What Does a White House AI Adviser Do, and Who Sets U.S. AI Policy?

A White House AI adviser helps coordinate the President’s agenda, but U.S. AI policy is shared among the President, agencies, Congress and states.

A White House AI adviser helps the President set priorities and coordinate federal work on artificial intelligence; the adviser does not control all U.S. AI policy. The President directs the executive branch, agencies act under authority granted by law, Congress enacts federal statutes, and states retain roles under the constitutional and statutory framework. The Office of Science and Technology Policy (OSTP) is central to White House advice and coordination.

What a White House AI adviser does

“AI adviser” describes a policy role, not a single office with authority over every government decision about artificial intelligence. OSTP advises the President and the Executive Office of the President on science and technology matters. Congress established the office in 1976 for that advisory function. Its Director leads White House technology-policy work, including AI, and chairs the National Science and Technology Council (NSTC), which convenes senior federal officials to coordinate science and technology policymaking and integrate the President’s agenda across agencies.   • Advise: Provide scientific and technical analysis to help the President and the Executive Office of the President make policy decisions.
  • Coordinate: Bring agencies together through NSTC and other White House processes so related federal work can follow common priorities.
  • Shape plans: Help develop administration-wide strategy and assign proposed or directed work to relevant departments and agencies.
  • Connect priorities to resources: OSTP assists the Office of Management and Budget (OMB) with annual reviews and priority setting for the federal research and development budget.

These duties influence the executive branch’s agenda, but coordination does not give OSTP or an adviser powers Congress has not granted. Agencies remain responsible for acting within their own legal authorities.

Who sets U.S. AI policy

AI policy is made through several institutions and legal instruments. The useful distinction is whether an action is advice, an executive direction, an agency action under existing authority, a legislative proposal, or enacted law.

Actor Role and instrument What that means
President Sets executive-branch priorities and may direct agencies through executive orders, subject to law. An executive order directs executive-branch work; it is not an act of Congress.
White House, OSTP and NSTC Advise, develop strategy, convene agencies and coordinate cross-government work. They can shape priorities and coordination, but cannot displace statutory limits or Congress’s lawmaking role.
Federal departments and agencies Carry out assignments in laws, executive orders and policy plans using their legal authorities. A White House plan is not, by itself, a grant of unlimited agency power.
Congress Enacts federal statutes and can establish, amend or limit agency authority. A White House framework asking Congress to legislate is a proposal until Congress enacts a law.
States Act under state law and govern their own operations, within the constitutional and statutory framework. Federal-state disputes depend on applicable law; an administration’s preferred preemption approach is not settled law merely because it appears in a proposal.

How the White House’s AI agenda moves from plan to action

Joint planning, rather than a single adviser acting alone

A January 2025 White House order assigned development of an AI Action Plan jointly to the Assistant to the President for Science and Technology, the White House AI and Crypto Czar, and the National Security Advisor. That assignment illustrates how the White House can divide policy development across senior officials rather than vesting it in one AI adviser. The January 2025 order set that planning task.

Agency assignments and implementation

On July 23, 2025, the White House announced America’s AI Action Plan, describing it as containing over 90 federal policy actions grouped under accelerating innovation, building American AI infrastructure, and international diplomacy and security. The plan assigns work to bodies including OSTP, OMB, the Department of Commerce and NIST, the Federal Communications Commission, and the Federal Trade Commission. Those assignments are carried out by the named agencies within their legal authorities; the plan itself does not convert the adviser into a regulator or lawmaker. The White House’s July 2025 announcement identifies the plan and its action count.

The announcement identified Michael Kratsios as OSTP Director, David Sacks as AI and Crypto Czar, and Marco Rubio as Secretary of State and Acting National Security Advisor for purposes of the plan announcement. These are dated attributions from that release, not confirmation of later personnel status. The release also quoted Kratsios describing the plan as a course to cement U.S. dominance in AI and Sacks saying the United States must win the AI race. Those are administration arguments for its agenda, not neutral findings about legal authority or the outcome of the competition.

Executive orders can assign defined work

A June 2, 2026 executive order assigned cybersecurity-related tasks across the Treasury Department, Department of War, Homeland Security and CISA, OMB, NSA, and other officials. It also directed development of a voluntary framework for certain frontier-model access and collaboration. The order expressly says it does not authorize mandatory government licensing, preclearance, or permitting for AI model development or release. As with other executive directions, the agencies named must act within their legal powers. The June 2026 order sets out its assignments and limits.

A legislative framework is not a statute

In March 2026, the White House issued a National Policy Framework as legislative recommendations. It advocated federal legislation that would preempt certain state AI laws while describing proposed exceptions, including generally applicable consumer and child-protection laws, zoning, and state use of AI. The framework states the administration’s position; it does not itself preempt state law. Whether any proposal becomes binding federal law depends on Congress and the applicable legal process. The White House framework describes the recommendations and exceptions.

How to read claims about who controls AI policy

  • Check the instrument: Is the document an executive order, a strategy, an agency rule or action, a legislative proposal, or an enacted statute?
  • Check the status: Does it propose work, direct an agency to act, report completed implementation, or establish law?
  • Check the responsible institution: Identify the official or agency assigned the task instead of attributing every action to “the AI adviser.”
  • Check the legal basis: Agency action depends on the authority Congress has provided, and executive directions remain subject to law.
