The FTC’s June 2023 lawsuit alleged that Amazon used “dark patterns” to enroll people in automatically renewing Prime subscriptions without informed consent and made cancellation difficult. The case is no longer an unresolved lawsuit: Amazon and the FTC agreed to a settlement announced in September 2025, including a $1 billion civil penalty, $1.5 billion in consumer redress, and required changes to Prime enrollment and cancellation. Some eligible U.S. customers may receive an automatic refund.
What the FTC alleged in its 2023 lawsuit
In June 2023, the Federal Trade Commission sued Amazon in the U.S. District Court for the Western District of Washington (case 2:23-cv-0932). The agency alleged that Amazon used interface designs it called “dark patterns” to steer customers into Prime subscriptions that renew automatically, without informed consent, and made it difficult to cancel. These were allegations in the complaint, not findings established by a full trial.
The FTC said some purchase flows made the option to buy without Prime harder to find, or used a transaction button that did not clearly disclose the recurring subscription. It also alleged that customers trying to cancel encountered a multi-page sequence with offers and other steps before reaching the final cancellation action. The agency brought claims under Section 5 of the FTC Act and the Restore Online Shoppers’ Confidence Act (ROSCA). The FTC’s account of the complaint is at its June 2023 announcement.
Then-FTC Chair Lina M. Khan characterized the allegations this way: “Amazon tricked and trapped people into recurring subscriptions without their consent, not only frustrating users but also costing them significant money.” That was the chair’s description of the agency’s case, not a court finding.

How the case was resolved
On September 25, 2025, the FTC announced a stipulated settlement order with Amazon and two senior executives named in the announcement, Neil Lindsay and Jamil Ghani. The agency described the agreement as a $2.5 billion settlement: a $1 billion civil penalty and $1.5 billion for consumer redress. The FTC said the redress was intended to provide full relief for an estimated 35 million consumers affected by unwanted enrollment or deferred cancellation. That estimate is not a count of people who will necessarily receive a refund.
The FTC characterized the $1 billion penalty as the largest ever in a case involving an FTC rule violation. The settlement announcement quotes FTC Chairman Andrew N. Ferguson calling it “a record-breaking, monumental win” for consumers. These are the agency’s descriptions of the settlement. The resolution was a stipulated order, not a full trial verdict on every allegation. The FTC notes that stipulated final orders have force of law when approved and signed by the district court judge; its case page records the entered order dated September 25, 2025. Changes required under the order
The order requires Amazon to cease unlawful Prime enrollment and cancellation practices. The FTC says the required changes include a clear way to decline Prime, clear disclosure of material subscription terms such as price and renewal, and a cancellation method that is easy to use and available through the same method used to sign up. The order establishes requirements; the FTC materials do not provide a neutral assessment of how effective any changes have been in practice.
Who may qualify for an Amazon Prime FTC refund?
The FTC’s current refund guidance sets out several conditions. A customer must be in the United States, have used one of the challenged enrollment flows or tried and failed to cancel online during the specified period, and have used no more than 20 Prime benefits in any 12-month period after enrollment.

- Enrollment or cancellation history: You must have signed up through a challenged flow or tried and failed to cancel online between June 23, 2019, and June 23, 2025.
- Prime benefit use: You must have used no more than 20 Prime benefits in any 12-month period after enrollment.
The FTC identifies the challenged enrollment flows as the universal Prime decision page, shipping selection page, single-page checkout, and Prime Video enrollment flow. Meeting these general conditions does not guarantee a particular person’s eligibility or refund amount; check the FTC’s current refund page for details and the settlement administrator’s information.
Do you need to file a claim?
No. The FTC says eligible customers do not need to submit a claim or form. Payments are made automatically by mailed check, PayPal, or Venmo, and a payment expires 60 days after it is issued. The agency says eligible customers will receive refunds by April 2027.

The refund is for Prime subscription fees and is capped at $200 total per eligible customer. Earlier payments were capped at $51; under the revised order, additional payments may bring an eligible customer’s total to $200. The FTC reported that more than $845 million had been distributed to eligible Prime customers as of the date stated on its refund page. Neither that distribution total nor the maximum cap means every eligible person will receive $200.

The FTC says it is not contacting people about refunds and will never ask for payment to obtain one. Treat an unsolicited message, call, or offer demanding a fee to release a Prime settlement refund as a scam. For eligibility details and updates, go directly to the FTC’s official refund guidance rather than following a payment link in an unexpected message.
