Viral attention is not proof of value or legitimacy, and no checklist can make a speculative coin safe or guarantee an exit at the displayed price.
Why meme coins carry distinctive risks
The SEC Division of Corporation Finance describes meme coins as crypto assets inspired by internet memes, characters, current events, or trends. In its Feb. 27, 2025 staff statement, the Division says they are typically bought for entertainment, social interaction, or cultural purposes, generally have limited or no functionality, and derive value primarily from market demand and speculation. That is the Division’s staff view, not a rule settling the legal status of every token or transaction.
When demand depends heavily on attention and sentiment, a change in online interest can affect price sharply. The SEC staff says meme coins tend to experience significant price volatility. The CFTC cautions that buying a digital coin only in expectation of selling it later at a higher price is speculation and carries considerable risk, regardless of how convincing a white paper or business plan sounds. Check the token’s rights and real functionality
Start with the exact token, not just its name, logo, or social-media ticker. Identify its network and contract address, then verify the address through a source independent of a social post, unsolicited message, or influencer link. A similarly named token or fake link can send a buyer to a different asset.

Read what ownership actually provides. Distinguish an enforceable or clearly described right or working function from a roadmap, a promise of future utility, or community language about what the project may become. If the only concrete reason to buy is the hope that someone else will pay more, treat that as speculation rather than utility.
Assess demand, concentration, and control
Ask what could support demand beyond a burst of attention: a usable function, a clearly described right, or only continuing promotion and market enthusiasm. Consider who can create additional tokens, change important settings, or sell large holdings. Concentrated ownership or control can make a market more vulnerable to a large sale or a change in project direction.

Look for independently checkable information about promoter identities, token distribution, and control arrangements. Do not assume a published claim is verified simply because it appears in a polished website or project document. General regulator guidance identifies these as due-diligence questions; it does not establish the ownership distribution, code, or control structure of any particular coin.
Check whether you could actually sell
A displayed quote is not a promise that your order can be filled at that price. Liquidity—the ability to buy or sell without a substantial effect on price—matters to the exit, especially if you hold more than a small amount. Trading activity and liquidity can vary by venue, and the CFTC lists liquidity among the factors that may affect a digital coin’s value.

- Identify the venue you would actually use and confirm that it supports the exact token and network.
- Look at trading activity and available liquidity on that venue, rather than relying only on a price chart or a quote elsewhere.
- Consider whether a sale of your intended size might receive a worse price or be difficult to complete.
- Check the venue’s rules and any relevant restrictions before relying on it as an exit route.
The cited guidance does not establish current liquidity or listing status for any individual meme coin; those conditions can change.
Scrutinize promotions and claims
Social-media hype, celebrity images, presale countdowns, and professional-looking sites can be part of a fraud pattern, not evidence that a project is legitimate. Investor.gov describes fraudsters creating and touting memecoins, including presales, to attract buyers and pump prices. The UK Financial Conduct Authority warns that scammers may use social-media advertising and celebrity imagery, as well as sites that manipulate displayed prices or returns. - Treat guaranteed returns, claims of no risk, and pressure to buy immediately as warning signs.
- Verify endorsements and links through independently confirmed channels; an image or a post is not confirmation that a person endorsed a coin.
- Check who is making claims and whether the evidence can be independently examined, rather than relying on reposts or anonymous testimonials.
- Be especially cautious if a presale or promotion makes it difficult to verify the token, its terms, or how a buyer could later sell.
Separate market risk from custody and theft
A coin can fall in value even if your account is secure; separately, digital assets can be lost through hacking or theft. Decide how you would store the asset and protect account credentials and private keys before purchasing. A hardware wallet may be one self-custody option to consider, but it is not a guarantee against every form of theft and does not solve volatility, poor liquidity, or misleading promotion. The CFTC identifies hacking and theft as risks but does not endorse a particular wallet or brand.

Legal treatment depends on the token, transaction, and jurisdiction. The SEC Division of Corporation Finance’s Feb. 27, 2025 staff statement discusses its view of meme coins and the federal securities-law analysis of whether a particular offering and sale may involve an investment contract; it does not declare every meme coin a security or exempt every transaction.

For the UK specifically, the FCA says that since Oct. 8, 2023, firms wishing to promote cryptoassets to UK consumers must be authorised or registered by the FCA, or have their marketing approved by an authorised firm. That UK promotion rule should not be treated as a global rule. Check the applicable regulator and rules where you are located and where the offer is made.
