but by itself does not establish the petition’s subsequent docket status as of 8 October 2026. The contempt case’s closure in August 2024 and activity in the underlying writ petition are distinct procedural developments.
