What Landowners Should Know When Renting Out Farmland

A practical guide to farmland lease structures, local rent comparisons, written terms, stewardship responsibilities, and U.S. tax and USDA program considerations.

Before renting out farmland, decide how rent will be calculated, what the tenant may do, who handles costs and upkeep, and how either party can end the arrangement. Put those terms in a signed written lease and have it reviewed for the state where the land is located. The right rent structure depends on how much payment certainty you want and how much production risk or management responsibility you are willing to take on.

Choose a lease structure that fits your goals

The main choice is whether rent should be predictable or linked to what the land produces. These are broad patterns: the written terms and the parties’ actual conduct determine how a particular arrangement works.

Fixed cash rent

Cash rent offers the clearest payment amount, which can make budgeting easier for the owner. The tenant usually has greater production autonomy and keeps the crop returns after paying rent, while taking on the associated production and market risk. Spell out any limits on use, conservation duties, maintenance obligations, and required approvals rather than assuming that a fixed payment settles those questions.

Crop share

Under a crop-share arrangement, the owner’s return is tied to crop results or proceeds. The parties may also share specified production costs. Agree in detail on the crop or proceeds being shared, how quantities or sales are determined, which inputs each party pays for, and how records and payments will be handled. A crop-share label alone does not determine federal tax treatment.

Flexible or hybrid rent

A flexible lease can combine a base cash rent with an additional payment tied to price, yield, or gross revenue. The formula should identify its inputs, calculation period, documentation, payment date, and any cap or floor the parties choose. Model plausible outcomes together before signing so both sides understand how the formula behaves when prices or yields change. Minnesota Extension discusses base rent plus bonus structures and notes that a particular structure may receive specific FSA treatment; check the current program rules and the parties’ facts with FSA rather than assuming that treatment applies.

Free-use arrangements

Some owners allow land to be used without rent, often by a relative or another person with an established relationship. If you choose this, write down the permitted use, responsibilities, term, and exit expectations anyway. An informal or no-rent arrangement can still leave practical questions about upkeep, access, improvements, and crops in progress.

How to set and negotiate rent

There is no single national rent figure established here that can responsibly be applied to every parcel. Use current local comparisons for similar land, and treat published rates as meaningful only when their geography, land type, survey year, and publisher match your situation. For example, University of Minnesota Extension’s rate resources and worksheet are Minnesota-specific; they are useful as a method or local reference, not as a rate guide for other states.

Prepare a parcel and owner-goals profile

  • Record the parcel’s legal description, acreage, current use, and any buildings, access, water, or improvements included in the lease.
  • Gather available soil and productivity information, and note irrigation, water access, drainage, roads, fencing, and other infrastructure.
  • List known repairs, maintenance needs, restrictions, and conservation concerns.
  • Decide your priorities for rent level, lease length, payment dates, maintenance, and how much involvement you want in farm decisions.

Compare local evidence and discuss the operator’s economics

Compare parcels with similar soil quality, location, size, water access, infrastructure, and productive potential. Ask the prospective tenant to discuss the economics of the proposed use; the aim is to agree on terms that are workable for the operator and consistent with your goals. Decide whether rent is per acre or calculated another way, when it is due, whether it can adjust, and who pays property-related and operating expenses. University of Minnesota Extension emphasizes local rate research and these parcel and lease factors.

Assess pasture separately

For pasture, consider forage potential, fertility, soil and water supply, fencing, and how livestock will be managed. University of Minnesota Extension’s pasture guidance addresses these questions and is specific to pasture; it is not nationwide legal advice.

What to put in a written farmland lease

A signed, dated agreement helps both parties understand what they have agreed to. The following is a practical discussion checklist, not a statement that every item is legally required. The terms that are enforceable, and any required notices or formalities, depend on the land’s jurisdiction and the facts of the tenancy.

  • Parties and property: Give the owner’s and tenant’s full legal names; identify the land by legal description or map and acreage; state which buildings, access, water, and improvements are included or excluded.
  • Term and renewal: Set start and end dates, the renewal method, and any notice dates. Address what happens to an in-progress crop if the lease ends or the property is sold.
  • Rent and payment: State the amount or formula, its inputs, payment dates, and any agreed late-payment, default, security, or prepayment provisions.
  • Costs and upkeep: Assign responsibility for taxes, insurance, repairs, maintenance, utilities, fences, drainage, roads, weeds, and improvements. Specify who must approve work before it is done.
  • Use and stewardship: Identify permitted uses, including any livestock or subleasing; address chemicals, conservation practices, soil and water protection, and any agreed recordkeeping or inspection process.
  • Share arrangements: For crop-share or flexible rent, allocate seed, fertilizer, pesticide, fuel, machinery, and other inputs, and describe how production, sales, or formula inputs will be documented.
  • Access and exit: Set access expectations and address dispute resolution, breach and cure, termination, casualty, and transition responsibilities.

University of Minnesota Extension recommends written terms and legal review. Ask a lawyer familiar with agricultural leases in the property’s state to review the actual agreement, especially its duration, notice, termination, recording, liability, and insurance provisions.

Agree on management, maintenance, and stewardship

Make the owner’s role explicit. State who chooses crops and production practices, who authorizes work, who pays for inputs and improvements, and what the owner will actually do. If you intend to be a passive lessor, make sure the written terms and real arrangement reflect that; if you will participate in production or management, describe the responsibilities clearly.

Discuss soil condition, erosion, water, nutrient inputs, cover crops, and other conservation practices before the lease begins. USDA Economic Research Service report EIB-270, published in March 2024, finds that land tenure and lease horizons may affect conservation decisions, with results differing by crop and measure. This makes it worthwhile to address stewardship in the lease rather than relying on assumptions about what either party will do.

For a pasture lease, specify practical arrangements for livestock management, water, and fencing as well as the broader lease terms. For any land use, say who pays for an improvement, who authorizes it, and whether it must be removed or remains with the property when the lease ends.

Understand the U.S. tax and USDA context

Federal income tax treatment depends on the arrangement

IRS Publication 225 (2025) says cash rent received for another person’s use of farmland is generally rental income reported on Schedule E, rather than farm income. Crop-share rental income may be included in self-employment income when the arrangement provides for the owner to materially participate in production or management and the owner does so. For applicable crop-share income when the owner does not materially participate, IRS guidance describes reporting on Form 4835 and Schedule E. These are fact-sensitive rules: consult the current publication for the relevant return year or a tax professional, and do not infer the tax result from the lease’s name alone.

Check program eligibility with FSA

For specified ARC/PLC and CRP benefits, USDA Farm Service Agency guidance describes contribution requirements for tenants on cash-rented land. Eligibility depends on the program and year and applies to the operator’s circumstances. The tenant should confirm current requirements with the local FSA county office before relying on a benefit.

Check local law before signing

This guidance is U.S.-oriented and cannot settle state-specific lease rules because the property’s state is not specified. Requirements and risks involving lease duration, termination notice, recording, landlord liability, insurance, and agricultural tenancy can vary by jurisdiction. Have the lease reviewed under the law where the land is located before either party relies on its terms.
