The 57th GST Council is reportedly weighing changes to GST arrests, prosecution thresholds, seller registration, export rules and refunds. The agenda and meeting date remain unconfirmed.

The 57th GST Council meeting is expected to consider changes to GST enforcement, small-seller registration, export rules and state revenue protection. These remain reported proposals, not decisions: the meeting had not concluded as of October 7, 2026, and published reports disagree on whether it is scheduled for October 7 or October 8.

What is known about the 57th GST Council meeting date?

Press reports say the meeting was initially scheduled for September 12, then moved to October. Some reports identify October 7, 2026, while others say October 8. The date is therefore not settled by the available reporting. The Council, chaired by Union Finance Minister Nirmala Sitharaman, does not publish its agenda in advance; the proposals below should be treated as reported possibilities until an official outcome is issued.

Could GST arrest powers be removed?

Reports say the Council may consider removing the power of arrest from the GST statute, with tax recovery, interest and proportionate penalties used instead of arrest for tax violations. The precise design is uncertain: some coverage describes removing arrest power entirely, while another possibility reported is requiring judicial authorisation. No final decision has been confirmed.

A Finance Ministry official was reported as saying safeguards built into the law in 2017 could now be relaxed because the system is better at detecting irregularities. This was a paraphrase in press coverage, not a published Council decision or a verbatim quotation.

Is the GST prosecution threshold set to rise to ₹5 crore?

The reported proposal is to raise the prosecution threshold from ₹1 crore to ₹5 crore. The existing and proposed figures describe the threshold under discussion, not a change already in force. A higher threshold would narrow the cases eligible for prosecution on that basis; the reported approach to enforcement would also rely more on civil recovery measures. Neither proposal has been confirmed.

What could change for small e-commerce sellers?

BusinessToday reported that small sellers using e-commerce platforms may be allowed to use a platform warehouse in another state as their place of business after one-time verification in their home state. The aim would be to reduce the need to complete separate registration steps in every state where platform stock is stored. The report also said registration on major platforms may be substantially simplified, potentially with greater use of AI.

This e-commerce proposal has been reported by BusinessToday alone among the results reviewed, so its scope and mechanics are especially uncertain. Sellers should not change registrations or warehouse arrangements on the basis of the proposal; they would need to wait for official rules and guidance.

Which export rules may be revised?

Reported proposals would broaden the treatment of supplies involving overseas customers and Indian operations. The Council is expected to reassess export definitions with a view to aligning them more closely with forex-earning activity. The reported cases include:

  • Supplies billed through an exporter’s own overseas branch.
  • Job work performed in India on goods belonging to a foreign client.
  • Goods sold to an overseas buyer but delivered to a Special Economic Zone (SEZ) on that buyer’s instructions.

Reports also say the Council may provide retrospective relief from a restriction on refunds for exporters that used duty concessions on inputs. Separately, changes to export-of-services rules for IT firms and Global Capability Centres (GCCs) are expected to reduce compliance friction and speed refunds. These are proposals; the available reporting does not establish final definitions, eligibility conditions or effective dates.

What do the reported refund and compliance proposals mean?

BusinessToday’s October 6 headline referred to “17 day refunds,” alongside simpler registrations and easier input tax credit (ITC). That is a headline-level claim about an expected reform; the available reporting does not establish the process, eligible taxpayers, start date or whether 17 days would be a binding service standard. Treat it as a reported proposal rather than a guaranteed refund timeline.

Other reported agenda items include automated registration cancellation, multi-state ITC transfer, review of blocked ITC under Section 17(5), refunds for inverted duty structures, and a proposal to protect compliant buyers when a supplier fails to deposit tax. A late-fee waiver for small taxpayers and a rate revision for molasses have also been reported. Rate rationalisation is not described as the meeting’s main focus; coverage characterises the agenda as chiefly procedural.

How might the changes affect state revenues?

The reform package is being framed as an effort to provide compliance and enforcement relief while safeguarding, and potentially increasing, state revenues. The Council reportedly has a post-“GST 2.0” review of state revenue on its agenda. The balancing act is central: easier procedures and broader export treatment may benefit businesses, while states rely on GST collections and will assess the effects on revenue. No official revenue estimate or confirmed state-level impact was available in the reports.

When would any proposal become law?

A Council discussion or recommendation does not by itself establish that a proposal is in force. Implementation would depend on the legal route and official follow-up: some changes may require a CBIC notification, while amendments to provisions in the CGST Act may require an Act amendment. The relevant post-meeting press release and later legal instruments—not advance reporting—will determine what is adopted, who qualifies and when it applies.
