Why the $30 million headline is outdated
In 2024, 23andMe agreed to a settlement fund of at least $30 million and potentially as much as $50 million for eligible U.S. data-breach claimants. The settlement received final approval on January 30, 2026. On July 7, 2026, the bankruptcy court approved a final amount of $46.75 million—not a $30 million payment to each victim or a $30 million payment made directly to every customer.
The approved amount is a gross settlement fund. Administrative costs, attorneys’ fees, approved claims and other deductions affect what individual claimants receive.
What happened in the 2023 23andMe breach?
23andMe announced the cyberattack on October 6, 2023. The settlement website describes unauthorized access involving approximately 6.4 million U.S. residents. State attorneys general and other public statements commonly cite approximately 6.9 million customers worldwide. Those figures describe different populations, not necessarily conflicting totals.

The exposed material reportedly included ancestry-related and other sensitive personal information. Genetic information is particularly difficult to replace because, unlike a password or payment-card number, it cannot simply be changed.
The lawsuit alleged that 23andMe failed to adequately protect customer information. The settlement resolves those claims without an admission of liability.
How bankruptcy changed the case
The multidistrict litigation began in the U.S. District Court for the Northern District of California as Case No. 24-md-03098-EMC. After 23andMe entered bankruptcy proceedings in March 2025, the matter moved to the U.S. Bankruptcy Court for the Eastern District of Missouri. Following the 2025 sale of 23andMe assets to TTAM Research Institute, the company is referred to in legal materials as Chrome Holding Co. and ChromeCo, Inc. The settlement website continues to use “23andMe” for convenience. Because payments are handled through bankruptcy, the available fund, timing, expenses and other creditor claims are governed by the bankruptcy plan and court orders.

A person generally qualified as a U.S. settlement-class member if all of the following applied:
- They were a 23andMe customer between May 1, 2023, and October 1, 2023.
- They resided in the United States during that period.
- 23andMe notified them that their personal information had been compromised.
Receiving a notice did not automatically create a cash payment. Most cash benefits required a timely claim, and the monitoring benefit required pre-enrollment under the settlement rules.

What benefits were available?

The estimated $100 statutory amount and the “up to” figures were not universal awards. Approved claims, the number of valid claimants and the net fund determine actual payments. A person who took no action may retain access to monitoring under the settlement terms but is not entitled to cash reimbursement or statutory benefits without a qualifying, timely claim.

The dates and current status are listed by the administrator at the official settlement website. Since the filing and cure deadlines have passed, do not assume that the website is accepting new claims.

What can a claimant do now?
- Check the official website for payment and distribution announcements.
- If you submitted a claim, review any deficiency notice and confirm that any required cure form was sent by June 12, 2026.
- Use the administrator’s published contact information for questions about an existing claim.
- Be cautious with unsolicited messages. Do not pay an upfront fee or provide cryptocurrency, gift cards, passwords or full account credentials to receive a settlement payment.

For ordinary settlement questions, the official FAQ directs class members to the administrator, class counsel or the settlement website rather than the court.

42-state attorneys general settlement
In July 2026, 42 state attorneys general announced a separate settlement with the 23andMe bankruptcy trustee concerning state claims arising from the breach. It involves different legal claims and payment arrangements; its reported figures should not be added to the consumer class-action fund or treated as an automatic payment to every class member. California attorney general lawsuit
California Attorney General Rob Bonta also filed separate litigation concerning 23andMe’s handling and protection of customer data. That case should not be treated as resolved merely because the consumer class action settled. Associated Press coverage describes that proceeding.

The accurate 2026 description is that eligible U.S. 23andMe data-breach victims are sharing a court-approved $46.75 million settlement. The original $30 million figure was a minimum in the earlier framework. Cash amounts depend on the claim category and approval process, and the deadline to file or cure a claim has passed. The administrator’s expected September distribution is the next major event for people with approved claims.
