Elon Musk did not personally file a claim that he owns every X account. X Corp. made that argument in a November 25, 2024 bankruptcy objection aimed at stopping the transfer of several Alex Jones and InfoWars-related accounts to The Onion. X said users receive a limited, nontransferable license to use accounts; it did not establish that X owns every post, or that a court has ruled X owns all accounts.
What happened
The Onion’s parent company, Global Tetrahedron, was announced as the winning bidder for InfoWars assets on November 14, 2024. The proposed package included the InfoWars website, trademarks, archives, equipment, inventory and social-media assets. X Corp. filed a limited objection in Jones’s bankruptcy case on November 25, focusing on the X accounts rather than challenging every part of the proposed transaction. The Associated Press reported on the auction and asset package; TechCrunch reported X’s objection.
The bankruptcy followed roughly $1.5 billion in judgments won by families of victims of the Sandy Hook school shooting. The Onion said it planned to turn InfoWars into a satirical project, with the transaction structured to benefit creditors and the families.

Reporting also referred to other accounts maintained by Jones or Free Speech Systems. Jones’s personal account should not automatically be treated as the same asset as the company’s business accounts. The filing concerned accounts connected with the business and the proposed asset transfer, not a judicial declaration about every account Jones has used.

What X meant by “owns” the accounts
X’s position was contractual. According to reporting on the filing, X characterized the accounts and its platform service as X property, while Jones or his company received a personal, nonexclusive, royalty-free and nonassignable license to use them. X argued that a bankruptcy trustee could not sell or assign that license to The Onion without X’s consent. TechCrunch summarized the account and license argument.
That is different from saying a user owns no interest in the account’s business value. A company may build goodwill, followers, customer relationships and a recognizable handle around an account. The dispute is whether those commercial attributes can be transferred when the platform contract says access is personal or nonassignable.

Three separate interests
- Platform property: X’s software, infrastructure, account system and rules.
- Contractual access: permission to log in, post and operate a particular account.
- Content and identity: posts, photographs, trademarks, audience goodwill and business branding associated with the account.
X’s objection principally asserted rights in the first two categories. It did not automatically resolve the third.
Does X own everything users post?
No such conclusion follows from the reported filing. Coverage said X’s position preserved users’ ownership and rights in content they posted while granting X a broad license to host, display and distribute that content under the applicable Terms of Service. The exact contractual language depends on the Terms of Service version at issue. “X owns the account” should therefore not be paraphrased as “X owns every photograph, video or post.” Account access, content ownership and the platform’s license to use content are separate questions.
Why the filing was legally unusual
Platforms commonly prohibit account sales or transfers, but those provisions are usually enforced by refusing a change of control, reclaiming a handle or suspending an account. A bankruptcy sale forced the platform-versus-account-operator question into a public court proceeding. Bloomberg Law reported that bankruptcy courts have rarely had to decide this issue directly.

The legal questions include whether an account is estate property, a contractual license, a personal-services arrangement or a combination; whether bankruptcy law overrides an anti-assignment clause; and whether X consents to the buyer. A business sale can transfer a website, trademark or customer list without automatically transferring the social account used to promote them.

X’s objection was not a final ruling on account ownership. On December 11, 2024, the bankruptcy judge rejected the proposed InfoWars sale after finding that the auction process required further scrutiny. Axios reported the December ruling. The proposed transfer therefore was not completed as an ordinary, uncontested sale of the accounts.

Nothing in the reported outcome established a universal rule that X owns every account on its service, and it did not make Musk a personal litigant in the case. The technically accurate attribution is that X Corp. filed the objection; describing it as “Musk claims” is headline shorthand.
What this means for X users and businesses
Personal users
- Do not assume an X account can be sold, gifted or transferred with your other property.
- Account control does not by itself mean X owns all of your content.
- Your rights depend on the current Terms of Service, account type, jurisdiction and the facts of any dispute.
Companies buying or selling a business
- List the social accounts separately from trademarks, websites, mailing lists and content libraries.
- Review the platform’s operative Terms of Service and any account-specific restrictions.
- Seek written platform consent when an account is material to the transaction.
- Document who controls credentials, two-factor authentication, advertising accounts and linked data during closing.
- Plan for the possibility that the platform will refuse a new operator, rename a handle or suspend access.
A handle may have branding or trademark value without giving its holder an unrestricted right to transfer the account. Private messages and user data raise additional privacy and contractual issues; an asset sale would not automatically transfer them.
Bottom line
X used a bankruptcy dispute over a handful of InfoWars-related accounts to assert a broader contractual principle: users may operate accounts without holding a transferable property interest in the account itself. That is materially narrower than saying Elon Musk personally owns every X account or every post users publish, and no reported court ruling has settled ownership of all X accounts.
