The GST Council’s December 2024 clarification did not introduce a new popcorn tax. It explained how the then-applicable schedule treated ready-to-eat popcorn based on its classification: salted or spiced popcorn was treated as namkeen, while popcorn mixed with sugar, such as caramel popcorn, was treated as sugar confectionery. The rates below describe that 2024 clarification, not a verified current rate schedule.
What the GST Council clarified in December 2024
At its 55th meeting on 21 December 2024, the GST Council recommended clarifying the classification and rates for certain ready-to-eat popcorn products. The government said the clarification addressed inconsistent interpretations and did not impose a new tax. The Ministry of Finance’s account of the meeting sets out the categories and rates under the schedule then in force.

The 5% and 12% distinction applied to the salted-or-spiced namkeen category and turned on whether it was supplied pre-packaged and labelled. The 18% category was different: the clarification treated sugar-mixed popcorn as sugar confectionery. Packaging alone does not explain the difference between salted and caramel popcorn.
Why caramel popcorn was treated differently
The Council’s explanation turned on the product’s classification, not simply on whether a packet was sealed. Salted or spiced ready-to-eat popcorn fell under the namkeen entry, while adding sugar placed popcorn such as caramel popcorn under the sugar-confectionery entry. That is why the 2024 clarification listed a different rate for sugar-mixed popcorn.

Did the clarification create a new tax?
No. The government described the move as a clarification intended to settle disputes over how the existing schedule applied, rather than a newly imposed tax. The accompanying circular also addressed past-period treatment: because of genuine doubts, it regularized the period up to 14 February 2025 on an “as is where is” basis. The circular text records that treatment.

Do not assume that the 5%, 12% and 18% figures above are the rates that apply today. The 56th GST Council meeting recommended further goods-rate changes in September 2025. Notification No. 9/2025-Central Tax (Rate), dated 17 September 2025, superseded the earlier goods-rate notification, and the revised rates took effect on 22 September 2025. The Ministry of Finance’s materials on the 56th meeting and rate changes establish that revision, but do not by themselves establish the current rate for every popcorn formulation.

For a purchase or a business tax decision now, check the operative rate notification and the relevant tariff entry for the exact product and packaging presentation. A business making a compliance decision should confirm the classification and rate with a qualified tax adviser rather than carry forward the 2024 figures.
