In a July 2024 court filing, the U.S. Department of Justice alleged that TikTok and its parent company, ByteDance, used an internal platform called Lark to transfer and search sensitive information about U.S. users. The filing said tools could retrieve information based on users’ content or expressions, including apparent views on abortion, gun control and religion. Those were government allegations in litigation—not a court finding that the Chinese government received the specific data described.
What the DOJ alleged about TikTok’s data
The allegation appeared in a July 26, 2024 filing in the case over a federal law requiring ByteDance to divest TikTok’s U.S. operations or face a ban. The government said TikTok and ByteDance used Lark, an internal communications and collaboration system connecting employees, to transmit restricted U.S. user information to ByteDance personnel in China. It also said some information was stored on Chinese servers and accessible to employees there. The public court appendix contains the filing’s account of Lark and the alleged search capabilities.
The DOJ further said internal tools could gather user information in bulk based on content or expressions, citing apparent views on abortion, gun control and religion. The filing did not mean that users necessarily completed political questionnaires or that TikTok had definitively assigned every person a political or religious identity. The government described ways to retrieve information associated with user activity; the public materials do not establish a comprehensive database of users’ beliefs.
How activity can reveal sensitive interests
Information relevant to a sensitive subject can be supplied directly, observed through activity, or inferred. A person might state an opinion in a post, watch or search for related videos, follow relevant accounts, comment, or engage in other ways. Patterns of behavior can suggest interests without proving a person’s identity, beliefs or position. That distinction matters: a capacity to search information linked to expressions is not the same as proof that every user was profiled or that an inference was correct.

- Observed behavioral data: viewing, searching, following, commenting and engagement patterns.
- Inferred data: conclusions someone might draw from those behaviors.
What the filing does—and does not—establish
The DOJ’s public account described alleged transfers, storage and access involving Lark and internal search tools. The government also relied on national-security material that was classified or redacted. Readers can examine the public filing, but cannot independently evaluate material that was not publicly disclosed. The allegations should therefore be attributed to the government rather than stated as established facts.
Several terms that appear in this debate describe different events. Access means a person or system could retrieve information; it does not by itself show that retrieval occurred. Transfer means information moved between systems or locations. Storage describes where information resided. Disclosure means it was provided to an outside party, such as a government. And compulsion refers to a government’s ability to demand information. The DOJ’s national-security argument focused on access and the risk of possible coercion; the public filing does not prove that Chinese authorities received the specific data it described.

Why the DOJ raised the allegations
The filing was part of TikTok, Inc. v. Garland, in which TikTok and ByteDance challenged the Protecting Americans from Foreign Adversary Controlled Applications Act. The government defended the law on national-security grounds, arguing that Chinese control of ByteDance created risks both of access to large quantities of Americans’ data and of covert content manipulation. The data allegations were one part of that broader legal argument.
How TikTok responded
TikTok’s immediate public response was primarily a legal one. A company spokesperson said the filing did not change TikTok’s view that the Constitution was on its side and that the company expected to prevail in court. Contemporaneous coverage quoted that response. It was not a detailed, point-by-point factual rebuttal of each Lark allegation.

TikTok has separately described its U.S. data-security measures and arrangements in a company explanation of how it protects U.S. user data. Such statements explain the company’s position and safeguards; they do not, on their own, disprove allegations about historical access or transfers. Data stored in the United States is not necessarily inaccessible to foreign-affiliated employees. Storage location, technical permissions, actual use, system administration and legal control are separate questions.
The July filing was not the children’s privacy lawsuit
The DOJ’s July allegations belonged to the defense of the divestiture law. They were distinct from a civil action the DOJ filed with the Federal Trade Commission on August 2, 2024, alleging violations of the Children’s Online Privacy Protection Act (COPPA) and a prior consent order. That case concerned TikTok’s handling of information about children under 13, including allegations that children could use the regular service without adequate parental consent. It was not the same claim as the Lark-related national-security allegations.

The D.C. Circuit upheld the law on December 6, 2024, and the Supreme Court later left it in place. The Supreme Court’s decision addressed the legal challenge to the statute, not a trial verdict finding every factual assertion in the DOJ’s July filing to be true. Upholding the law is not equivalent to deciding that Chinese authorities received the specific user data at issue.

What changed in 2026—and what did not
In a July 16, 2026 opinion, the DOJ’s Office of Legal Counsel concluded that a newly structured TikTok U.S. Data Security Joint Venture did not fall within the federal-government-device prohibition. DOJ cited the venture’s independent operation, majority ownership by U.S. investors, and revised recommendation and cybersecurity systems. The opinion addresses that later joint venture and the federal-device prohibition; it does not resolve the historical Lark allegations or establish that all TikTok data is inaccessible to foreign personnel. Nor does a conclusion about government devices establish that ordinary users receive identical protections.
What this means for TikTok users
The dispute is about more than the data a person deliberately types into an app. It also concerns how activity may be queried, transferred, stored and accessed—and who controls those systems. The public record supports describing the DOJ’s claims as allegations, while distinguishing them from the courts’ decision to uphold the divestiture law and from the separate children’s privacy case. It does not establish that China received every category of data discussed in the filing.
