Google’s $2.3 Million Check Avoided a Jury Trial in the DOJ Ad-Tech Case—but the Case Continued

Google’s $2.3 million check filing addressed the damages claim and led to a bench trial, but did not settle the DOJ’s ad-tech antitrust case.

Google’s reported $2.3 million cashier’s-check filing changed how the U.S. Department of Justice’s ad-tech antitrust case would be tried: Judge Leonie Brinkema was to decide it without a jury. It did not end the lawsuit, establish that Google violated the law, or resolve the government’s demand for changes to Google’s advertising business.

What Google’s $2.3 million filing did

In June 2024, Google filed a copy of a $2.3 million cashier’s check in the Eastern District of Virginia. The reported purpose was to cover as much as three times the government’s monetary-damages request, plus interest. That is different from saying the court awarded the government $2.3 million or that the DOJ received and deposited that amount. Contemporaneous reporting described the filing as a step to cover the damages claim.

The amount was not simply the damages figure the government sought. According to secondary coverage, the DOJ initially sought more than $100 million and later reduced its request to less than $1 million; the $2.3 million figure was reported in the context of treble damages and interest. Those figures concern the damages claim, not the broader relief the government pursued. Android Headlines reported that chronology.

Why the check changed the trial format

The government had included a monetary-damages claim and demanded a jury. Google’s filing was intended to remove that damages issue from the case. Judge Brinkema then ruled that the remaining case would proceed as a bench trial: the judge, rather than a jury, would hear the evidence and decide the issues.

The Seventh Amendment protects the right to a jury in certain civil cases, but this episode does not establish a general rule that a defendant can avoid a jury simply by tendering money. The ruling concerned this case’s damages claim and the way Google addressed it. The legal significance was procedural: the jury phase was avoided before the merits trial, not ended after a jury had heard the case. The Associated Press also described the dispute as one over a judge rather than a jury.

What allegations remained

The DOJ and eight states alleged that Google unlawfully maintained a monopoly in technology used to buy, sell, and serve online advertising. The lawsuit sought more than monetary damages: the government also pursued structural relief that could require changes to Google’s ad-tech business. The court still had to decide whether Google violated antitrust law and, if so, what remedy was appropriate.

The check addressed the damages issue that supported the jury demand; it did not decide liability or settle the question of remedies. Google had not been found liable merely because it filed the check.

Google’s position

Google said the payment did not admit liability or wrongdoing. Contemporaneous coverage reported that the company called the damages issue “contrived” and characterized the case as a meritless effort to pick winners and losers in a competitive industry. Those were Google’s arguments, not findings by the court. The company’s position was reported in coverage of the filing.

What was scheduled to happen next

At the time of the June 2024 reports, a bench trial before Judge Brinkema was scheduled for September 9, 2024. That date was a schedule, not proof that the trial took place as planned or a statement of the case’s present status. The contemporaneous articles linked here do not establish the later procedural history, merits ruling, or any remedy proceedings.

What the filing did not mean

  • It was not a finding of liability. The antitrust allegations remained to be decided.
  • It was not shown to be a full settlement. The reported filing addressed the damages issue, while the government’s central claims and requested relief continued.
  • It did not establish that the DOJ received $2.3 million in damages. The reporting describes a check copy filed in court to cover potential damages exposure.
  • It did not resolve Google’s other antitrust disputes. This was the DOJ’s ad-tech case, distinct from the DOJ’s search-distribution case, Epic Games’ Google Play litigation, and state or international proceedings.
