UPSIDE Foods and GOOD Meat were the first companies to complete the federal steps for cultivated chicken and make U.S. restaurant sales in 2023. But that milestone does not establish that both companies sell it today. As of February 2026, the FDA listed three chicken companies with completed consultations—Believer Meats, UPSIDE Foods, and GOOD Meat—yet an FDA consultation is not approval to sell. USDA inspection, product and label requirements are separate, and current consumer availability is not established by the cited government sources.
What “lab-grown chicken” means
Here, “lab-grown,” “cultivated,” and “cultured” chicken mean food made by growing chicken cells in a controlled process, such as in a bioreactor, then harvesting them for food. It is not plant-based meat. The USDA describes this as cell-cultured meat and poultry production. The two original FDA consultation records describe different forms of chicken material: UPSIDE’s record covers muscle and connective-tissue cells in sheets, while GOOD Meat’s describes cultured chicken cells in biomass form.
What the current federal record does—and does not—show
The FDA’s inventory, updated in February 2026, lists completed consultations for cultured chicken from Believer Meats, UPSIDE Foods, and GOOD Meat. It also lists consultations for pork-fat cells from Mission Barns and salmon cells from Wildtype. Those five entries count completed FDA consultations; they are not a list of companies authorized by USDA to sell products.
The established U.S. restaurant-sales milestone belongs to UPSIDE and GOOD Meat: both made initial sales in July 2023, in San Francisco and Washington, D.C., respectively, according to the Congressional Research Service. The cited sources do not establish their current restaurant listings or grocery availability. A March 2026 Eleventh Circuit opinion says UPSIDE had received a USDA grant of inspection and could sell its chicken in interstate commerce; the cited sources do not verify GOOD Meat’s present operating or market status. The FDA inventory entry for Believer does not establish that the company has USDA inspection authorization.

FDA consultation and USDA inspection are separate steps

FDA described UPSIDE’s consultation response on November 16, 2022, as meaning that after evaluating the information the firm shared, it had “no further questions at this time about the firm’s safety conclusion.” That response was not a general FDA authorization to sell. According to the Congressional Research Service, USDA-FSIS issued the original grants of inspection to UPSIDE and GOOD Meat in June 2023 and approved the label term “cell-cultivated chicken.”
How the milestone developed
- November 16, 2022: FDA completed UPSIDE Foods’ premarket consultation and said it had no further questions at that time about the company’s safety conclusion.
- March 20, 2023: The FDA inventory records its response for GOOD Meat’s consultation. The record also displays a later response letter dated June 9, 2023.
- June 2023: USDA-FSIS issued the original grants of inspection to UPSIDE and GOOD Meat and approved the label term “cell-cultivated chicken,” according to the Congressional Research Service.
- July 2023: UPSIDE and GOOD Meat made their initial U.S. restaurant sales in San Francisco and Washington, D.C., respectively, according to the Congressional Research Service.
- July 24, 2025: The FDA inventory records a completed consultation response for Believer Meats’ cultured chicken cell material.
- February 2026: The FDA inventory lists five completed consultations overall, including the three chicken sponsors.
- March 23, 2026: The Eleventh Circuit said UPSIDE had received a USDA grant of inspection and could sell its chicken in interstate commerce, while affirming that federal law did not preempt Florida SB 1084 as applied in the case.
Does federal inspection mean cultivated chicken can be sold in every state?
No. Federal inspection status and state market access are separate questions. In March 2026, the Eleventh Circuit affirmed that federal law did not preempt Florida SB 1084 in UPSIDE’s challenge. The same opinion said UPSIDE had a USDA grant of inspection and could sell its chicken in interstate commerce. That ruling should not be read as proof that every state has the same rule or that an FDA consultation alone establishes permission to sell.

Where can you buy cultivated chicken?
The cited government and congressional sources establish initial restaurant sales in 2023, not a current directory of restaurants, grocery stores, online retailers, prices, or production volumes. They therefore do not establish that cultivated chicken is currently available near you or in U.S. grocery stores. Check directly with a restaurant or retailer for current listings rather than treating an FDA consultation record as a sales listing.
