What to Do If Your Citizenship Is Revoked: Appeals, Deadlines, and Legal Help

Citizenship revocation has no universal appeal route or deadline. Identify the exact notice, protect the relevant dates, and get qualified advice on the process in the country that issued it.

If a government says it may revoke your citizenship or has already done so, first identify the country, the exact decision, and the deadline stated in the notice. There is no universal appeal process or deadline: the route depends on the country, the legal ground, the kind of decision, and when and how you were notified. Preserve the notice and get urgent advice from a qualified lawyer or appropriately accredited nationality or immigration adviser in that jurisdiction.

What should you do first?

Do not assume that a letter proposing action is a final order, or that a general immigration-appeal deadline applies to a citizenship decision. Read the whole notice, including attachments and instructions, and make a record of:

  • The government department or official that issued it, and the country whose citizenship is at issue.
  • Whether it is a proposal, a request for information, a final deprivation or revocation decision, or a record of a loss-of-nationality determination.
  • The legal ground stated, the date the notice was sent, the date and method you received it, and any deadline or response instructions.
  • The named tribunal, court, department, or review process, and whether the notice says the decision is certified or subject to a special procedure.

Keep the original notice, attachments, envelope or delivery record, and relevant email metadata. Gather prior citizenship or naturalization papers and records related to the stated ground, then make a dated timeline. Organizing these materials can help an adviser assess the situation; it does not guarantee that a particular document will be accepted as evidence.

Contact a qualified local lawyer or appropriately accredited adviser promptly. Ask which deadline applies to this exact notice, what event starts the clock, where and how a response or appeal must be filed, whether an extension is legally possible, and whether legal aid or fee relief may apply. Do not wait for general online guidance to settle those questions.

How do you work out the deadline?

Find the deadline in the notice and verify it against the rule for that decision type. The relevant date might be when a notice was sent, when you received it, when you learned of a decision, or another legally defined event. A response period, statutory appeal period, and judicial-review period are different procedures; one does not replace another.

For example, the UK government’s general immigration-appeal page gives time limits for the ordinary appeal route described there, but those figures should not be transferred to a citizenship-deprivation appeal without confirming the applicable rule. The page separately identifies deprivation of British citizenship as an appealable decision. If the notice gives a deadline, treat it as urgent while a local adviser checks the governing rule.

These examples illustrate why the notice and jurisdiction matter. They do not cover every country or every legal ground for loss of citizenship.

United Kingdom: deprivation of British citizenship

Section 40A of the British Nationality Act 1981 provides a right of appeal against a decision to deprive a person of citizenship. The usual statutory route is the First-tier Tribunal. If the Secretary of State certifies that the decision relies wholly or partly on information that should not be made public for specified interests, the appeal route is the Special Immigration Appeals Commission (SIAC).

There is a special timing rule for relevant orders made without notice: the appeal clock does not begin until the person is given notice that the order has been made. The Act and Home Office caseworker guidance also distinguish certain historic orders, so both the order date and the date you were notified can matter. The materials cited here do not establish one general filing period for every deprivation appeal; verify the rule for the specific order and notice.

Home Office guidance says the right to appeal a British-citizenship deprivation decision may be exercised from abroad or within the UK. Being outside the country therefore does not, by itself, mean there is no appeal right; confirm the filing method and any practical requirements in the notice and current tribunal guidance.

SIAC publishes guidance on applications and time limits for cases within its remit. The cited public guidance was last updated in 2020, so check current rules and the decision notice rather than relying on an old page for a deadline.

Canada: revocation for fraud, misrepresentation, or concealment

Immigration, Refugees and Citizenship Canada (IRCC) describes a staged process for cases involving alleged fraud, misrepresentation, or knowingly hiding information in an immigration or citizenship application. Its guidance says an initial Request for Information allows 30 days to respond. If the process continues, a Notification Letter provides 60 days to submit information or evidence. These are different stages, not a single appeal period.

The Citizenship Act provides for notice of the grounds and reasons, the right to make written representations, and information about how the decision will be made. A person generally has 60 days after the notice is sent to make those representations; an extension may be available for special reasons. Unless the person asks the Minister to decide the matter, the Minister generally must seek a Federal Court declaration to revoke citizenship for fraud. IRCC also describes the Federal Court as deciding revocation cases unless the person requests a ministerial decision.

A separate judicial-review application for leave under the Act generally must be filed and served within 30 days after notification or awareness of the matter. A judge may extend that period for special reasons. This is not the same deadline as the initial IRCC information response or the statutory written-representations period.

United States: review of a loss-of-nationality determination

The U.S. Department of State’s administrative-review process concerns a decision to issue a Certificate of Loss of Nationality or to approve or deny a request for one. The department says an individual may submit a written request with supporting documents and that each case is decided on its merits. This is a specific administrative review route; the cited guidance does not establish one general appeal procedure for every situation someone might describe as citizenship being revoked.

Do not substitute a deadline for an immigration-court appeal for a State Department nationality review. They are different processes, and the State Department notice and current instructions should be checked with a qualified adviser.

How can you find legal help, and what about fees?

Look for a lawyer or adviser qualified to handle nationality or citizenship matters in the country that issued the decision. When you contact them, send the complete notice and ask whether they can advise on the specific decision type and forum, the deadline and triggering event, any extension procedure, and the immediate filing steps. If you cannot afford representation, ask about legal aid or other local assistance; availability and eligibility depend on the jurisdiction and case.

In the UK, the government says an appeal against deprivation of British citizenship is exempt from the immigration appeal fee. That is a fee rule for the appeal, not a finding that you qualify for legal-aid representation and not a guarantee that you will have a lawyer. The cited material does not establish legal-aid eligibility for an unspecified reader.
