3 Illinois Updates That Bolster Mortgage Lender Enforcement

Illinois enforcement updates include mortgage-company and MLO cases, a multistate settlement over education misconduct, and a community-investment rule amendment effective June 29, 2026.

Illinois mortgage enforcement is visible in three distinct developments: state actions against mortgage companies and loan officers, a multistate settlement over a loan officer’s education misconduct, and an amended rule connecting mortgage community-investment reviews to enforcement authority. Together, they show what regulators can act on—not that enforcement has increased statewide. The available reports and orders document examples, not a comparable time series of case volume or severity.

What Illinois’s mortgage regulator oversees

The Illinois Department of Financial and Professional Regulation (IDFPR) Bureau of Residential Finance administers the Residential Mortgage License Act (RMLA) and regulates residential mortgage companies and mortgage loan originators (MLOs). Its enforcement actions can address both company-level compliance and an individual licensee’s conduct. IDFPR’s Residential Finance bureau overview describes the bureau’s role.

1. Company and loan-officer cases address licensing, compliance, and borrower-facing conduct

IDFPR’s 2025 enforcement reports and a December order cover several distinct issues. The reports summarize agency actions; the specific December matter is described in a final order. These examples should not be read as findings against lenders beyond those named.

eHomeLoan and Naveen Aggarwal — May 2025 report The report describes a scheme misleading borrowers into believing they were represented by an attorney, and disclosures that failed to show ownership or interests in affiliated businesses. eHomeLoan’s mortgage banking license and Aggarwal’s MLO license were revoked.
Liberty Home Mortgage — May 2025 report APLD and RMLA violations. Consent order resolving the violations.
Claudia Langarica — December 9, 2025 order Used her sponsoring mortgage business’s letterhead and email while directing clients to her own companies, and did not enter loans in the sponsor’s loan origination system. The order characterizes the conduct as misleading borrowers and lenders and violating RMLA provisions. IDFPR assessed a $7,500 fine.

The February report is available as IDFPR’s February 2025 Enforcement Report, and the May report as IDFPR’s May 2025 Enforcement Report. The Langarica matter is documented in Order Assessing Fine No. 2025-MLO-06.

2. A multistate settlement linked education integrity to Illinois licensing

On December 23, 2025, IDFPR announced that Illinois and 20 other state financial regulators joined a settlement concerning MLO Patrick Terrance Donlon. Regulators alleged that Donlon directed another person to complete required education and claimed the credit. Under the settlement, he had to surrender his Illinois MLO license, was permanently barred from Illinois MLO licensure, and was barred from acting as a control person for an Illinois residential mortgage licensee for two years.

IDFPR reported a $31,000 total fine across the settlement—not an Illinois-only assessment. Its release says other participating states generally receive $1,000 each, subject to specified exceptions. IDFPR Secretary Mario Treto, Jr. said, “The Department takes misconduct by licensees very seriously and will act to ensure Illinois residents are protected from unlawful practices.” Read the December 23, 2025 IDFPR release for the settlement details.

The same release describes state SAFE Act requirements of at least 20 hours of pre-licensing education and eight hours of continuing education annually. Those figures are the requirements cited by IDFPR in 2025, not a new rule announced that year.

3. The community-investment rule has an enforcement connection and a 2026 amendment

Illinois Administrative Code Title 38, Part 1055 provides a framework for assessing covered mortgage licensees’ records of meeting mortgage-credit needs, including in low- and moderate-income neighborhoods and among individuals, consistent with safe and sound operation. The code entry says failure to comply with the Illinois Community Reinvestment Act (ILCRA), Part 1055, or referenced law may be grounds for enforcement under the ILCRA and RMLA.

The Illinois General Assembly/JCAR code entry identifies an amendment effective June 29, 2026. That date establishes an amendment, but the available entry does not establish the details of any new operational requirement. Consult the current full text before relying on a particular implementation change. Illinois Administrative Code, Title 38, Part 1055.

What these updates establish—and what they do not

These records show concrete enforcement tools and the kinds of conduct or obligations regulators have addressed: branch licensing and trade-name compliance, APLD and RMLA requirements, borrower-facing representations and disclosures, education integrity, and community-investment obligations. They do not establish a statewide increase in enforcement volume or severity; the cited reports, orders, settlement, and code entry do not provide a comparable trend measure.
