What Happens When an Air Permit Expires? Renewal, Enforcement, and Public Records

A timely, complete Title V renewal can generally keep an existing permit effective while the agency acts. The outcome depends on permit type, deadlines, completeness, and jurisdiction.

For a federal Clean Air Act Title V operating permit, a facility can generally keep operating under its existing permit while a timely, complete renewal application is pending with the permitting authority. Without that qualifying application, expiration ends the permittee’s right to operate under that permit. The answer can differ for other permit types and under state or local rules, so check the permit, the applicable rule, and the agency’s written correspondence before making a facility-specific decision.

What happens when an air permit expires?

“Air permit” covers several kinds of authorizations, and their expiration rules are not all the same. The clearest federal baseline is the Clean Air Act Title V operating-permit program. State, local, and tribal agencies administer most Part 70 Title V programs; the U.S. Environmental Protection Agency (EPA) issues a smaller number of Part 71 permits. Construction permits, state-only operating permits, registrations, and other authorizations may follow different rules.

For Title V permits, the permit itself states its expiration date. EPA’s 2024 Title V FAQ describes the permit term as no longer than five years. Treat that as the Title V baseline, not a rule for every kind of air authorization. The issuing authority and the permit’s specific terms control the facility’s situation.

Can a plant keep operating while its renewal is pending?

Under the Title V baseline, a timely and complete renewal application generally keeps the existing permit effective while the permitting authority acts. EPA says the permit does not expire while the authority has failed to issue or deny a qualifying renewal application. The continuation rule does not mean that every pending application authorizes operation: timeliness, completeness, information requests, permit terms, and the applicable program all matter.

The Part 71 example cited by EPA says that a timely and complete application filed within its prescribed window keeps the permit effective until EPA issues or denies the renewal. That example also says the permittee’s failure to have a Part 71 permit is not a violation of that part until EPA takes final action, but the protection ceases if the permittee misses a deadline for information EPA requests in writing. Those provisions are specific to the cited Part 71 framework and should not be generalized to other permit programs.

How early must an air permit renewal be filed?

For Title V, EPA’s 2024 public FAQ describes the timely renewal window as six to 18 months before expiration. EPA’s April 2026 renewal guidance says applicants must apply at least six months before expiration. These are federal Title V references; an approved state rule or the permit may require an earlier filing. Use the deadline in the controlling rule and permit rather than calculating from a general summary.

State rules can set a more specific deadline. For example, Oklahoma’s EPA-hosted approved Part 70 rule requires a timely and complete renewal application at least 180 days before expiration. That Oklahoma example is not a nationwide deadline.

Check the actual date and submission status

  • Read the permit to identify its category, issuing authority, and stated expiration date.
  • Find the renewal deadline in the permit and the applicable state, local, tribal, or federal rule.
  • Record when the application was submitted and whether the authority has determined it complete.
  • Review agency correspondence for requests for additional information and the response deadline.

What makes a renewal application complete?

Completeness depends on whether the permitting authority has enough information to process the application and determine compliance with applicable requirements. EPA’s April 2026 guidance identifies application information such as regulated-pollutant emissions, emission points, emission rates, and limits. An application’s mere submission does not establish that it is complete.

Where permit terms and underlying requirements have not changed, EPA says an authority may allow the renewal to reuse or incorporate unchanged information from a prior application. The authority can still request supplemental information needed to determine applicability or ensure compliance. Documents incorporated by reference must be available for public review.

What if the renewal is late, incomplete, or missing information?

If the application does not qualify for the continuation rule, do not assume that a late filing or an application still under review authorizes operation after expiration. Contact the issuing authority to confirm the status and obtain qualified permitting or legal advice before relying on a continuation exception where operation is at stake.

Take particular care with written requests for additional information. EPA’s Part 71 example makes the response deadline consequential: missing it can end the protection described for that permit. The exact effect of an incomplete application or missed deadline under a Part 70 or other program depends on the governing rule and permit.

Can a facility be penalized for operating after expiration?

Where no continuation protection applies, operating after expiration may mean operating without the required authorization. The specific enforcement consequences depend on the permit type, governing statute, jurisdiction, permit terms, and facts. EPA materials establish that permit noncompliance can be grounds for enforcement, but they do not establish one penalty amount, shutdown outcome, or enforcement result for every expired permit.

Do not infer that an agency will—or will not—take a particular action from the expiration date alone. For an operating decision, verify the facility’s permit status with the issuing authority and get advice suited to the facility and jurisdiction.

How do I find an air permit or renewal application?

EPA’s public-participation materials identify draft and final permits, applications, and other permit documents available for participating jurisdictions and actions. Records are not necessarily available in the same way for every agency or older file. Search the issuing authority’s records or ask it how to access the facility’s permit docket.

Records to look for or request

  • Facility name, location, and permit number, if known
  • Current and prior permits
  • Renewal application and correspondence about completeness
  • Written requests for additional information and the facility’s responses
  • Draft permit, public comments, and final agency action
  • Compliance certifications or reports

These records can help establish which permit applies, when it expires, whether a renewal was filed on time, and what action the authority has taken. The agency’s process for searching or requesting records depends on the jurisdiction.

How can the public comment on a renewal or challenge a permit?

Title V renewals follow the same procedural requirements as initial permit issuance, including public participation, according to EPA’s April 2026 renewal guidance. EPA’s participation materials describe opportunities to comment on draft permits, request a public hearing, appeal Part 70 permits in state court, and petition EPA to object to certain state-issued permits. Which route is available depends on the permit and action.

For a Title V petition, EPA generally requires the petitioner to have raised the issue with the permitting authority during the notice-and-comment period, unless doing so was impracticable. EPA’s Title V Petitions page, accessed October 4, 2026, describes a 45-day EPA review of a proposed state permit and, if EPA does not object during that review, a 60-day public petition period. These are petition-process periods, not renewal filing deadlines. Check the current action-specific deadline and submission instructions; EPA says the CDX timestamp determines whether a submission is timely.

How can I report a suspected air permit violation?

Separate a concern about permit content from a concern about compliance. A petition questions whether a permit is legally adequate or contains proper terms; EPA directs the public to report suspected noncompliance through its Enforcement and Compliance History Online (ECHO) system. A report does not itself establish that a violation occurred or determine the agency’s response.
