What to Do If You’re Laid Off: Severance, Benefits, and Unemployment

After a layoff, gather your documents and dates, review severance terms, file promptly for state unemployment, and compare health coverage before it ends.

After a layoff, secure your paperwork and key dates, review any severance offer, apply promptly for unemployment through the appropriate state agency, and compare health coverage before your current plan ends. The details depend on your state, plan, employment agreement, and household. This is general U.S. guidance, not a decision about an individual claim.

What should you do first after a layoff?

Start by establishing what happened and when. Your last day worked, employment end date, final-pay date, and health-coverage end date may not be the same. Those dates can affect unemployment, benefits, and coverage choices.

  • Save the layoff or termination notice, final-pay information, benefit summary, unemployment instructions, any WARN notice, and the full written severance offer.
  • Ask HR for the health plan administrator’s contact information, your coverage end date, the COBRA election notice and premium, and copies of relevant benefit-plan documents.
  • Ask how accrued paid leave will be treated and when final wages will be paid. State rules can affect these issues.
  • Keep copies of communications and note when you received each notice. Use the written agreement and plan documents when checking what was promised; do not rely only on a verbal description.

Make a short calendar of the dates and deadlines in the notices. When a deadline or instruction is unclear, contact the relevant agency or plan administrator rather than assuming it can wait.

Do you get severance if you’re laid off?

Not automatically under federal law. The U.S. Department of Labor says, “Severance pay is a matter of agreement between an employer and an employee (or the employee’s representative).” Review your written offer, employment agreement, employer severance policy or plan, and any union agreement. Before signing or accepting an offer, identify what it actually provides and requires:

  • The amount, payment date, and whether payment is a lump sum or installments.
  • Whether any health coverage or COBRA premiums are included, and for how long.
  • Whether payment depends on signing a release or meeting another condition.
  • The response deadline and any other terms that affect your rights.

If you dispute whether an agreement or policy entitles you to severance, or need help understanding a release, consider speaking with a qualified employment-law professional or contacting the appropriate government agency. Do not assume a proposed payment is guaranteed until you have checked its conditions.

How do you file for unemployment after being laid off?

Apply promptly through the state unemployment agency. The federal-state system uses state-specific rules for eligibility, wage history, weekly benefit amounts, ongoing certifications, and filing deadlines. A common qualifying situation is losing work through no fault of your own because work is unavailable, but the state agency decides eligibility under its rules.   1. Find the unemployment agency for the state where you performed the work and follow its claim instructions.
  2. Provide complete and accurate information about your employer, work locations, employment dates, and reason for separation.
  3. Follow the agency’s instructions for weekly or periodic certifications, even while a claim is being reviewed.
  4. If you live in a different state from where you worked, or worked in more than one state, ask the agency where you now live how to file. Do not guess which state should handle the claim.

DOL says the first payment generally takes two to three weeks after filing; that is an expectation, not a guarantee. A claim may take longer depending on its facts and state processing. Continue to follow the agency’s instructions while you wait.

How do you keep health coverage after job loss?

Check your actual coverage end date and the options available to each covered household member before making a choice. Federal COBRA guidance generally applies to private-employer group health plans with at least 20 employees and state or local government plans, subject to details and exclusions. Smaller employers may be covered by state continuation laws, sometimes called mini-COBRA. What to know about COBRA

In the usual job-loss case, COBRA continuation coverage can last up to 18 months. The general election window is 60 days, measured from the later of the date coverage is lost or the date the election notice is provided. The notice should explain your applicable deadline, premium, and payment instructions, so confirm the dates and costs with the plan administrator. You usually pay the full group-plan premium plus a 2% administrative fee. COBRA can be retroactive to the date coverage was lost if you elect it properly and pay what is due; waiting to decide can therefore leave you responsible for back premiums. Compare the available plans, not just the premiums

Option What to check
COBRA Whether keeping the current plan and provider network is worth its quoted premium, including the usual 2% administrative fee; check the election and payment dates with the plan administrator.
Marketplace plan Monthly premium after any income-based savings, deductible, out-of-pocket maximum, doctors, prescriptions, and coverage start date. Loss of job-based coverage can qualify you for a special enrollment opportunity. HealthCare.gov: COBRA coverage when you’re unemployed
Spouse or household member’s employer plan Whether you and any dependents can enroll, the plan’s special-enrollment deadline, cost, and effective date. Ask that plan’s administrator.
Medicaid or CHIP Whether household circumstances and income may qualify you or a dependent; check the relevant state enrollment channel.

Compare expected total costs, including premiums, deductibles, and likely out-of-pocket spending, as well as access to current doctors and prescriptions. Marketplace coverage may cost less for some households because savings can depend on income; COBRA may better preserve access to an existing plan. There is no universally cheaper choice. Confirm the replacement plan’s effective date before ending COBRA or other coverage. HealthCare.gov says voluntarily cancelling COBRA early generally does not itself create a Marketplace special enrollment period; rules differ when COBRA is exhausted. Could the layoff require advance notice?

The federal WARN Act generally requires 60 calendar days’ advance written notice for covered plant closings or mass layoffs. DOL describes covered employers generally as those with 100 or more employees and qualifying events affecting at least 50 employees at a single site. Thresholds and coverage depend on the facts, and exceptions may apply; some states have broader notice laws. A layoff does not automatically mean WARN applies. If a large workforce reduction may be involved, save any notice and ask your state labor agency whether state or federal notice requirements apply. You can also contact your state dislocated-worker unit or Rapid Response team about available transition support.
