Talk about your intentions before a crisis, choose a capable and willing executor or trustee, make the documents consistent, revisit the plan after major life changes, and bring in qualified help when family or tax issues are complicated. U.S. estate and probate rules vary by state, so consult a qualified local professional about your circumstances.
1. Talk about your intentions before a crisis
A conversation can help relatives understand what you intend and why, rather than encountering an unexpected decision only after your death. The American Bar Association notes that discussing how assets are meant to be handled can reduce surprise and misunderstanding. You decide what to share and with whom; disclosure is not a legal requirement, and a conversation cannot ensure that everyone will agree.
Keep the discussion focused on the plan and the process. Explain your reasoning where you are comfortable doing so, give relatives room to ask questions, and avoid presenting a preliminary conversation as a substitute for legally effective documents. If the conversation becomes too difficult to manage, professional support may help (see step 5).
2. Choose an executor or trustee for the work involved
Do not assume that the oldest child—or any particular relative—is automatically the best choice. Consider whether a candidate is willing to serve, reliable, financially capable, impartial, available, and able to communicate with beneficiaries. The needs of the estate matter: a person who is a good fit for a straightforward estate may not be suited to complex assets or difficult family dynamics.

Understand the responsibilities
An executor, also called a personal representative in some contexts, generally handles administrative work such as gathering estate assets, paying debts, distributing property, and making required filings. The Internal Revenue Service outlines these responsibilities in its guide for estate administrators and Publication 559. Depending on the estate, an administrator may need to account for assets and debts, obtain an estate EIN, and file applicable returns. The IRS says an estate income-tax return is required when estate assets generate more than $600 in annual income. Personal representatives may also face responsibility for certain tax obligations in some circumstances.
Discuss willingness and alternatives
Ask the person before naming them, explain the responsibilities, and discuss whether they have the time and ability to take them on. A non-family or corporate fiduciary may be worth considering when impartiality, expertise, or family relationships make a relative a poor fit. Compensation and the rules governing fiduciaries vary by state, so get local advice before deciding.

3. Make the plan clear and consistent
Ambiguity about who inherits can fuel disagreement. Ask an estate-planning professional to check that your will, trust provisions, and related beneficiary designations reflect the same intended recipients and allocations. A plan’s appropriate documents and legal effect depend on state law and the assets involved; a conversation or an informal list does not necessarily change who is legally entitled to property.
Keep an organized record of relevant financial and estate documents so the people who need to administer your affairs can locate them. The National Institute on Aging’s checklist can help with organizing records. A binder or organizer can keep information together, but it does not create valid legal documents or replace professional advice.

4. Review the plan after major changes
A plan that once matched your wishes may become inconsistent after a marriage, divorce, birth, death, change in a relationship, or material change in assets. Revisit both estate documents and beneficiary designations when circumstances change, rather than assuming an older plan still says what you intend. The ABA’s estate-planning update guidance discusses the importance of reviewing a plan as life changes. A qualified professional can advise what updates are effective under the law in your state.
5. Bring in help when the situation calls for it
Different problems may call for different expertise. An estate-planning attorney can advise on documents and state-law requirements; a tax professional can help assess filing duties; and a mediator may assist relatives working through a disagreement. When family communication has become too difficult for the legal professional to address, a mental-health professional may also be appropriate.

In the ABA article “How to Deal with Family Conflicts in Estate Planning,” attorney Samuel Dangremond writes: “Although completely avoiding family in-fighting in estate planning may not be possible, there are ways to mitigate potential for conflict.” The article also quotes Dr. Marsha Levy-Warren, a New York-based clinical psychologist and psychoanalyst, on referring clients for mental-health support when family communication exceeds what an attorney can address. That is an individual expert’s view, not a legal rule.

Federal income-tax treatment is only part of the picture, and state rules may differ. The IRS says inherited property generally is not income when received, but a later sale may result in taxable gain depending on the property’s basis and sale price. For a U.S. citizen or resident who died in 2026, the IRS says Form 706 is generally required when the gross estate plus adjusted taxable gifts and specific exemption is more than $15,000,000. A return may also be filed to elect portability regardless of estate size. This is a federal filing threshold for that year and circumstance, not a measure of how often families have disputes. Confirm current requirements in the IRS Instructions for Form 706 and with a qualified tax professional.
